Just wanted those sending applications now to know that Nebraska has recently rejected hundreds of (i) EB2 cases with x yrs of experience + BS even when x is 10 and (ii) EB-1 cases even with Ph.Ds (this accding to my lawyer.)
Ph D does not make it EB1 at all. I know fresh CS/EE Ph Ds from good schools in teaching jobs in reasonable schools apply for EB2. I was surprised to know this.
Based on the posts here, it looks like there are no fixed rules. I don't know whether it depends on your lawyer or USCIS or both.

I seriously hope that the Director of the USCIS understands our "Gandhigiiri".
We dont want the Americans thinking, "hey lets keep screwing these immigrants and getting stuff like free flowers and free blood from them"

My last post in the matter. By our perspective, what I meant was, if you see an article talking about common topics such American Compititiveness or Illegal immigration you can always send an e-mail to the reporter and talk about plight legal immigrants. In most cases you will see a response from the reporter, whether they publish it or not is generally a matter of who you represent and audicences to the cause and other issues . That's why I said if IV as an organisation sends an e-mail (it could be me or you but representing IV itself) there is a possiblity that you will be taken seriously. But repeating the same issue to the same reporter 100 times will not make it any important it might even have a deleterious effect. I have seen this method working in the past. If you disagree with my approach, let's agree to dissagree on our approaches.
--> Hear you totally sending one single message but what will you release for press and how often will you do it. If I am not mistaken, You are suggesting that we come up with a list of issues and do a press release and that should be fine. Well, Its a good idea and I am sure we had PR releases when there were events.
If you are saying that we should do a press release now instead of sending personalised emails, I guess its gotta be more with the $$ than being able to do it. Not all reporters, do leave an email and google might do the job. I have tried sending emails to such reporters and the response has been lukewarm over the past 2 months. Here is what one reporter has to say.
Well, youve got a hard sell now because everything is so centered on the elections, and the larger immigration story centers on the undocumented (who are far greater in number than high skilled immigrants, at least those seeking green cards.) A lot of media outlets also dont have immigration reporters per se. If I were you Id target business reporters. But make sure they havent already done something on this in the past year, because even though not everyone listens to or reads everything we do, we do tend to wait a while before repeating the same topic.
Mostly the problem is we all have tons and tons of possible stories and not enough time to do them all, so I can understand your frustation
Do you think that if 3 or 4 more of us has written to her, will she re consider it? may be or may not be. I dont think they have so much time to cause a detrimental effect. They dont want to write on it, it goes to /dev/null :)
<---
If this is the case no matter how many e-mail we send it will not have any impact on him/her. That debate is almost like Conservative vs. Liberal debate and no amount of convincing can convince the other side.
I thought that was what we are doing. 25, 10, 1000 are all numbers, if 1000 is a spam why 25 isn't a spam. I think it is subjective.
--> Well, There is too much prediction on this forum than sending emails to people. Forget about email, I doubt if every member has sent the webfax. When you call it SPAM, Is it 100% unsolicited, undesired and one of those email that should have gone to the bulk folder but came to Inbox? I dont think so. But by doing copy/paste, we might be just telling that we are seeking attention. By writing in our words, may be we are expressing a concern. Public can always write to media and lawmakers. Circling back with the number 25, I dont consider it a spam if 25 people express a genuine problem in their own words
<--
Anyway, I will contact a local reporter and see how it goes, but I will not send e-mail to this editor becasue there are already e-mails sent by others conveying the same thing.
-->I will be very happy if you can elicit a response easil y and will learn the tricks from you ;) Sure, You can refrain from sending an email to this editor as I clearly see that there have been ~ 10 or more emails.

I believe they might have assigned a visa number to you. Please raise a SR or take infopass and try to find out more.
Well I jumped a little too early :) and opened a SR in July. The following is the response I received:
================================================== ========
The status of this service request is:
The Service is waiting for VISA availability. Once a VISA becomes available allow additional time for your application to be reviewed by an Officer and you will be notified as soon as a decision is made
================================================== ========
It is less than 60 days old status now and hence cant open a SR for 1.5 months :)
BTW, it has been over 2.5 months now and my AP hasnt been approved yet

e-mail won't do it. Put it in writing or wait until 90 days passes from the receipt date
This is like the banana joke in an old tamil movie, it is over 157 days and the USCIS now wants to go by processing times which mention july 3rd processing date, which is still late, but then they will say it is just one day over your receipt date.

Not sure what Shana wants, looks like he is feeling insecure about the whole process of changing jobs or layoffs etc....
He wants assurance that AC21 works fine and he will not have any issues.
I can only say - AC21 protects you, but cannot guarantee the ride will be smooth.
Chandu,
It is not about me and I have used AC21 with H1 and now on I using EAD.
I had bumps on my way with RFE and sorted out with my attorney.
All I am asking is in general for every one who are on this I-485 (freeway).
I would personally prefer paying tolls and had a smooth ride, but thats not an option for me.
Good luck to you!

See for your self what Pre-Adjudication means. Its literally conditional approval......
Pre-Adjudication is just a work flow method and not a policy. There is a high chance that a pre-adjudicated case may just get an approval when the visa numbers are available. But, who knows, they may have reasons to still issue an RFE requesting employment verification based on certain triggers such as change of address, over a year since case was pre-adjudicated etc.
So we may not be able to say for certain that all Pre-adjudicated cases will be approved when visa numbers are available.

Sukanya Roy is America's spelling bee champion | Sukanya Roy | 2011 Scripps National Spelling Bee | Indian Express (http://expressbuzz.com/world/sukanya-roy-is-americas-spelling-bee-champion/280779.html)
WASHINGTON: Spelling tongue twister "cymotrichous", Greek for having wavy hair, Indian American Sukanya Roy has won the 2011 Scripps National Spelling Bee crown to retain the coveted honour for the community for the fourth year in a row.
Roy, 14, an eighth-grader at Abington Heights Middle School, Pennsylvania, said she knew as soon as she heard "cymotrichous" that she'd get the word right and win the championship Thursday night.
"My heart started pounding, I guess," she said. "I couldn't believe it. . It's just amazing. It's hard to put into words."
It was Roy's third trip to the national spelling bee, and she had credited her past experience with keeping her calm and relaxed heading into the finals. She tied for 12th place in 2009 and 20th place in 2010.
Roy speaks Bengali and every summer travels to India to visit family. She hopes to pursue a career in international relations.
Roy is the ninth Indian-American in the last 13 years, a run that began when Nupur Lala captured the crown in 1999 and was later featured in the documentary "Spellbound."
The winner will be awarded a $30,000 cash prize, a trophy, a $2,500 US savings bond, a complete reference library, a $5,000 scholarship and $2,600 in reference works and other prizes.
Anamika Veeramani had scored a hat-trick for Indian-Americans in taking the crown last year.
Roy was one of the six Indian Americans - Sriram Hathwar, Arvind Mahankali, Prakash Mishra, Mashad Arora, and Dhivya Senthil Murugan - who made it to the last 13 in the finals.
The youngest finalist was 10-year-old Dhivya Murugan of Denver, who was born in India.
The spelling bee kids just keep getting better and better. Even words like chlorthalidone," "dreikanter," "renminbi" and "helichrysum" couldn't sufficiently narrow down the field in the semifinals, which needed 95 minutes of overtime earlier Thursday to whittle the competitors from 41 to 13.
The week began with 275 spellers. A written test Tuesday and two oral rounds Wednesday reduced the field for the semifinals.
According to the Scripps Spelling Bee's website, this year brought contenders ranging in age from 8 to 15 years old from all over the world.

as far as I know, you paying for H1b is not correct and is illegal and they will be accountable for this. Secondly, I heard the contract dont stand in court, especially when they are rude.
I think you have an option to report this employer to DOL/USCIS, for charging you the H1b expense. Companies should sponser H1b only when they genuinely need and can pay for the expense!
I am not a lawyer, so I recommend you consult one. Also feel free to communicate this issue to your employer and I guess you will be on your own!

Scenario1:
If you are on H1 in your 6th year with EAD (not used) then after 6th year will be applicant be on EAD or does he has to fill I-9 with employer
Based on how HR departments handle i9 forms, in most companies, they may not know when your h1b or EAD is expiring - some HRs may have calender triggers and request for updated EADs or h1b extensions. Usually you need to show the EAD or H1b extension with updated i 94 and they take a copy and place it in your file so that if there is an audit, they will produce the documents.
So it is your duty to inform your HR department that you wish to work using EAD after 6th year so that they update the i 9 form
Scenario2:
If you are on H1 in your at the end of 6th year with EAD (not used) then before the end of 6th year an applicant loosed job. then from that point will he be automatically be on EAD or does he has to do some thing to file till he gets a job (because once he find a job and he might apply for new h1 or join with EAD and he can file I-9)
Basically, if your 485 is pending for more than 180 days and you lose job, then technically you can start using EAD and move on using AC21. You can even get a h1b transfer as your 140 is pending or approved.
EAD is not a status and one does not fall int EAD status - if you lost job on h1b and satisfy AC21 criteria then you are in pending AOS state and use EAD to work.

I am not sure why someone said that it is scheduled for 24th.
I've started calling and made first call to the chairman's office. I told the man that I'd called to express my grattitude and thank the chairman. Then I requested the chairman to take a yes/no vote on this bill and to take the bill to its logical conclusion, at least in the Jud Committee.
Please remember, "thank you" packs awesome power and all members should convery their thanks to the chairman and request a vote on the bill for logical conclusion.
I have not finished calling yet and I iwll update the poll only after I have made all the calls. From this thread it looks like the hearing is on 24th. If that is the case I will make the calls tomorrow so that I could actually talk to someone.
