What happens when there is a problem with I-485: Denial or NOID ?
If denial, and in US, MTR can be filed and if MTR accepted, the period (from Denial) is considered as legal stay (even if not maintaining H1b status).
But if denial, and outside US, you can NOT enter on AP. Correct ? Here only option to enter US is H1b ? Can MTR be filed ?

I don't understand this, we are talking about these backlogs, which are effecting about 300K - 500K skilled immigrants, and we only have about 4000 members yet. We should take this as challenge and go on to drive to speak to people like us to increase the members strength, so we will have significant backing and Senate / House / President will pay attention to what we request.

I recently returned from an international trip (flew into JFK), and the only document that the CIS officer asked for was my AP. Based on what my lawyers had said, the only 'required' document is your AP, although it probably doesn't hurt to have copies of the LC, I-140, I-485 (more for peace of mind!).

I have completed 3.5 years of my H1B and am looking at the possibility of applying for GC either under EB2/3.
After my 12th, I did a 2 year Diploma in Business from Australia and then did a 2 year MA(History) in correspondence (open uni) from India and also a 1 year PGDCA by correspondence.
I have more than 10 years of IT experience to go with my 12+2(fulltime)+3(correspondence)years of education.
Questions:
Please advice if I qualify for EB2 and if so will there be any issues ?

Hi ,
One of my friends applied for his GC thru a consulting company which he does not work for...He used to work for the company but left that company before he decided to file with them...Since he has good relations with the company, they decided to file for him.
The company recently filed his I140 but they got a RFE on I140. INS wants to know why does the company want to hire him and why he left the company in the first place..does anyone in the forum has a similar experience to share...The RFE is actually for the conmpany but the owner wants my friend to write a letter and mail it to the lawyer. Any help is appreciated.

Nov.2002 - RIR Labor filed in CA
June 2006 - Labor approved from Phily BEC
July 2006 - I-485 , I-140 filed at TSC
Sept.2006 - I-140 approved

I have permanant opprtunity with one organization which wants me to work on EAD. My situation is like this
my EAD is expiring on XX/XX/2010. The new compnay wants me to join on YY/YY/2010. My questions are
1. IF 15 after joining new Compnay, I apply for EAD renewal and before filing for AC21,Will it create a problem. Since I can only file EAD renewal 4 month before expiration date I need to do it some where in april.
2. In case my Old employer revoke 140 before I file EAD renewl and AC21 will it create a problem?

Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. The UAFA would be a huge step forward. The Senate will have its first hearing on the bill tomorrow. You are more than welcome to do the stamping in any country... just that if your name comes under TAL or any other check, you would end up enjoying that country for longer than you had intended originally...
I have been to Canada twice for stamping - no issues, just realized that they have become more strict in evaluating candidates - one friend of mine enjoyed Toronto for about 1.5 months (originally intended for 2 days).
So talk to your lawyers and be safe and comfortable :)
As said, you can go any US consulate to get your Visa stamped, I got my twice in Canada, once in Dublin, once in London, most times I was travelling on business, I know if there is somethging wrong my company and the lawer will be there. It depends on your company, I guess...

I left the US for good after spending around 5 years on H1-B sometime last year and have only made entries on tourist visa. Can I apply for a new 6 year H1-B quota since leaving the H1-B status last year or will I have to spend 1 year outside since the last tourist visa entry ?

If you are going to apply during april 2010 you will need to wait till oct 2010.

I should add that you can only port once your I-140 has been approved.
