    Hello All,

    I am a silent reader of Immigration voice forum and have got great information about H1B and other related issues on this forum.. Today, I am in dilemma as what to do in following situation and I thought you all will be able to help me by answering my questions. Here I go:

    I am on H1B and my wife [on H4] graduated [MS] in Dec'06. Because she completed her MS in Rehabilitation counseling on H4, she does not have OPT to start the work. Now, she has got a job offer from private rehab firm and they are ready to file her H1. I would like to know following:

    1. Is she eligible for 20000 MS quota exemption?
    2. According to H1B visa reform act of 2004, such exempt applications were allowed to be filed on March 8, 2005 for FY2006. Is this the case for future fiscals as well?
    3. If the H1B application is filed by lawyer say on April 1, 2007 in premium processing, can it be approved in 15-20 days i.e say April 15.
    3. If she gets the I-797 on April 15, what will be the start date on it? Will that be October 1 or can she get earlier start date i.e. Say April 15, 2007?

    The problem is if the visa start date is October 1, 2007 then the employer might not be ready to wait that long.. In that case, what are our options?

My character had my same name, Carlo, and eventually I got a job at Mr. Hooper�s store. I had to make a birdseed milkshake for Big Bird, that was my tryout. I ended up appearing on �Sesame Street� for five years. But the whole time, I had a secret: I was an undocumented immigrant. The papers I�d used to get hired were fake.My family had come from Ecuador when I was seven and my older brother Angelo was nine. We came on a tourist visa, and the moment my parents had gotten it, we knew we were not coming back. They sold all our furniture before we left.

    My mother had a sister living legally in the United States, and my parents planned to have her sponsor us for residency. Soon after landing in New York, my parents saw a lawyer. But we were told the process would take four or five years.

    Coming to the States was traumatic. In Ecuador, we had lived in a house. Here, we were in a small apartment. We didn�t know any English. But you know, at that age, things change quickly. In six months we were speaking English and running around like normal kids. Most of the time, we blended in. But we knew weren�t supposed to be here, and we lived with a lot of fear.

    I started acting when I was 11, almost as a fluke. One day, we went to visit our cousins, and they were on their way to try-outs for a community theater production of �Oliver!� It was through a program put on by the city, to get disadvantaged kids off the street. When we got there, the producers were like, �You should try out, too.� So my brother and I did. Then we all went to lunch. When we got home, we had a phone message that we�d both been cast. I was Oliver.

    Now working on H1b, 8th year
    PD: Oct 2005
    I 140: approved
    I 485: pending
    AP, EAD: approved

    I want to change job to another employer.Can the new employer file an H1b for me based on my approved I 140. I prefer to be on H1b as traveling is easier and don't have to wait for the EAD, AP each year and the uncertainities invloved.

    I would appreciate replies.

    Indeed the consulate websites are confusing. Anyway I found the NOC form.
    My daughter had 5 year passport which is expiring soon. So you have to apply for new passport.

    Hello IVians,

    I am with company A on L1B in the US. Company B is processing my GC for future employment. Now my L1B is up for renewal in December. There is a lot of paperwork that my company has asked me work on. In one of the questionnaires, I am asked if my labor / 140 / 485 is pending. I don't know what to answer.

    Does any of the forms for L1B renewal needs this info? Will it be an issue if I say no? Does USCIS really care?

    Pls share your experiences.

    Just a heads up about the new filing requirements for I-129s and I-140s. See link. In a nutshell all I-129s go to Vermont Service Center and all I-140s go to the Nebraska Service Center.

    One of my friend is in the same situation and he has been told by his lawyer that he can get his part-time concurrent H1 Extn for 3 years based on fulltime concurrent H1 approved I-140.

    He is going to apply the same soon.

If I-94 issued for 1 year, suppose we change home address from one state to another state, until what time the driver's license will be issued(most of the states check the I-94 validity end date)? will it be only 1year till the I-94 expires? If yes, what is the process of renewing the driver's license after one year.

    You have to be "in-status" to apply for AOS. The IO wants evidence of your continued non-immigrant status before you filed your AOS. Also, remember AOS does not grant you a status. It just lets you not accrue unlawful presence

    1) Bank deposit in US around 9000 $
    2) deposit in india about 10000$
    3) Job No objection certificate ( parents )
    4) affidavit's of support
    5) They carried all property documents in india ( valuated by CPA )
    6) my H1b1 copy and a letter of invitation from me

    I think it goes around intent. Does your sister show signs of staying in the US or does she fully intend to return. Proof of reasons for her to return would be good to have on hand.
