Hi,
My EAD card was sent to my old address, which I failed to update in time. I have been following up with USCIS for more than a month, but haven't been able to receive the card or the approval notice so far. I have to start working on Monday (Aug 11th), so this is really urgent!!
I can join and submit the EAD card within 90 days (as per the I-9), but my employer needs to see the approval letter (something which proves to them that my EAD case has been approved).
I do have the following which indicate my approved status:
1. My online status used to show that the case was approved (it said that the card was mailed to me). Now it has changed and says that a new letter (not the EAD card) has been mailed, but I won't get this letter till after Aug. 11th, my joining date. I do have a printout of the previous status, though.
2. I managed to get a letter from my university saying that my case has been approved.
3. I have the receipt notice, which shows that the case was submitted and received by USCIS.
My company still insisted that they would need a letter from USCIS saying that my case has been approved. Any advice on what I can do from here??

...that you submitted and it has a column where you were supposed to fill in the job code. Also, you would have attached a copy of your approved labor to support the application and job category.

I have an approved I-140 with a priority date of April 2008 (EB2). Unfortunately, my husband's employer did not go through with the GC filing process as promised and his H1B runs out next summer. I had heard that there were cases in which an individual could apply for additional extension based on the spouse's approved I140. Is there any truth to that?

From what I know, it is not mandatory to file AC-21 but if you think your previous employer who filed for your I-140 can create problems for you, it's safe to file AC-21. Although, your previous employer can not withdraw your I-140 by law, some employees attempt to withdraw/cancel I-140. Sometimes, USCIS behaves in an un-expected manner and they might issues a NOID on your 485. If that happens, you will have to appoint an attorney who fights for you to repeal USCIS decision. You will win in the end, but you will go through some unwanted stress and will loose some money to the attorneys. In such cases, if you have filed for AC-21, it acts as another strong point to your fight against a erroneous decision from UCSIS.

my name was not interview with my family.
my family gave interview and embassy asked for original I140 and I824 approval notices to check my eligibility.
i submitted and now after 2 weaks got the follwing reply:
In your case , the I-140 was filed on sept 10, 2001 and approved on october 08, 2003. The visa became available on october 08, 2003 . Form I-824 was not filed within one year of visa became available. <my name> was born on January 03, 1986. because he (me) is above 21 years old an immigrant visa as a derivative beneficiary of Employment third prefrence (e3) immigrant visa category cannot be inssued to <my name>. In order to qualify for a visa, he (me) would need to benifit from CSPA. Since form I-824 was not filed within one year of visa becoming available on October 08, 2003.
<my name> cannot be processed under CSPA.
but i think and i am not sure if i am right or wrong that I824 can be filed after issuance of green card, but at that time my dad ddnt got green card.
SO plz help me with right advice and solution so that i can travel with my family.
my mom and bro got te visa and it will expire in 6 monts and i want to go with them, can i be able to get visa in any case before their visa expire?
i badly need help.

We are in the same situation, filed 485 on July 8th at NSC & EAD/AP on August 12th using 485 proof of delivery. Received receipt notices, FP done, 485 transferred to TSC, but haven't received EAD/AP. Planning to take Infopass appointment.

I am new to this thread. I have a bachelor degree in Applied Science in IT and got it in about 1 and half years because I got an points exemption from my advance diploma. I also have 7 years of IT working experience and currently hold a H1B1 visa. H1B1 and H1B are not the same thing. The question is can I apply for my GC in eb2 category?

Applied for AP/EAD/485 in July 07.....I know that I can invoke AC21 after 180 days and change jobs.....My question is ,
1. If I travel to India before the 180 days and use the AP when I return, is it like invoking AC21 before 180 days ?
A AC21 has nothing to do with AP
2. what are the consequences of using AP within 180 days after filing for 485 ?
