It appears form the wording in the text that, anyone who has maintained a continuous stay for at least 5 years preceding and up to the date of enactment of this bill, gets to apply for AOS and be granted permanent residence.
so with respect to EB folks, this provides GC aspirants (with 5 year stay) an immediate relief. The total quota numbers are not modified. Everything stays as is. This appears to be a one time relief to free up the choke in the system (at least for EB).

The text of the current bill states that the applicant needs to apply under this bill's section to adjust status, similar to 245i. Now if this means reapplying under this section, that would mean another flood of applicants. Folks I had an infopass this morning for EAD pending more than 90 days. The officer basically told me cannot issue EAD but will contact NSC to check status and gave a customer information receipt saying "Our records indicate that your I765 is pending. I will contact NSC for further review of your application"
I was very disappointed by this. Is there anything else I can do to get interim EAD? I still don't see a LUD on my case.
I took 3 infopass appointments but not one helped, but if they take your FP in the infopass appt, you may get your EAD approved after 4-5 weeks(as happened with me)

I always wonder when Thackeray, Modi can become ministers after committing such atrocities and walk freely in India, why can't people like Dawood Ibrahim (after all he is also indian and successful in his own profession).
You guys may think that I am racist by reading above lines. From bottom of my heart I vote for punishing all bad guys ( irrespective of their religion) who harm innocent human beings. Long live India����..

If you look at THOMAS it actually shows that Yeas are 55 and Nays are 40
So the bill passed the voting ....
but it failed because it was ruled "out-of-order" and hence rejected ...
I dont know why it was ruled out of order ... maybe because it was attached to the defence spending bill so it was not the right place to put in this kind of amendment....

This will be a class action lawsuit which means that all the people who are in the same class as the plaintiff will get the benefit of the favourable decision. Now on whether to file or not, it is an individual decision but most of us have already prepared for the filling so there is no harm in going ahead with the filling. The worst will be to file again but nothing more than that can happen and as I have heard most of the attorney will not be charging again when people will be refiling their cases. So better to file your case and let USCIS reject rather than feel sorry later on if the judge rules in favour of the lawsuit.

I have a question regarding an appeal I did a year ago for a rejected LC.
I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. So gc101 would be safe if his PD becomes current before his file is pre-adj or get's stuck (!) in something like FBI namecheck after pre-adj. which might allow him time to add his wife's name.
So, what you mean is, I would be better off to hope that my name gets stuck somewhere in the namecheck or RFE or something for me to have enough time to get my spouse added in time BEFORE my I-485 gets approved. Did I understand it right?

For those of you who qualify, HSMP , I think is a much better option. There in UK the permanent residence is not dependent on employer and you can do your own consulting. Typical bill rates are 350 to 600 GBP per day based on skill level and years of experience.

I'm in the same boat. PA DoT wants to see visa stamp on the passport.. applied for 1st 3 year extn at VSC on 7/10, will up it to PP this week... anyone in PA got their DL renewed using RN... please specify how and where??

This is a problem because the DL people do not understand the immigration law. I was in a similar situation 2 years ago in Iowa. Tried to explain to the manager of the office, but got a lecture on how good their public transport system is. Then I went to another DL office in a rural county. The counter clerk refused, asked to see the supervisor who agreed to extend for 6 months by which time my extension came through.
