    Hi All,

    I opened a service request with USCIS when my I485 was current in 09/08 and i got response saying that still investigation into my background remains open, so the case is not yet ready for decision. I filed my I 485 in August 2005 and in july 2007(then my file was current) also i was told that the background check is still going on.

    Now we know that if it has been more than 180 days after we file I485, no need to wait for background check to process the petetion. My intention is to get my file out of this loop by the time PD becomes current. If any one had this issue and got it resolved, please advise me how i can handle it.

    the change in salary ($76K to 120K) is a cause for concern. It depends how long ago you filed your labor. If it has been greater than 5 years, IMO the salary change may be ok. Rather than the titles, the job duties have to reasonably match.

    1. You can definitely change the employer and invoke AC21. No issues there..

    2. You can change AOS to consular, but not after you've invoked AC21.
    Actually there's probably a way to do that too , but maybe a good (and probably expensive) lawyer needs to be consulted.

    They are increasing the fees only for the other apllications. I-485 and the related ones will maintain the same fees until August 17th. I think it says so on the announcement from USCIs.

    All other forms except i-485 the fee increase will be effective from july 30th and i-485 will get increased post August 17th:)

    I applied for my I-140/485 together in the last week of June. I havent got the receipt numbers yet. My wife is on H1 and since she is not the primary application on my 485 forms, is it okay if she changes her job. Will her H1 transfer affect both of our applications.

    My H1-B is valid from September 14 2006 to September 14 2007.I got laid off recently; my LC is pending Dallas Backlog center last 3 years, I got new job and submitted my last pay stub December 15 2006 to my new Lawyer with my ex lawyer contact address. I do not know whether there will be any hassle in USCIS for my H1-B 8th year extension approval? My new lawyer is yet to file my premium H1B extension. I am very anxious regarding the uncertainty of extension.

    Is it enough to get 3 year extension with courtesy copy of I140 approval ? I am asking this because my company has just given the courtesy copy.
    Also I understand that the old Eb3 PD can be used to get extension(how can employer revoke approved labor certification ??)

    H1b Can be filed anyday and you friend can start as soon as the H1 gets approved.

    I have to work 20 hrs per week part time apart from my full time 40hrs per week. Since I am not working 35 hrs per week as you said does this mean my GC process will have a effect?

    My limited understanding about the GC process is that from the day I-485 is filed, a person may change his/her job only after 180 days or more, and of course by filing AC 21.

    Yes, you are correct.

    Also, in case the I-485 does not get approved within the 180 days after filing, then how can a person change a job without having an EAD.

    You can file for EAD along with 485 or after you file 485 - EAD will be issued within 90 days (as of writing w/ current processing times) from the date of filing. You can change job only after 180 days filing 485 - In order for you to work for another employer you need EAD

    A person can EAD only once I-485 is approved? Is that correct.

    You will get GC itself once 485 approved, there is no need for EAD - EAD is a temporary work permit set to expire in 1 or 2 years from the date of issue

    Yes, that's correct. Especially if you are subject to 3 or 10 years bar.
    For how many months is it valid?
    For 1 year.
    DO you need a lawyer to re new it or is it an easy process that any layman can re-new on their own?
    No, I did it myself twice.

    So if the company requires an MBA + 0 for the job that could work?
