Reason most people filed in EB3 was that it was thought that their application will be subjected to less scrutny and had higher chances of success. Also, so far EB3 has been moving in tandem with Eb2, so it did not matter.

In most cases it would be pure ignorance on the recruiter's part. A simple phone call from OSC will clear that.
Of course the best course is to avoid bringing up EAD in the first place. But if it comes to that, you can reach out to OSC, even if you don't have anything in writing.

Anybody who was in India and got greened during that time. I want to understand how it played out upon entering US then? Can somebody reply back here with such an experience. Where to go ? Visa queue or Permanent Residents queue. Show them visa or adv parole or email print out which says welcome to new permanent resident. What happens then? they stamp the passport or allow you to enter under what status?
I want to understand this please. My wife is coming to US on Sat and we got greened yesterday. I want to inform her. My attorney does not know but he says yes she will be allowed to come in for sure and it will be an odd entry. Any experiences please advise.

I think we should not loose hope and feel USICS will wake up and resolve all this mess
1) 4-6 years back there was big mess of labour blachole: people started rasing their voices, companies started writing letters and finally they started BackProcessign centers, streamlined process and finally labours were approved
2) I 140 was taking hell of a time: people started writing letters and ther esult was Premium processing( Even though they have s toppe dit now but still USCIS had listed to us and gave a path to resolve our issues)
So taking all these into perpective, I think all EB3 folks should not loose their heart, but we should make an effort to appraise USCIS,Congress,Senators of the pain of EB3 folks who are waiting for a long time to get their american dream realized.
So dont get dishearted or loose ur focus by others comments, no one dreamed in 2003 that labours will be approved,but still they got approved.So today we maybe facing lot of negative vibes and comments that it snot going to happen and no law tells the EB3 should get their visa's before EB2.So my fellow EB3ians PLEASE write as many letters as possible, as many calls as possible to make it happen.
It all starts with a dream, a zeal to achieve it.So I think it is possible if we make a collective effort .

My lawyer also uses fedex, I dont think fedex delivers on saturday so I guess I am fine , right ? (Unless fedex guy goes out of his way and delivers on saturday to improve his performance!!)
Yes you are fine as long as he does not choose saturday delivery, which is very highly unlikely, and I guess he might be aware that the application should reach only on or after 1st july.

actually it does matter, right. what happens if the dates retrogress significantly for EB2 again, because of the influx of EB3 to EB2 ports? Then EB2 folks with later priority dates will miss the boat.
But the question is whether the EB2 folks who are missing out are getting an "unfair" deal. That is debatable.
Let us assume that EB2 is going to be current in a year or even sooner than that. Given that situation, and arguing that about 500 people jumped ahead into line over you in to EB2 from EB3, still I do not foresee that their GC's will be approved before the people who are already in line, because
1) as FIFO is not being followed by USCIS, probably they are processing cases based on RD,
2) PD porting is effectively done at the time the second I-140 IS APPROVED. At I-485 stage you can only hope to PD recapture and cross your fingers after sending a no fee letter. This will surely would need additional scrutiny, hence is not a so called 'Low hanging fruit'. Even if an EB3 person wants to start his process right now, it will not be probably before a year and half to two years before he/she is ready to port, and by that time you are past the gate or significantly nearer.
so my point of view is if you look at this thing negatively, you would have a Heartburn and related health issues, but if you are positive and an optimist you would deserve what you get.

I agree. The companies should feel the pain. our cause should get sympathy from the americans. We need publicity for our causes.

I came across a couple who got their H1B approvals last yr with in 3 weeks to each other. One of them was in PIMS and other one not. So I feel approval date does not seem to be a criteria to base these delays upon.:confused:

It's funny how many types of personalities you see in everyday life. I remember in my early childhood days there always use to be one guy at the least in my class who would do things that would freak everybody out....usually he would be the teacher's cutest student. But once the teacher was out.....maan his ass was all red in the hostel, in the class.....just kept running away from every other fellow student.....
