EB3 is not working, because we have no hope, not because we all went back or have ported.
Say only EB3 India. not whole EB3. EB3 ROW have no problems.
If EB3 India have no hope then why do they visit forums, check visa bulletin every month, ask questions if something is going to happen?
Should they be stoppoing it and forgetting greencard if they have no hope?

I guess using our degrees to pass on a message is a fool-proof idea. That can immediately catch on with media like flowers did. If not stoppers, we can write our message in bold colors on the degrees.

Thanks Kumar1 for letting us know the options. We both have valid EAD's in hand. I like to maintain the H1B status as I am the primary applicant for the GC.
As you said some of friends also mentioned the same about talking to lawyer. Only thing I expected in this time is peace of mind. This is the worst timing. We always wanted to welcome our baby with lots of joy and happiness. But this desi consultancy put me in this worst situation I never expected.

Did my post suggest in any way that I was defending the guy? I was only ridiculing those who were bad mouthing him.
Are you suggesting that my post would have scored more points if I came out with more ammunition? I did not post in order to win your accolades. The fact that you felt there is not enough ammunition, suggests to me that you think it is perfectly fine to do all those filthy things I was referring to. This tells me about your moral standard.

You are sick and tired of defending our community? Do you imply that most people from our community have turned to criminal acts these days, and so you are tired? It is true that the law does not impose punishments on backstabbers, womanizers, sexual perverts, etc. Prostitution is legal in a lot of countries. The fact that the law permits some things, does not have any bearing on the moral severity or the lack thereof, of those things. Would you choose a 'prostitute' over a 'shop lifter' for a wife? If these are the only 2 options, I would be content with a shop lifter. Would you choose a 'prostitute' because there are no criminal issues involved and you will get your greencard faster?

But one thin I enjoy is problem solving and this is one of the hardest out there as it is dynamic.
With Eb3 India the Horizontal spillover methodology kills most hope as there is the large Eb2 India backlog. In 2007(I think) the vertical spillover methodology was followed and Eb3 India got 17000 or so visa numbers. So with Horizontal spillover and no number increase I am sorry to say movement is limited.

one correction PERM started in March 2005 or even 2004 cannot be sure....defintely not 2006

If you are in March first week PD, you will be current from September 1st 2010.
I would do the following.
I will open a SR on the first working day of the September (As you have already done this and can not do one more SR in the next 45 days)
Will taken an infopass around 10th of September (Just waiting to see whether the date retrogress or not. If the date stays as it is for October 2010 i don't go to infopass otherwise i will go to infopass around mid of September to find out more details)
I am in Mar first week PD and hence dont know whether my PD is current yet (Aug VB). Planning to wait for the first week of September before taking an infopass appointment.

"Retrogression" is the word for the rest of the year for EB3 (I). Learn it, Leave it (eat it, sleep it, drink it - whichever way you want it).
How about Dec. 2000 EB3-I for incoming bulletin? Then "Retrogression at will" as we move forward for the rest of the year. Now don't ask me how because anything is possible with (fill in the blanks).

Generally most companies are comfortable doing a 1099 on Corp to Corp than doing a 1099 with an individual. In both cases it is 1099 and company pays $$ as agreed.
There is one major difference why companies want to do business with consulting firms rather than individuals as the perception is when doing business with a firm as opposed to individual you deal with so many people (not just one) who share the responsibilities. If for some reason things don't work with the consultant the company can request the consulting firm to provide substitute so on so forth.
Also firms are perceived financially Strong, can afford $3M+ insurance (just in case something goes wrong) while individual may not be in similar position
it is always better to go with a Consulting firm rather than going individually (Pros certainly outweigh all the cons)

To best of my knowledge, at least one parent must have US citizenship to get OCI ( the rules were different earlier - may be 3-4 years back ).

They will issue you a letter that states that the child is allowed to stay beyond six months. The letter that we got is valid for two years. We were told that if the child stays beyond the date of the validity date in the letter, then to come and get a new letter. The whole process took about two hours. BTW, this was in Hyderabad.

Everything from immigration to foreign policy to war to world relations etc. is done in the interest of capitalism, not in the interest of immigrants, citizens or other countries.
This is a country where capitalism is practiced at its extreme....
The drawbacks of capitalism are also seen here in their extremes....

Through my 3 year stay in Canada, I was made to pay 43% of my income as income tax - a lot of people around me would grumble about that, but I for once, have never felt bad about having to pay such high taxes in the interest of a socialist healthcare system...
It gives such a peace of mind knowing that one never has to worry about getting medical attention all our life...irrespective of our job situation....stories of people having to sell their houses just to get proper medical treatment are just unheard of...
