It appears that US CIS lost my I-90 application a year ago and subsequent attempts to get a replacement GC failed thus far. Best course of action?
Here are the details...
Received GC in 1999. Last year when I tried to get a re-entry permit (I-131), US CIS mailed me a notice saying that my GC had the wrong A-number on it (US CIS administrative error), and needed to be replaced via I-90.
The notice also said that while waiting for the replacement GC, I could go to the district office, obtain a temporary GC, and then re-file for I-131.
So in January 2007, I filed the no-cost I-90, where the reason was, "My card was issued with incorrect information because of a USCIS administrative error. I have attached the incorrect card and evidence of the correct information." The application included the original GC with the "bad" A-number, and was sent via certified mail, receipt requested. Later, I received a confirmation from US Mail that the application was delivered.
Subsequent multiple requests to US CIS produced the response, "We have no record of your application". Subsequently mailed copied of the I-90 application, produced a response, "denied, your did not include a GC with your application".
I did another "Service Request" with US CIS yesterday, and am pretty sure the response will be the same, "We have no record of your application".
What would you suggest as the best course of action? Just file a full cost (about $300?) I-90 declaring the GC "lost", and forget that it was the US CIS error?
Thanks for any help!

IV needs volunteers
As the time approaches for heated immigration debate on the Hill, behind the scenes IV activities are also are also going to increase. IV core members have full time jobs and thus we need more hands to share the mission we have all been working on.
This is a request to IV members if they are willing to spare a few hours everyday for some IV's work. This work will involve writing lots of emails (a template will be provided) and making phone calls.
We all are going through a lot of frustration due to the delays in our green card processes and I am sure highly skilled and educated spouses that are on H4 would have more than our share of pain due to not having any work permit. If we could have such volunteers who can devote few hours during the day for IV it would a Big help. With everyone's effort and support we will surely succeed.
If you would like to help us, please write to himanshu at immigrationvoice.org

Hello EliteG000,
Unless the animation is created in another application such as illustrator, the files size for anything created within Swift such as text, squares, etc. take up a lot of space. But when I do use 3D in Flash (I don't use 3D all that much), I use Swift 3d.
When I publish the Swift 3D SWF file and import it into Flash, I often delete a keyframe from the animation every 2 or 3 frames. Each keyframe in a Swift animation is about 3-8KB each. For a fairly large 3d Shape that is being rotated, the file size could balloon even more. Anyway, deleting a few random frames does not degrade too much from the animation.
To help reduce the file size, I also select each frame of the Swift animation in Flash, and press the Smooth or Straighten buttons. That helps remove some of the extraneous artifacts that might degrade the look of the animation as well as take up a lot of space. I also Optimize the animation by removing extra curves, etc. by going to Modify | Optimize. Optimize is similar to using the Smooth and Straighten icons at times!

as long as your gc is pending, you can get 1 year extension. After 140 approval and 485 still pending you can get 3 year extension. OR you can apply for EAD to continue in status.

My PERM for EB3 has been approved on July 2008. My I-140 is pending. 485 has not been submitted yet. I don't have EAD card either. For some reason, I have to change job.
My question is, if my current employer will not revoke my current I-140 sponsorship, even I have left company, and in case my current I-140 will be approved, can my priority date be carried over?
Bunch of thanks!!

There really is no science behind the time line to be honest. All i can do is tell you my experience.
I came to the USA in July 2008 on an L1A visa in category EB3 c (Multi national Executive or Manager). On Oct 9th 2009 my companies attorney filed for the I-140 and I-485 concurrently for me and my family. I received my EAD in November 09 and my I-140 was approved on the 18th of March 2010. My green card (I-485) was approved on the 22nd of April 2010 and I received my actual card on the 30th of April 2010.
As I said above there is no science to the time line, its really a case of take a ticket and hope for the best but mine took a total of 6 months from start to finish. This is pretty quick to be honest but my attorney was very good.
Hope this helps.

Yours will be EB1C. You can expect to get GC in 1-2 years.
If i-140 premium processing comes back, then typically within an year. (know of 2 people who got done within 8 months... EB1-India). Right now the I-140 is going to take the longest time..

Hi all
My I-485 is pending(EB-3,India)since 2007. I changed employer & successfully ported PD on new I-140 approval in EB-2 category. My PD is in Oct 2006 & I expect that to become current in the coming few months.
Now, I need to do Interfiling to link my pending I-485 to my new I-140.
(1) What all documents/wordings are required for interfiling? Can someone pls provide a checklist?
(2) Who should do Interfiling- Myself or "Attorney of File" on my original I-485 or my current attorney (who did my new I-140)?
(3) Can I send my Interfiling request to USCIS even before my PD becomes current?
Thanks

Hello,
Basic question to my current situation and my plans for the future.
If i wait until my PD becomes current for me to file I-485 and once filling is done and i wait 6 months from the filling date to change my job,
1. Am i limited to change jobs only in the same corporation.
2. If not and i decide to start a new job (after 6 months of filling I-485 obviously) with a new corporation can the old company revoke my I-140 and I -485.
3. If yes, then does that mean i would have to start fro the beginning with the new company for my GC processing??
Thanks in advance for answering this complex situation.

Dear all:
May I ask what I should do in the following situation?
I hold F1 visa and my new job starts on Sept 1. The int'l student office of my current university mistakenly set my OPT start date on May 6. My OPT has been approved and EAD card arrived.
That is, I will have 120-plus "unemployment" days accumulated by early August, which will then violate the "90-day unemployment rule" of OPT.
I am under tremendous pressure and really want to hear your opinions.
Many thanks in advance!

Greetings all,
I am new to Immigration voice and feel very blessed for finding the site.
Here is my situation I am a green card holder since 1996. However I waited until now because I had I received probation before judgment in 2003. The case was expunged in 2007. The conviction was Annotated Code of Maryland article 27 , section 146 (c )(1 ) stipulating that : Any person who violates any provision of subsection (c)(1) of this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $1,000 or imprisonment not exceeding 3 years or both.
According to the information I found on USCIS, you can not have any conviction in the five years preceding your application; It looks like I should be fine. I am ready to apply now and it has been a good obedient green card holder for 6 years now, I don't have any issue with the law since 2003.
I am also married to a US citizen and have three children (all citizens). I was able to get all my information from the court prior to the expungement as well.
Please let me know what you think. Thanks you so much.
