Well said.. we, who have not yet made up our minds, have no excuse NOT to support IV.
Right now, there are several things we all can do:
1) write to congressman/woman
2) meet congressman/woman
3) Join Team IV fitness/fund raising group
4) Contribute in the current funding drive
5) Become active and then tell your friends to do the same.
Why are we discussing this subject when it will do nothing to take us closer to getting the GC? In almost each social event, I have heard this subject being talked by my fellow friends. But discussing it on IV forum does not serve much purpose.
To me, it seems in the conversations about this subject (not just this thread, even in social events), each person is trying to find a group of people that agree to his or her thoughts. That makes the group then feel better. But what do we all do the next day, pray that we get the GC fast. People who want to really go back to their country do not take much part in these discussions. The officer from looks & accent seemed orignally from US's southern neighbor. The way I convinced him was repeating how important it was to visit my parents as they are so far away and I get to visit after long time etc..
But as one of the poster mentioned above, they should make some change in the text and purpose of AP.

I don't think you're following it too closely.. every year it creeps up a few early 2005 months, becomes unavailable the last quarter then in October jumps back to late 2003

For those of you who qualify, HSMP , I think is a much better option. There in UK the permanent residence is not dependent on employer and you can do your own consulting. Typical bill rates are 350 to 600 GBP per day based on skill level and years of experience.

Just curious, why are you not porting your PD?. Nowadays Perm takes less than 2 months and with premium, 140 takes a few months.
I-140 premium processing was stopped last year...It takes upto a year or more to get I-140 approved, that too if its a direct case...If its a interfiling case to capture PD from Eb-3 to Eb-2, then its taking even longer..One of my friends filed I-140 in March 2007 to capture his Eb-3 PD of Apr 2004 to EB-2 and he is still waiting....I-140 processing dates are well beyond his receipt date but still his application is pending....So porting PDs is not that straightforward these days...

I have filed FIOA request and got reference no. or control number with below information in letter after 3 weeks of mailing initial form G-639 (notarized)....
All FOIA/PA related requests, including address changes, must be submitted in writing and be signed by the requestor. Please include the control number on all correspondence. Requests may be mailed to the "FOIA/PA Officer at the National Records Center. P.O. Box 648010. Lee's Summit. MO 64064-8010" or fax to 816-350-5785. You may also submit FOIA/PA related requests to email address at uscis.foia@dhs.gov.

I was debating the fact that we need to ask India government to device some sort of parity between Capital acceptance from U.S. firms. It takes us, who respresent Intellectual capital, 5 to 6 years to get some kind of permanent residency in U.S. and that too in a grudging manner. Why do U.S. MNCs demand immediate clearence of their projects and complain about delay etc. If you look at comparative delays, Indian system is still light years ahead of so called efficient American system. Its just that we need to look at things from a correct perspective. Monetary capital needs to be treated at par with Intellectual capital. Just a thought.

You have to register the birth with the consulate (to get an Indian birth certificate) within a year using this form (see part II) (http://www.cgisf.org/visa/misc.pdf), following which you should be able to get an Indian passport. The USA will not issue a visa on this passport since it considers the child to be a US citizen. However, US policy in this regard does not matter if the child never travels to the US.

EB3-India cannot be discriminated.
Anyone in EB3 after 2-3 years waiting is qualified under EB2-I. And we see people waiting for much more. How can we be discriminated then. We have to do something.
We are able to get very good number of people with like minds in Edison, NJ and other big cities with big concentration. We are planning to start a drive against this discrimination, in about 2-3 weeks from now. We would like to write to the honorable policitians and processing centers like Texas and others and to USCIS to treat all fairly.
1. EB3 India cannot be treated unfairly, wheras EB3-China is much ahead. Why is this.
2. EB2-India is Feb 2004, wheras EB3 India is Nov 2001 for many years. Why is this.
3. Why are allowing family immigration when skilled immigrants are waiting.
4. Why should greencards be counted head-wise, whereas H visas are not.
5. On the whole, why backlogs and punishing us.
These are the lines in which our group plan to drive this.,send more ideas.
For this we need money and more impo'ly efforts, so please contribute smartly as we request below.
We have teams in all major software hubs like NJ, DC, Livermore, CA, TX, Detroit, and and will need volunteers. We will soon come up with a yahoogroup to communicate.
We plan to send 10,000 letters and other awareness programs letters to the concerned people.
We plan to have our small booths in temples where many people will come.
We will print all the letters, you just need to buy the stamp from us and mail it.
Or give us an envelope with the 42c stamp. We need about 5-10 from you all.. So its will be $5.00 per head. That way there will be no quesiton of transparency. But if you want to donate more, you are welcome, instead we will prefer you put your efforts in creating strenghr and pass the word.
We cannot keep quite like this. There is no reason why EB3-India will move forward in current situations and with current rules.
We know EB2 will be upset, but based on your contribution, we can fight together, else we will go alone. EB3 is big enough to go by itself.
We plan to wear white dress with white caps.. for peace.. So we can be easily spotted. Give us a envelopes and stamps.. or we will give you addresses to send and the document.. As you wish...Or buy the stamps from us and take the printed content from us in free envelopes.

it depends on who is in which category ..I feel the above (1 -2 -3) is unjust ..not that I/we can influence how it flows. my view is that the category which is at the end should get more visas ...and I would support this even if things change tomorrow (EB3 current and EB2 severly retrogressed or EB-wwide - retrogressed ..not that it will ever happen !!)

I think you are wrong... Company A can revoke approved I-140, if employee leaves them..

Company A CANNOT revoke approved I-140. I have checked this with 3 to 4 attorneys & also with Gurus on this forum. Only the USCIS has the authority to cancel the approved I-140, if it detects that it was obtained fraudulently.
One more suggestion, ask company B to file your H1 with Premium processing. Once you get H1 approval then submit resignation to Company A.

there is no employment allowed on H4. Please check with your lawyer as you might have problems with canada stamping
she has never worked on H4. The problem is that she has not worked on H1 either and I am thinking of changing her back to H4 to be safe.
