Your case might just be a coincidence unless we have lot of transferred cases not being approved. Speaking of which we see this handle Visual whose PD is Jan 03.
If transferred case is the road block, you guys have a strong case to raise, even legal action.
I went thru TSC-EAC-TSC cycle. I did quite a bit of research online :) and found they did approve those cases, if PD is current. So, that shouldnt be a hurdle. Key is make sure you have all the checks are passed and current.

I am on H4 for past 2yrs. My H1 is valid since Oct07. I want to travel to India in Dec this yr. I have few questions:
1. I haven't started to work. So, what is my status as of now, after my H1 being aproved and valid since Oct1 2007?
2. My H4 is valid till Mar 2008. If I want to travel to India in Nov end and come back in Dec, do I need stamping on my H1 from the consulate.
If YES then:
Do I need to show any pay-stubs?
I NO then:
a. At the port of entry what status is I am supposed to declare?
b. If I enter as an H4 then does that invalidate my H1 visa?

Now, DO NOT TALK TO THESE NEIGHBOURS AT ALL. Nothing, NADA. Do not show any emotions to them, say hello if you see them and move on. If they try to talk, it is good, but DO NOT STOP TO talk. Inform your attorney about it.
Change the attorney, if you think you are getting a raw deal.
THis case should be dismissed.
I believe this case is a dismissed case from the beginning. Police/lawyer have nothing else to do, I mean, they are just doing their jobs, and they cant be funny at all. They will go by what the law says. Period. Research what the law says.
Now on the actual event:
Everyone, I mean everyone will have disputes. Now, the dispute is so large that the neighbours call the cops? I will guarantee that every IVian here who is married for 3 years or longer (or already has a kid), has had a bad argument, where either of the spouse has screamed(or spoken with a very high tone).
Your wife continued screaming so loud that you had to cover her mouth to pacify her, bcos she peed on herself.
Wait a minute here, if I was a cop, I would definitely judge this as DV. Unless, you absolutely had shut up to begin with. No chair, no drag, no nothing. which now has to be proved as misinterpretation.
And any offer that your lawyer brings you is trying to resolve the case, You are the one who should decide whether this case goes to trial or not.
Past peeing incidences, where the neighbours heard screams should be kept in mind.
And finally, take English lessons, dude, your written English too is very poor.
You can actually submit this as a proof that you were misinterpreted, if this goes to a Jury trial.
Also, please Delete any proof of the incidence, including the one posted here. No one shold be seeing the 100% truth, your 100% truth is scary.

The thought of the remote possibility of any correspondence from the USCIS going to the old attorney (for whatever reason), and not making it to me/new attorney in time to respond to it, is a little unnerving.
Well, anyway, no point losing sleep over these things, although it is easier said than done.

Gave in and sent PP by Fedex yesterday for Schedule A, grp 2 case.My attorney did not advise me to PP nor did a legally brain I turn to for advice. He said its likely that I would get approved even during retrogression.
But I decided its better to know sooner than later, preferably before spouse started using EAD, and if a miracle happens (who can prevent miracles?) the 485 could also get approved concurrently with the 140.... And because I have 13 days more before retrogression hits. And because I saw people reportiing really qiuck turn around after PP. My employer was willing to pay half as well...
Well plus I did not want to be stuck in the general EB2 pool (India) which looks like its a black hole. I have an approved labor from 2004 there.(yet to file 140 for that one)..so didn't see a reason to be stuck there with a 2006 PD.
I still wonder if my reasons were sane and if my hasty action mght prevent my spouse from working -- if the 140 gets denied...Well, we'll take it as it comes..it may mean goodbye to the US or something..
BTW as far as I know, retrogression doesn't start till November 1st.

I highly doubt they pull up state criminal record at POE.
If its a federal crime, then i can believe that.
You want to bet with me on this.. I am not wrong here. Why would I scare someone..Even if this is Misdemeanor or felony charges irrespective of wheather this is state or federal it is one's record and every officer at POE has an access to this record.

HI,
My wife got her h1 approval in Oct 2007. She hasnt been on any project, nor has she received any stubs. i want her to convert to h4 again as she is pregnant. If she goes to India to get her H4 stamped what docs does she need? will there be any problems?

Wonder what I should do. After November no more Sch A numbers left, so what does that mean for people who've been able to file 485?
Filed I-140/485 with RD August 7th Sch A, EB 2. No movement on the I-140. Any suggestions? Should I seek premium processing?

Any idea how many years will it take for APril 04 priority case (EB3/India) to get the 485 approval? Since I filed more than 3 years ago, I am telling my family and friends in India it will take 3 MORE years....

AC21 can be as safe as a any normal 485 case so do not worry. Its classic case of USCIS ignorance on AC21. I would say, hire a good lawyer and prepare for a MTR. I have seen Ron Gotcher as a very prominent proponent of AC21 rules. You can take his help. I used AC21 and got GC approved without any hiccups. My case was handled by Ron and I have been completely satisfied with his services.
