For filing of I485, do I need to file for my dependent child who is an US citizen (age :1 year+)? Also does my child need to go through the medical exam and be part of the I485 application even though she is a citizen?
Sometimes it becomes confusing and some guidance from our IV folks is really appreciated.

Hi,
If I enter using H1-B/L1visa then I-94 validity end date will be ususally till the visa expiration date.
Suppose if I am entering US on Advanced Parole(I-131), what will be the validity enddate for I-94? If suppose they give for 1 year how to extend that if i am not going out-off US?
Thanks

2) can she do any thing about medical exam in India. I mean can she get a certificate from India?
They may not accept a certificate from india, medical exams has to be done by a civil surgeon in your area who is authorized to perform the tests.

I am travelling to India and I have got AP. I also have an I-94 when I arrived last time to US. This is expired and I also have a I-94 with my last H1b (expires in June 2010). Now, I am working on EAD.
My question is which I-94 I need to return to the Airlines while boarding the flight?
Also, I am starting my flight from Cincinnati to Washington. From Washington I have a connection to Dubai and then to Chennai. Where should I submit my I-94?
Thanks,

I don't know anyone in Chicago. But I think it does not matter. You can hire an attorney from other city/state as long as he/she is competent. We live close to chicago, but our immigration attorney is in Michigan.
We had a great experience with this attorney. She is thorough, clear, always accessible and prompt. And she does not charge a fortune either like others. She does not even charge extra for phone calls, emails, etc.
The office is Law Offices of Ingrid Brey P.C. in Grosse Point Park, MI. Just google it and call the office. Have them email their services/charges, etc.

I recently found out that someone had stolen my credit card information to purchase items online. I have since then closed that credit card and went ahead and put a fraud alert for 90 days on my credit report. I don't believe my SSN was stolen, but I want to check my credit report and also for protection have the alert so that no one tries to apply for loans etc. using any of my information.
Will having the fraud alert have an impact on my 485 filing in any way? Let me know what the best process is to handle this if it does have an impact on 485 background checks, and pending green card approvals etc.
I have no criminal history.
Thanks,

Technically, you can do that. But it's better for you to transer your case to consular processing if you are not planning to be in the US for a couple years.

question: can I file without employer letter
For an employment-based petition, in order to proceed and be valid,
they
need to still INTEND to be employed by the sponsoring employer if and
when
they get their green card. The employer however, does not need to sign
any
forms per se with relation to the adjustment petition. If the alien is
currently working for the sponsoring employer (on H-1B or other) he or
she
can port or transfer employers without penalty or without losing the
green
card process 180 days after they file the I-485 petition. At that
point,
they can change employers and work for whomever they wish (provided
they
have a valid work permit)

Temporary Protected Status and Expired Employment Authorization Documents
One must accept a Temporary Protected Status (TPS) beneficiary's expired Employment Authorization Document (EAD) if DHS has automatically extended its validity in a Federal Register notice. Automatically extended EADs are listed on the USCIS web site. EADs issued to TPS beneficiaries will include one of two category codes: A-12 or C-19. You must not require an employee to provide proof that he or she is a national of a country that has been designated for TPS.
When creating a new case in E-Verify for newly hired TPS beneficiaries, select Employment Authorization Document (Form I-766) as the document presented and use the date to which the EAD was automatically extended as the expiration date. We recommend that you read the TPS information on the USCIS web site carefully, as the EAD automatic extension is usually shorter than the TPS extension date.
When re-verifying an existing TPS beneficiarys employment authorization in Section 3 of Form I-9, write down the date to which the EAD was automatically extended as the expiration date. Never use E-Verify to re-verify an existing employees employment authorization.
Once the automatic extension of the EAD expires, re-verify the employees employment authorization again in Section 3 of either the original Form I-9 or a new Form I-9. The employee may choose to present a new, unexpired EAD, or any other document from List A or C of Form I-9 that shows he or she continues to be authorized to work in the United States. Federal contractors with the FAR E-Verify clause must follow special rules for verifying new and existing employees, including employees in TPS status. Federal Contractor needs to check the Supplemental Guide for Federal Contractors for more information.

I have 2 H1B Transfer questions for clarification.
1. Can H1B Transfer be filed when H1B Extension is pending with the current employer?
2. Do i need to have copy of I-140 approval notice for H1B Tranfer? The current employer does not share this document.
I appreciate members response.

I'm hoping someone can provide some good advice...
My grandmother renewed her green card application January last year, got fingerprinted and was told she was all set. While she was out of the country in June, she received notice that her prints had to be retaken and her appointment was in 10 days.
Being 90 and not in the best of health, she did not go back to the US with such short notice. She tried to call the UCSIS hotline to reschedule and was told she could not and that she had to go into the local office to do so (though the whole point was she in Asia).
I was only told this recently by my parents and tried to find some solutions for her as the main reason she came to the US in the first place was to help raise me.
Looking over her denial notice, it appears she could reopen the case with supporting evidence. But am wondering what I need to provide and if there's anything I can do?
Any suggestions?
Also, it looks like if you are 75 years old or more you do not need fingerprints but is this only for the naturalization process or does it also apply to the PR process?
Any advice would be great!

Friends...
I am considering move to a different state in few months (work from home) keeping my existing job for health reasons... My employer has been nice to me.. so Iam not considering changing job for now... My concerns,
1) Will this situation cause compulsary RFE? Anything I need to be careful of?
2) Do I need to invoke AC21 or just amend my H1 or start using EAD? What is advisable... Any personal experience??
3) Can I claim moving expense (when filing taxes) if moved with same job??
Thanks...

Your priority date is the same as your husband's. It will be on your husband's I-140 approval notice.
