That helps somehow I was under impression that once you invoke AC21 you have to use EAD. I prefer to be on H1 as long as possible till GC come.

yes. AC21 is a provision to allow you to change employers without affecting ur 485. It has nothing to do with work authorization. Your authorization can come from ead or h1 transfer.

My I-485 was filed in month of August 2008 under EB2 .I was laid off from my I-485 sponsoring employer(A) in month of August 09 and i took another Job with employer (B) in same field in month of Sep 09. I did not file AC21 as my previous employer's(A) attorney advised not necessary to file AC21.Now I am getting new offer from another employer(C) in same position but this new employer(C) wants me to file AC21 .
What are my options now? Should i file AC21 for employer (B) first and then file AC21 for employer (C) or should i directly file AC21 for employer (C).
I will greatly appreciate your reply.

The town we are in only has a community college only, my spouse is an engineer and they have nothing to offer... Small town restricts her chances to be hired on H1 too.
Biggest reason for taking up the new job is to be able to access the above options.....:(

MY PD - July 8 2004, RD July 2 2007 NSC. I-485 - Pending USCIS's mistaken with EB Classification. (came to know of this after opening 3 SR's and 3 Infopass appointments).
My Attorney wrote to USCIS last week about the problem with my I-485 (USCIS mistakenly put me as EB3 instead of EB2). I want to know experience of memebers / Attorneys who have writen to USCIS for any reason(s) (USCIS Mistakes, Eb3->EB2 porting, Etc) and goten response and how long did it take for getting the reponse. Any Hard LUDs/Soft LUD's after sending letter etc.
Please share you experience.

Hi,
Company B has applied for I-140 and 485 because you will work with them for a min of 6 to 12 months after getting GC.
So its not required for you to join them if they have already submitted I-140 and 485. You can say that you will join them after getting GC.
And if the 485 takes more than 180 days for the approval from the receipt date you can apply the AC21 portability rule and submit a new employment offer from anycompany and you can join that company.(Provided I-140 is approved and if I-140 is pending for more than 180 days then you can port the I-140 priority date by restarting the whole GC process)
Above is the knowledge I got from IV and google.
So u dont need to worry and join the company B, but keep them happy since they have to respond to all RFE till I-140 is approved.

I have a question. Our files are stuck in the Chicago local office (after our interview last year) and the only thing pending is the Namecheck, which has been pending for more than 180 days. Our PD is current. Is anyone in the same position?
It is frustrating because you do not get any LUDs when your files are in the local office and I have no indication whether the Chicago officeis processing cases with NC pending > 180 days. Anyone knows?

Is there any risk in rescheduling a fingerprinting appt? I am travelling when the appointment is currently scheduled for:(. Does that impact the overall processing times of 485/EAD/AP?

You can use AC21 because, 180 days is completed and you have approved 140 from employer A.
The amendment is to continue your green card process in employer B.
Note : employer A is old company.
employer B is new company.
I hope some of the senior people in this group can give you more correct information. Consider this information as my analysis, because I am also in the same boat.

Friends,
I have had my GC for about two and a half months now. I am currently checking out SOA consultant positions with a consultancy in Saudi Arabia. I don't know the length of the contracts yet. Can I work out of USA and still apply for Citizenship after the wait of 4 years and 9 months ? Does this require me to stay a certain amount of time in USA for every year ? What are the tax implications ? Would I have to file taxes on the income that I earned out of USA ? Thank you.

I spoke to another Border Post official and he suggested that i drive uptp the nearest border and they would refuse my entry to Canada as i don't have a valid visa and i can turn around and come back to US and i can get a new I-94. Do you think it would be safe to do this ?

You will not get new I-94 for travel to Canada less than 30 days.
What visa status are you in? If you are on H1, your H1 renewal will have the new valid I-94.

hi everyone,
i wondered if someone could help me find answer to the following questions.
I am a Physician and currently in Residency program which is for 3 years. my residency ends on 30th September 2008 and i have H1b status. I have been offered Fellowship in my desired specialty but it starts on 1st January 2009, therfore there is a gap of 3 months between the end of my current job and beginning of my next job.
so my questions are:
1. H1 petition which I will file for my fellowship starting 1st jan 2009 would be an extension of my current H1 or would I have to file a new H1?
2. suppose I find a job for 3 months gap period at the same institution where I have got my fellowship (keeping in mind that decription of this job would be a little different from what i will be starting from 1st jan 2009), would i have to file for 2 different H1B petitions (one for 3 month period starting 1st oct 2008 and the other for fellowship starting 1 st jan 2009).
3.also, I was thinking that if I file for H1 approval say in july 2008 for the fellowship starting 1st jan 2009 and get approval by mid september 2008. with the approved petition I go back to India and have a vacation for 3 months and come back to US in late december 2008 on H1B again for Fellowship beginning 1st jan 2009. In this case, what would be my status for the gap period of 3 months that I spent in India?
also, would I be issued a new SSN when i come back again. also, i have heard rumors that US embassy in Delhi can hassle you to get H1. How true is that?

My labor got approved couple days ago and my employer would like to file I-140 without using an attorney. I have few questions, it might seem simple to you but I am confused:
I am a software engineer and labor approved for SOC 15-1032, what should be filled in the nontechnical description of job field? For H1B, my company listed duties of the position on the cover letter for this question, should it be the same way for I-140?
Anyone has sample template of the cover letter?
My company has not filed tax returns for the last quarter, will the returns of second last quarter do? I have W-2 which is substantially higher than the proffered wage.
Since I am earning more than the proffered wage should that be filled under "wages" on I-140 or the offered wage mentioned on perm?

Any significant absence from the US can lead to a finding that one has abandoned permanent resident status. Such determinations are very fact specific. It is a commonly held myth that merely entering the US once a year is sufficient to maintain GC status. If you forsee spending significant time out of the US, you should take steps to protect your GC, such as filing for a re-entry permit. You should also consider maintaining ties to a home in the US.
