1)Company A (GC sponsoring company) filed H1B 3 years extension based on approved 140 six months back and it is pending since then and got RFE .My previous H1B expired 3 months back.
2)Now i would like to switch company B by using AC21 and want to file H1B renewal also with company B.
Is it possible to file H1B renewal with company B by using pending receipt notice of H1B (that was filed by company A)? or do I need to wait until get H1B approval that was filed by Company A?
Experts please suggest?

Hi,
When I entered USA on L2 dependent spouse visa,my passport was expiring on 15 Sept 2008 and hence my I-94 got departure date as 15 sept 2008. After that i applied for an L2-EAD with the old passport and I-94 (both having expiry date as 15-sept-08)and hence i got the L2-EAD which also expires on 14-sept 2008.
Now I have renwed my passport which is valid upto 2018 and want my EAD to be renewed.
Can someone tell me L2 EAD expiry date depends on I-94 records or does it depend on my spouses L1 or on my new passport expiry date...or may be out of all these which ever expires first....??

My wife will be relocating to Toronto,Canada for work and I will be traveling between the US and Canada. My employer is fine with me telecommuting 50% of the time which means I will be working 2 weeks remote and 2 in the USA for the next one year. I will continue to be a US FTE [Software Development] and also pay US taxes. Will I be able to continue being on H1B status while I travel or do I have to explore other visa options? Since I will be returning to the US every 20 days [and by road] will I be able to use the automatic I94 revalidation?

Option1 -
Get enrolled in some university and get F1. Full time classes can give you 2-3 years of stay.
Option2-
Covert status to B1/B2. That would just buy you 6 months at the max.
Option3-
Pack up and go back to home country. Live a free life.

My wife received Appt. letter for FP second time. It mentioned that first time FP didn't pass thru FBI check, se she need to come again at no cost. Is this normal and did it happen to any one? We are in Atlanta.

Last month dates were 7 Jan 2005.
This month dates are 22 Jan 2005.
Still the reported Jan 2005 approvals(, IV ) etc are less than 5.
Not sure whats happening to these

This looks similar to the PERM applied for labor... It would be faster for new applicants.. but old applicants could get stuck again... for years... and years... not due to visa.. but due to transformation...

I entered US on H4. Then applied for H1 for software job. worked for 2 months last yr and then went for maternity leave.
Now I started working again and I still have to go for stamping.
I have completed CPA and I would like to move to an accounting firm ( they have to file my H1 transfer with accounting domain).
Is this going to cause any problem during H1 transfer or stamping??
Please advise me...

I am not sure how h1 transfers work in case it is different profession.
I guess they should work fine because people can have multiple skills, some people gain skills over time like say, people do MS or MBA while on h1b, and then apply for a different kind of job and get a transfer.
Gurus must be able to answer this question.

My priority date will become current on June 1st 2011. I will add my wife to green card process on June 1st 2011 (she is in US in H-4 status now). My I-485 is with Texas processing Center.
If I leave my sponsoring (green card) employer after 3-4 months of getting my green card and join another employer or have my own company, does it affect my wife's green card that may be still in process

Based on USCIS's last action rule, the status of an applicant depends on whatever petition is approved last. So, if her H4 is approved after her H1 COS, then she will be on H4.
I am assuming you have applied for H1/H4 extension recently in regular processing. So the chances of her H1 COS getting approved first under premium are higher. So once you get her H1 COS approval, just withdraw her H4 petition.

My 485 application is pending at TSC on EB3 category, country of chargebility is Inida. Yesterday my PERM labor approved on EB2 category and need to apply 140 to recapture my own EB3 PD.
My employer will come under NSC. if the PD recaptured, I will be hardly one month away from my priority date to be current, as per the current visa bulletin dates.
1) So can you please provide some suggestion to which Service Center will be opt for filing EB2 140 now, in order for getting an optimal or faster process for 140 and eventually 485?
2) Does the service center really matters as it will take a very long time for me to get greened?
3) Is it worth waiting for couple of month's visa bulletin, to see whether the EB2 I dates are moving so that I can use some streamline process to process 140 and 485 together?

Any one had luck refiling I140 in EB3 for denied EB2 I140 (for same labor)?
Also is it possible to request USCIS to change an EB2 I140 denied partition to EB3 during an appeal?

Just came across GAO's( General Accountability Office) recommendations to make changes in H-1B program. Eventhough they talk mainly about Staffing Companies and increased employer accountability, there seems to be a mention regarding the H1B extensions beyond 6 years with simultaneous application to green card. Eventhough not stating in exact words, it seems to hint to the congress to seriously relook at H-1B extensions beyond 6years and also regarding cap exempt Visas and supposedly how easy it is to get them. Looks like with the economy being how it is, Congress might use this report to jump in and bring some unfavourable changes. Any thoughts on this...?
