Hello I am leaving for India in two days and have still not received my H1B approval. The receipt date is May 19th 2009. It is being processed at the CA center, is there anything I can to do get it soon.

Assuming & God Willing I get my GC then , how long does it take to get US Citizenship. Does it matter which state you are working in and the Queues , State Wide Differ OR its the same slab.
Can someone point me to the webpage on USCIS that tells you how long the Q is . Does it matter , what your prev. nationality before GC was like to Priority Date my country or no relation.

If the foreign national has the required license, the adjudicator should not "look beyond the license." If the foreign national has a restricted license (e.g., license approved except for mandatory supervised practice), and the petition is otherwise approvable, an adjudicator should approve the petition for one year, or the duration of the restricted license, whichever is longer.
If the employee does not have the license because s/he needs certain immigration documents before getting a license, CIS can approved the petition for one year. Hi- My stamping on my passport expired on Sep'2008 (over 19 months now). But, my I-797 is valid till Aug'2012. I plan to get my visa re-stamping done when I go to India in May'10.
1. Will there be any issues?
2. What am I supposed to say for this question in the visa application website?

I will be going to a USCIS roundtable on customer service on Sept 23.

Your I-485 will not get approved until the dates become current for you. For eg. say in March 2009 bulletin (which is valid from April 1st of 2009), your priority date becomes current. Your I-485 can be approved only after April 1st. Just have your wife's application ready and apply on the first day when your priority date becomes current.

Don't worry, the same thing happenned with my wife (labor approval lost in mail) and it took her 3 months for 140 approval. For me, everything was fine and it took 6 months for 140 approval - isn't USCIS the best part of the American experience?:mad:

I am working as a biomedical research fellow on a J1 visa for the last 3 years in a non-profit research institute but they cannot sponsor my H1B. I am planning to get a J1 waiver and apply for H1B as I plan to work in the private industry. I am not sure whether I can apply for H1B without an employment offer? I would appreciate any suggestions.
You can never apply for H1-B. Your employer has to petition H1-B on your behalf. So obviously you need to find an employer first with an opening (i.e., you need to find a job first).

You can check with the airlines and ask for wheelchair for you aged parents ... usually I have seen with Lufthansa - they provide a very good service when you ask for special assistance. Not sure what BA will do though ... you can always try ....

Even if your status changed to H1 in October 2004 and you started working in November 2004 for a second employer following approval for that employer, I would say it is just 30days and would not be an issue in future GC application. Don't worry about it.

I got a RFE for medical which I replied immediately and the current status shows
"we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done"
My PD is not current by the time I got RFE and don't expect it to be current in near future too.
Now, my questions :
1. Does USCIS send a snail mail with in 60 days regarding the status of my application?
2. Is it fair to assume that my case is preadjudicated If I don't get any further RFE's with in 60 days ?

My 6 years on H1B is going to expire in Oct 10. I want to file for extension but the lawyer says that i can do it only after Mar 10 that is 6 months before h1b expires.

I have to visit my home country in May 10 and i wanted to go with my new h1b documents.

----my idea is apply premium on Mar 1st.You will get it within 15 days.
