Hi,
I�m in EB2 and My I-140 was approved September 2008 through Employer A. And I got laid off on November 2009 from EMP A, within 15 days I joined another Employer B. As per policy, employer B is not going to file GC for me. Already I spend 5 years on my H1B. I check with EMP A�s HR dept, they will not revoke my I-140 and H1B. I know AC21 is one of the options to transfer (Portability) my PD to Emp B after apply I-485.
It would be great if I get answer the below my Question:
1. If my PD is current, Will I eligible to apply I-485 using Employer A I-140 approved?
2. What are the documents needed from employer A, if I want apply I-485?
3. All my friends telling me, I can apply I-485, Is it true?

No you cannot apply I485 in company B. when your PD is current if you go back to your Company A , then company A can file I485.

No you cannot apply I485 in company B. when your PD is current if you go back to your Company A , then company A can file I485.

I am having the same issue.Applied AP online on 1/10/11.Got receipt no and Application as PDF.I have the Receipt no and sent all supporting document with LINXXXXXXXX no.But I have been trying to add the case no to my profile and it says not found.I am not sure what can I do or wait for more days.

If my H1 transfer is approved on say 1st August 2010, do I need to join the new company immediatly say 2nd or 3rd or can i take some more time say 2-3 weeks (Aug 20th) to join?

My company wants to transfer me to Europe for 2 yrs. Its a very good opportunity for my career. My I140 approved and 485 is pending. PD March 2006 EB2 India. It wont become current for foreseeable future. I am appplying for 3 yrs of H1B extension.
Can I be outside the US for 2 yrs w/o jeopardizing the GC process. Can I then come back after 2 yrs on stamped H1?
My wife used EAD to work. Can I apply her H4 extension with me and she foregoes her EAD? Will she get H4 status and extension along with my H1?
Can she then come back with me after 2 yrs on H4 and then revert back to EAD to work?
I need to make a decision soon. Any replies will be greatly appreciated!

Filed I-485 in July 2007.
My current H-1B expires on December 2009. (9 years on H-1B.... ya that long)
Based on my AC-21 portability after 180 days of I-140 approval, if I move to a new employer and file H-1B transfer, will I get default approval of only upto December 2009, or can I get 3-year extension based on my I-140 approval?

You can get 3 years extension based on your approved I140. Please consult a lawyer before jumping into conclusions though.

Why do you think anyone in India including the government will spend there political good will to help people like us? Since we are planning to leave India for good and possibly become USC in due course of time there is nothing to gain from helping people like us. . They might ask for H1/L1 etc because it impacts Indian companies.

I have just signed a contract to buy a new home.
The first step is to be eligible for mortgage.

I tried explaining her that I was not on H1 and had not received GC yet, that I am on EAD.
But she did not understand it. She only understands H1 or GreenCard.
I am not on H1 since I changed my employer and it expires this October.
I have also travelled on Advanced parole.

I have a friend in India who applied to a new H1B through a consultant, was lucky to get through the lottery but is now stuck in RFE because of issues with the consultant. He heard from someone else that the same consultant is getting rejects and is nervous that his case will get rejected too.
I've heard that while a H1B case is pending (before it is denied), one can apply a separate petition from another employer and is still considered a valid application that is within the quota as it is for the same applicant.
Does anyone have experience in this area? What do you recommend? I also plan to contact an attorney regarding this to help my friend.

Use the AR 11 online process to change address do it seperately for yourself and your wife. When you have finished submitting new address the system will prompt you asking if you have any pending applications with USCIS. At that time enter the receipt numbers of all pending applications. This will do the needful. You can track the success by checking the case status in few days you can see a soft LUD on your pending applications. Also in few weeks you will receive a letter from USCIS at your new address that tells that they have updated the address. Some folks even call USCIS and verify the address change.
