Guys if the employer's lawyer is not giving you information regarding the I140 and you are going behind their back for this information is it really going to help you with portability? It looks like they are just trying to make life miserable for you and what guarantee is there that they will not revoke your I140? I140 portability does not work if they revoke your I 140.

With all due respect, the probelem I have with volunteers is that I don't think amtures can pull a job this big, you've got to have profesionals, somethng like a compain maneger.
I admire the courage of your guys, and think the goal is fantastic. But the way it goes, I don't see how it can be achieved.
I've learned a great deal about immigration from the forum here. I very much appreciate it. I try to give back by answering questions others may have. I think IV has been doing a great job serving as that capacity.
But you guys want do something bigger. Well, you have faith in it, I don't, at least not now, neither many others. Maybe that is why you are still asking for money and volunteers.

i am a silent reader of this forum. you have to agree that iv has given the opportunity to file i-485's...forget about how many has not filed or missed the window but they provided the opportunity...and if you don't want to contribute then simply don't do....stop underestimating them....they do something about it instead of allowing changes to happen by themselves...they try to make changes in every possible aspect...so please don't contribute if you don't want to and stop badmouthing them.

I was under the impression based on some posts I read on other websites that even if your I-485 is approved before you applied for I-485 for your spouse, you can still add her if you were married before your I-485 approval date. Can someone confirm this ?? I feel the best way to handle the situation would be to apply for the I-485 of spouse on the date the PD becomes current. Keep all documents and applications ready and file on the first date. Since visa bulletin comes out 15 days in advance its good lead time to make preparations even if the movement of date is sudden.
you are right on the money!!But i don't see any use for guys with PD>2006 coz anyway they would have to wait for more than 3 years to file their spouses bcoz of retrogression. y not wait for PD's to bcum current at a later date and apply together..GET IT!!!

USCIS has specified that they would have processed all the records into a single database by 29th October.
Does this not mean that there could be a forward movement in the Nov bullietin ?

Guys,
I am also close to situation 3.a but I changed my GC sponsered employer and working for other good and stable company using AC21.
I would like to start a company and do a side business.
What you recommend - registering it on my is good idea or on spouse's name?
If I register it on my name and generate a profit - is it going to impact my 485 as I already invokded AC21? (again I will be working in simialr job as a FT)
Any sugessions would be great help.

If you are on 3a, you have neither used AC21 nor have you left your full time job (FT job that aligns with your LC). On EAD, you can do any number of jobs (ex: you can even work 2 part time jobs totally unrelated to your LC requirements ofcourse as long as you continue to be with your GC employer). Using this rationale, you should be fine starting a business and making profit in the part time.
In fact even those who were in 3 b were able to get their GC after an interview (Search for posts by the user "unitednations"). But, it's risky and best avoided.
Personally, I want to get into 3 a, but my 140 is still pending. I plan to approach my company to switch me to EAD as soon as my 140 gets approved.

No, it wasn't. The 1999 quota was exhausted in April 1999. Granted this is better than the situation today, but not by much as the quota was larger that year and the economy was smaller.

For those who think assisting US economy by buy houses (for pending GC applicants) is like selling a GC are just plain dumb! No wonder why we dont have a resolution to the 10 yr waiting that's been killing EB immigrants, is because ppl like you, who love to take pain want others to live through this for the lifetime.....................

Change the language and target too. I am thinking to draft a letter to send Home Builder Assoc and Car companies that I am not able to buy Home and Car because I am not getting loan. I need a car and home as I am paying rent every month around 1500. I am willing to pay 25% down and have credit score more than 700. No any kind of violation. Paied off first car loan. I am experienced enough to find another job in such bad economy. The only thing that I dont have is GC for which I am waiting for last 8 years. If I get GC probably I will get good loan faster and cheaper. If you lobby for us for GC probably not only me many other immigrant will get loans.
Never ever mention that it will improve economy.

Out of curiosity, what are your thoughts on ROW EB3?
I wouldn't expect any movement for EB3 ROW. I'd be happy if it doesn't retrogress further or turn out to be "U". I Base my assumption on the horizontal spillover from EB2 ROW to the rest of EB2 categories. If there is any movement for EB3 ROW i would guess it would come sometime in the 4th quarter.

E-Filed - June 15,2008 (for both me and my wife)
FP - July 12,2008
July 23 - My wife's EAD approved
July 30 - RFE for photos(?)
August 4 - received RFE letter
August 6 - responded RFE (sent photos)
August 7 - uscis received RFE(case resumed)
my current EAD expires Sep 26,2008
For the past 2 days trying book get infopass. I am getting a message saying "No appointment is available, Please try again later".

I work for Fortune 100 company and we are celebrating Diwali on Friday. There are flyers on all the corners and are expecting more than 500 co-workers for pot-luck lunch. And the best part, organizer and main activists are non-Indian. So its just another festival in the mix that everybody is looking to enjoy. This is like the banana joke in an old tamil movie, it is over 157 days and the USCIS now wants to go by processing times which mention july 3rd processing date, which is still late, but then they will say it is just one day over your receipt date.

I think it is a very good point. It was rediculous for some to get the GC in few months while others from other centers were waiting for years and still waiting. There needs to be some order to this madness and when got a chance this needs to be brought to attention.

Who ever go for testifying before congress should hightlight the USCIS mis use of VISA numbers during 2004 and 2005 by approving all latest cases and even though there are pending old cases

Why don't we mail copies of our degree certificates, diplomas and other credentials? They will know who is more educated..Lou Dobbs or us !!!
