We heard so many stories about violation many Indian bodyshoppers like bench without pay,Low pay ,fake resumes and many more. But when any bill comes to control them we are opposing. Because we fear that we may be one of the persons working in those companies and may be impacted by that.
Certainly the bill is not a pro immigrant and anti immigrant bill. But some kind of restriction is needed to clean out H1b. I accept as a pro immigrant we have to oppose any anti immigrant bill. So I am sure IV will try to block the bill as they did the restriction in TARP.
I am not going to get any benefit if they shut the door behind me. I need just one job that I can get any time and whatever compettion and there is no need to shut thousands of people. So my views are not based on any personal ambition.
I am seeing some positives in the bill. Wages will increase for the H1bs also. Only genuine companies can do the business. Best and bright people will not be impacted by this. Also it can open opportunity to increase H1b Cap and Green card Cap. So there is a good possiblity to reduce or eliminate retrogession.
Basically there are two options for IV and other pro immigrants if the bill is considered serously. One is just oppose the bill and try to block completely. Or other option is to negotiate to include our agenda to recapture/increase GC and also to modify the portions of bill. Instead of failing with option 1 getting success in option 2 is better.
I think this bill will not be passed if it is against WTO trade regulations.
So you never know all these violation when you were in H1. What were you doing then. Why didnt you oppose then. If you know the violation did you call the USCIS and DOL and complain...No. Because you would end up in trouble. Now you got your GC and no matter if other guys are end up in trouble, in fact it would be helpful for you... Are you ready to review your status thorught all your H1, all your PREM processing to prove there is no violation...? Eveyone know how things are working. So if you got your GC just keep quite and move on. When you can not be helpful to others...why you are just creating pain.
If you are worrying about the wages..let them free the employees from employer. Thats the best way to clean up the system. If you are really pro-immigrant your thoughts should align in that direction. But most of us see you as Ron Diamond in the making. Its very unfortunate. One study shows that only immigrants opposing immigration more than natvie people.

I have just upgraded my existing Vonage plan from Premium to World plan without any cost. As few guys said earlier, I remember paying $0.89 per min for India call a decade back when I was a student here - really great to experience fruits of VoIP innovation :-)

If you have a Masters you won't be affected.
I am EB2 India with Dec 2005 waiting. I think all EB applications should have fair short. So if a EB3 can become a EB2 legally, I think it is a fantastic thing.
I did not know about this rule. I changed employer in Jan 2005. My last employer's lawyer ill advised them to file me under EB3 in spite of the fact that the job paying off close to 200 k in compensation required B +8 and M+4 years of experience. I changed the job in Sep 05. Next company did the right thing and started the labor in EB2. I did not know about porting/interfiling otherwise my PD would have been Jan 2005. So even if I would have done a Port/Interfile, how am I at fault ?

Absolutely unbelievable-
Get this: A fingerprint check takes 24-48 hours but a name check takes upto 6 months!!! There are over 8 billion individuals on the planet, and how many have duplicate names? OK, now how many have similar names? And by the way, if you already have a fingerprint, why does name check take so long?
Reminds me of the scene in the recent Simpsons movie, where the government guy jumps up and shouts "Woo Hoo, we actually found someone we were looking for!". The bromide goes that truth is stranger than fiction, but it should be amended to "The truth is more idiotic that fiction".

Today I got I-140 approval and I am eligible for apply for I-485.
Case successfully transfer from EB3 to EB2
I am also anticipating international travel on business.
My lawyer told, just applies for I-485. As I have H1 approval till 2009 and current visa sampled on my passport.
I am thinking to apply for I-485, EAD and AP at the same time.
Is it good to apply I-485, EAD and AP all at the same time?
I was told, once I-485 applied I can�t travel unit received the notice of receipt of I-485. Is this true?

I made a service req on sept 6 and they opened it on Sept 30 and assigned it to an officer. They enquired took detailsof my fedex , etc. and now they sent a letter. Just summary "wait wait wait still we need to key in " huh i think many of us will have same fate even after doing all this but i am not giving it up lets do something rather than nothing.

Thats very bad news. This means most likely there will be retrogression in November VB.
Or maybe thats why the dates did not advance for EB2I and advanced only 2 weeks for EB2 C in the Oct 10 VB. Compared to this in the Oct 09 VB, the PD for EB2-I advanced by 2 weeks and for EB2 -C it advanced by 2.5 months.

The May Visa Bulletin, generally issued mid-April, will contain a discussion of visa availability projections for the remainder of the year.

How long are we going to hang in there? :mad: Thanks everybody for support and advice, but, there is a problem here. I am mad at USCIS, not the supportive people here. I am a concurrent filer, I don't even know if my package was lost, if it was transfered or not. Or, if it was tranfered if it was a successful transfer. Every other implication aside, it is worth a lot of money. :eek:
May be I am too negative, but, my J-1 waiver package was lost back when it was done by paper. Literally lost (!), although I could locate the person who signed it in. My SS#, all background information, a check showing my checking account were in it. I told them, my privacy information is in it after I applied for the waiver again. I asked them if they could look for the envelope and destroy it. They "nicely" told me I have no rights at all to make such a request. I asked them if they have a system of destroying people's private information if it is no longer use, they said no.
These should be our simple rights as a people who pay taxes in this country, although we are not residents yet. We can go to court for an everyday dispute, but at USCIS no rights.
Anyway, thanks for involuntarily sharing.

Can we remove the clause- 'Allow filing of Adjustment of Status (Form I-485) when a visa number is not available' from the letter. I think this statement is not as per Immigration and Nationality Act (INA).
Massive IV campaign for Administrative fixes
Dear Members,
Immigration Voice is starting a massive campaign to get administrative relief for our community. We have had several fruitful meeting with the administration in 2007, some of these meetings were scheduled in September, November and then in December. In these meetings, we were able to convince the administration about the implication and hardship due to current broken system. Since Congress has not been able to address our issues in 2006-07, we were successful in creating a case for administrative fixes that would give much needed interim relief to EB community. These meetings helped us start a conversation on possible administrative fixes like 3 year EAD-AP, clearly defining �same or similar� if AC-21 is invoked, and we are hearing favorable feedback.
Due to lack of action on legislative front our community�s patience is running out and we want some relief urgently to get out of probationary status. We are thus starting this nationwide campaign that will help our advocacy efforts and get administration to act quickly. There are several components to this campaign.
1) Support from lawmaker offices: We urge all our members to meet their lawmaker offices and get them to write to The President in support of administrative fixes and urging for an immediate administrative relief. The template of the letter is attached. Letters from lawmaker offices to administration get far more attention as compared to anybody else writing the same letter. The template of the letter is posted below. Please request lawmakers to give you a copy of the letter or lawmakers could copy IV on their letter to The President.
2) Support from employers: We urge all members to approach their employer and have them send a letter to The President expressing support for our administrative fixes and appealing for an immediate relief. The template of the letter is attached below. Please request your employer to give you copy iof the letter so that you could provide IV with the copy of the letter.
3) Plea from our community: We urge all our members to write personalized letters to The President directly and convey their plight. If you would like to write your own personalized letter, please do so with your own story. As you know, you and your wife will be able to file your applications to adjust status to permanent residence in July 2007. You will need to prepare the following for your adjustment applications:
1. Form I-485, Application to Adjust Status. You can find this Form on the Internet here:

4. Passports, Forms I-94 and Nonimmigrant Visa Documents. Please send us a copy of every page, including any blank pages, of each of your current and any prior passports. Please also include copies (front and back) of each of your Forms I-94. Please make sure that the date and place of entry on the I-94 copies are clearly legible.
5. Birth and Marriage Certificates. Please send us a copy of your and your wife�s birth certificates and of your marriage certificate. If your birth certificates do not contain your name, your date and place of birth, and both of your parents' names, you will probably have to get affidavits from parents or older family members to fill in the blanks. We will review your documents and let you know if affidavits will be needed.
6. Medical Exams. You each must have a medical exam done by a CIS approved physician. It is my understanding that it is already becoming difficult to get appointments with these physicians. You can locate these physicians at this website:

The exam will include a blood test for AIDS and other diseases, a physical exam, and a skin test, and perhaps a chest x-ray, for tuberculosis. The physician will complete the forms and return them in sealed envelopes. The envelopes must remain sealed.
