    Compare passing of bill with statusquo. Which is better?
    Main changes are legalization of illegal immigration , point system,H1b increase with restriction and slight increase of immigration and reduction of family based immigration. If any of these need big changes bill is in trouble and CIR is years away. If no CIR no relief for legal also. This bill with minor amendment is much better than statsuquo


    Yep!! This bill is really bad.
    It bleeds us dry.
    It bleeds the H1B program dry.
    It is evident that the proponents of this bill want it that way.

    Apparently the proponents see us as negative impactors to the US economy
    Apparently the proponents see the business community that use the H1B program as not "Pro-American".

    This is the beginning of protectionism.
    This is the beginning of isolationism.
    This is the beginning of blunting of America's competitiveness.

    The proponents of this bill must go back to school to study rich European nations and find out why they do not have vibrant economy like US has.
    And the proponents of this bill must go back to school to know what makes US unique and vibrant.

    After this if they still remain proponents, then GOD SAVE US!!!!!

    Must an H-1B alien be working at all times?

    As long as the employer/employee relationship exists, an H-1B alien is still in status. An H-1B alien may work in full or part-time employment and remain in status. An H-1B alien may also be on vacation, sick/maternity/paternity leave, on strike, or otherwise inactive without affecting his or her status.

    No, but he must be an employee. H-1 employee can avail vacation, sick days off, unpaid vacation days as are available to ALL OTHER employees. Employer needs to document such policies. There are complex issues involved here.

    Like you said in post As long as the employer/employee relationship exists this is the key part. How to prove employee relation - mostly by pay stubs and employment letter. Also, I-9 Form date determines when employee really reported to start the employment.

    You reputation has gone up because you are supporting a shoplifter over hook...? wow. Support sex offenders, rapist and drug addict and kidnappers... you would get even more reputation.

    Each of our past has its own dark stories buried somewhere.
    Who are we to decide whats wrong and what right? are we that "good" to say that OP is "bad"??
    Have we lived a honest and sincere life?? we should ask these questions to ourselves before weilding knife at OP.
    Give the OP guy a break. He is expressing remorse for what happened [again i am not getting into the discussion of whether he is innocent or criminal here].
    But do remember that all "shoplifters" are not criminals. Some go through misunderstanding process and get convicted. So without understanding what exactly happened, don't start judging people.

    OP: you are showing remorse, you are one step closer to forgiveness from god.
    Regarding immigration issues, please consult a criminal immigration attorney [they do case analysis and give you memo kind of thing that describes whether you case falls into CMT or not, and whether you are admissible or not]

    I did refered earlier in this forum ,about KIRAN SATHAYE AGENCY (http://www.givemeinsurance.com) , a desi agent deals with Farmers Insurance in Texas only.
    I got mine and my wife insurance with him for $15 a month covering 250K Term Life insurance ( We are on H1 )
    Check for any Farmers agents in your area.

    Mainstream media seem to be cautious about these issues as it may work against their self interests.

    I am still surprised that CNN did not pick this though MSNBC (did a positive) and FOX (Did a negative) on this

    I asked my attorney he said that I need to wait at least 1 more year. The Nov and Dec are gone in holidays. These Gov emp are worst then Indian Gov Emp.

    So, what are the options for EB3-I? It appears that porting to EB2 will be more difficult moving forward due to difficulties in getting PERM approved especially for IT professions.

    If the recapture of unused visas does happen, what is the estimate on how much EB3I would move?

    Figures suggest that there are over 800,000 pending applications. Recapture will get around approximately 215,000 green cards. We are shot of around 600,000 green cards, which will take around 4 years (@140k/yr EB green card) to address the current backlog, which contains your and mine application. This is a deep deep hole and EB3-I is at the bottom of this hole.

    You have been current so many times - did you ever take an infopass, talk to congressman, ombudsman, senator, calling USCIS etc. Did you do any of those?. Whats your I-485 receipt date?

    My I-140 was lost in mail just this year. My employer contacted USCIS, and they told him to file form I-824 (yeah, with fee). We did, and I got a duplicate approval notice back in about a month. So, if that's your case, here is the answer.

    I did FOIA on my previous LC attempt (not I-140); it took over 6 months to get all documents back (you can request a CD instead of a stack of photocopies -- they'll scan all papers and burn the files on a CD for you). I've heard it's getting worse, in terms of response time.

    I would love to get involved with bunch of like minded people.....I have all the experience needed for starting and running a company. I have successully done thrice.....We have so many experienced folks who would love to start and run a company but lack the experience/knowledge of running one. it would be a good start to bring all such people to get together and pool our knowledge, skills, money and succeed.

    Let me know what do u guys think... We can discuss next course of action.

    I will be facing the same prob if i dont get my extension in-time. At least EADwill work,meanwhileI am filing for my H1B extension ,but dont want to spend another 1000$ just to expedite the process for DL...

    What is your take on all these bills.. I am sure you have much more info. Do you see any hope of EB relief in 2009?
    There is growing pessimism in EB community.




    I ran these through my program but it is returning NULL.
    I guess each object needs to have a voting property or Lobby class attached to it. Without that you will only get Null values in return.

    There will not be any advance in dates for both Eb2/EB3 (I)..this is my guess.

    This will be a class action lawsuit which means that all the people who are in the same class as the plaintiff will get the benefit of the favourable decision. Now on whether to file or not, it is an individual decision but most of us have already prepared for the filling so there is no harm in going ahead with the filling. The worst will be to file again but nothing more than that can happen and as I have heard most of the attorney will not be charging again when people will be refiling their cases. So better to file your case and let USCIS reject rather than feel sorry later on if the judge rules in favour of the lawsuit.

    It is that time of the year again. Immigartion reform is in the air. Recently there were raids on many businesses and arrests ensued.The Bush administration is showing its zeal to pursue the 'illegal immigrants', 'Undocumented workers'.The pro-immigration and anti-immigrantion organizations are racheting up their activities. You would hear a common refrain from the anti-immigration ideologues like 'If they want to come to this country, let them come legally'. So let's see what the people trying to immigrate legally face.
    A major category of the people who immigrate to America come through a channel known as 'Employment Based' immigrants. They constituted almost 16% of the total immigrants to United States in year 2005. The immigration
    process consists of three steps
    1. Labor Certification - The US Department of labor administers this program. This process takes anywhere from 3 to 5 years. There are people in this queue who had applied for certfication in 2001. Now imagine waiting that long for the first step.
    2. Immigrant Visa application - The US Department of State allocates a visa number to the individual.
    3. Adjustment of Status - The US Citizenship and formally grants permanat resident status
    The whole process can take 3 to 10 years..There are people waiting to be sure of their status for even more than that. No wonder people are coming over the border rather than waiting in this hell. Some of these people have come together to find the organization http://immigrationvoice.org/. The goals include reduced waiting time for green card applications,increased numbers for employment based green cards, ability to get certain benefits if the wait time exceeds 5 years.

    What do you mean by upgrade to premium? I dont think you can change the option by simply upgrading. You need to file I-864 to change to consular processing.

    There are a few options:

    1. If you have chosen consular processing, ( I am guessing you have not), you can file I-485 and amended I-140 at any time PD becomes current.

    2. If you chose AOS on I-140 and the I-140 is approved, some consulates accept attorney certified I-140 provided you pay the fees usually payable to NVC. Expect 3 months of delay in getting an appointment though.

    Pros & Cons:

    Consular:
    You get your GC as against EADs endless loop.
    You have to be with the same employer for atleast 180 days since the time you get your GC and you enter US using your GC.

    AOS:
    You and your spouse both get EAD. NO need to travel to foreign country.
    You need to wait 180 days from filing 485 to change jobs (assuming 140 is approved, if not the case is more complicated).
    More time consuming and longer duration.

    The lawyers here will vouch for I-485 as it means more revenue for them. If you have a stable job where you are doing good and you are counting to get a promotion, etc go for consular processing instead of getting stuck with 485 process.

    I've a pending i-140 and I had opted for CP at that time (the lawyer adviced this as its easier to switch from CP to AOS)

    I can upgrade i-140 premium to get an approval asap and then proceed with CP, but I'm not sure how long it will take for the CP process (any ideas?), I'm concerned the PD will retro again and I'll be stuck again with nothing in hand.

    From your response CP looks like a better option but its too risky in my case correct?
