Hi Every one,
I'm on OPT right now ,i'm done with my masters in DEC 2007.
My visa Stamp in my passport was only untill april 2008(I got F1 stamped only for 24 months), now i'm on OPT extension.I applied H1B in 2008 and got RFE my employer could not answer the RFE and revoked my petition.
I did't apply in 2009 even i have chance to apply(because of the JOB fear ) i got my OPT extension approved ,my OPT extension is going to end in June 2010 , any way i will be applying H1B in 2010.
My question is if i don't get H1B in 2010 ,my plan i to take CPT and search for jobs ,does it effects my future immigration any way.

Hmm ... Are you still enrolled in your school as a student in good standing? AFAIK, you can avail CPT only during your study period, not after it.

It looks like you are getting glare from glass or something. Get as close to the glass as you can and the lens as perpendicular as possible. A dark cloth and duct tape to put it up with would get you two things: (1) ability to block glare from lights behind you and (2) hide you from the birds so they settle down.
I've actually put the camera on a tripod and draped a large towel over it and my head/torso for camoflage, which let me stand outdoors and get closer without scaring them away. But I don't do that much because it's really tiring standing there, motionless :)
For the most part, a flash doesn't seem to bother birds much and it's a great help - you get better contrast and a faster shutter.

You can also extend the H1b...if your labor is filed 365 days prior to your H1b expiraton...
You are looking atleast 21 months into future...there are so many things that can happen...
140 rejection may not be an issue... but in case your worst fear comes true...you will be alright if it's rejected before feb 2008.
Even then there are other ways around this problem...

We got our EAD cards today.
We had gone for FP on Sept 19th and saw LUDs on Sep 20th on our I-485s. But the EAD cards came without our fingerprints. EAD cards came from the same Service center (Nebraska) where the FP notices came from. So wondering, how they did not include our fingerprints in the EAD card?? I had also checked with FBI helpline two weeks back and verified that the FPs were delivered to USCIS.
Anybody else in similar situation?

When you did your FP, for what particular benefit it was intended? Was it strictly for 485 or was it combined for 485 and 765? If it was just for 485 - why do you expect it appear on your 765 and EAD card? As far as it known, 485 and 765 are complete different things and not related to each other in any way. Didn't you know that?

EB3/EB2 categorization depends on a lot of other factors. But I understand your question is about base eligibility.
In general Masters requirement for a job is considered to be eligible for EB2.
Similarly Bachelors+5years exp req for a job is also considered to be eligible for EB2.
So your employers advertised job "could" very well be EB2 if all other conditions are met.

Inorder to take the priority date with you, the I140 petition (after the labour approval) needs to be approved.

H-1B visas are work visas that allow foreign nationals to temporarily work in the United States for a U.S. employer.
