Medical report is a valid evidence and if its missing they will surely issue an RFE when they are adjudicating your case, whether its now or 1-2yrs later. Since the medical report is valid only for an year if you get the RFE an year later you might have to do it again.
One thing you can do is, once you get your receipt notice you can send your current medical report along with the copy of RN and a cover letter saying you are sending a missing document. Your lawyer should be able to assist you in this.

I know two of my friends who's wifes were on H4 then converted to F1 and were working on OPT and then filed their I-485's and are now working on the EAD got from the AOS.
I dont think there is any problem in applying for your wifes I-485. In fact I think you would be foolish not to apply for her. More over you are the primary applicant. If your doubtful then take up a paid consultation with top lawyers like Murthy, Mathew Oh etc
The only problems if when you travel and say if you can apply I-485 then she has to just be patient till her AP comes and then she can travel on that

If its mailed out today, then you are ok. Its the POSTMARKED date that is seen. So even if it reaches there in July, as long as it went OUT today, they will have to accept it under June's batch of applications coz it is postmarked in June (june 29).

I hope my attorney really mailed it as they told me yesterday "your appplication is in Fedex envelope already, to be sent out Friday morning for Monday delivery"
My problem is a little more complex than that. My lawyers kept telling me from Dec' 2003 that my LC was filed under EB-2 since I have a BS+5 ... When they filed I-140 last year which is still pending, they kept telling me it was under EB-2..... yesterday when I emailed to ask if my application was out, an associate told me that it was ready in the Fedex envelope and scheduled for pickup today morning and that they had kept it on hold because my PD was becoming current only on July 1st...
that was a surprise to me because I thought I was EB-2 and my date was current as of June 1st... she said she didn't know anything about that and that the lawyer had instructed her to put it on hold for shipping Friday morning....
May be some kind of confusion on her part.. otherwise why would they accept and start working on my case right after the june bulletin which was released in May..

I guess we'll need to ADD to that number:
1. BEC stuck folks who could not file in July 07
2. PERM approvals starting August 07
to the 47,728. Plus multiply by 2.1( for dependents ). That'll give the total VISA numbers required for this category to make it Current.
If I have to guess-- (1) would be very less, may be 100-200 max
(2) around 5000 ( just a PUMA)
So, there are about 53000 EB2 I applications. and 2.1 * 53000 = 111300.
If we can create 111300, EB2 I visas then it'll be CURRENT. easy:)

In fact lately, judges have even upheld firings of smokers from certain companies.
IF there is a pattern of discrimination based on age, sex, national origin etc etc. THEN you can sue.. but NOT just because you don't like the policy of the employers..

Can we ourselves verify the data in PIMS even before going for stamping? Is this info public anywhere? This would help us to take better decesion on whether to go for stamping or use AP.

I'd appeared for my H1B (F1 to H1) Visa interview on the 4th Jan at Mumbai. After almost 4 hours of waiting, the visa officer told me that they were unable to view/ verify my I-797 info as it was not updated in their Database. I was also told that this is an existing issue and that I should ask my company lawers to contact the Immigration Services office at DC. On being asked she told me the eta was 7-10 business days (or however long it takes for the info to get updated). I was then given the yellow slip and asked to submit my passport for stamping, after I receive an email indicating that my data is now updated. it's been 8 business days since my initial interview and I still haven't received any emails or calls.
1) anyone who interviewed on or around 4th Jan who has received a call or email?
2) Anyone who's aware of the procedure by which my company can expidite this issue (maybe through our lawyers)
3) any additional info on how long the wait might be?
I was told that on the 27th dec there were about 350 H1b pending cases (yellow slip) at the Mumbai consulate and around 150- 200 similar cases the following days. A freind of mine who appeared for his H1b interview on the 7th breezed through it with no issues.

Thats the right way. Probably I should not have told him that I have AP in my hands. This is what my attorney said. But now I have no idea if my h1 will be extended or not once I have used the AP.
If you really want to be on h1(very safe decision), why don't you leave for a couple of days and re-enter on your H1?

I'm also in same situation only difference is my visa stamped in PP is expired (Jan06), but has H1 till Jan 2009. I'm planning to visit India in Feb07 and return on AP. As I read in other forums that H1 will be valid and we can file for extension (even Cornin INS Memo (5-16-00)) memo says that. My attorney also confirmed that.

I would suggest you to get h1 your visa stamped from India and enter on h1 and not on AP. Don't even show your AP to the immigration inspector at the POE.

From what i gather, this idea was tried with lawmakers before.
But to change citizenship laws is far more difficult than changing the quota cap of a (GC) process.
Never-the-less, we should not give up.
Say, in the bargain for citizenship after 10 yrs of Legal & crime-free stay we get GC instead, still a deal.
Can we have a plan of action as a consensus?

I called the Nogales (mexico) US embassy and they were able to look up the PIMS system using the petition number.
I hope the PIMS is a "centralized" system. So even the consulate in India would be using the same.
