If DOJ agress what is being done based on country of origin is unjust, in what way can they help?
Can they ask congress to act? can they order USCIS to recapture lost visas?
DOJ does not ask congress to act. They directly give orders to executive branch that is USCIS in this case, based on their judgment..

The current definition continues to consider “backlogged” only the cases pending after subtracting those cases not yet ripe for adjudication, “where even if the application or petition were approved today, a benefit could not be conferred for months or years to come.
[Unripe cases are] excluded from the number of cases in the backlog but remain in the pending.”
Pending Cases Not Included in "Backlog" is 1,316,740 (Fig 1, 2nd column, page 14)
Total Pending = Backlogged + Unripe = 1,275,795 (page 11) + 1,316,740 (Figure 1, page 14) = 2,592,535 (as of March 2007)

Can anyone with some indepth knowledge predict availability for EB3 Rest of world (Canada). Here is some of what I understand - although I know it may be wrong (some infor from Shusterman site)....
- 300,000 applicants in BEC
- assume 200,000 get through

USCIS will go according to the ND. They will not follow PD. PD is used only to make the application eligible for adjudication or to apply for AOS. One filed, it is the application ND that takes priority. For example, if there are two EB2 applications, and the PD for the two are Aug 2002 and Aug 2004, and the ND for these two are June 2006 and Jan 2006 respectively, the applicaiton with ND of Jan 2006 gets priority, provided both PD are current.

kudos to what u accomplished in July 2007, but the reality is we haven't seen any major action after that. I guess its mostly frustration from ppl here, who think that the US housing/EB crisis can be pursued aggressively than expecting for CIR to happen.

To best of my knowledge, at least one parent must have US citizenship to get OCI ( the rules were different earlier - may be 3-4 years back ).

They will issue you a letter that states that the child is allowed to stay beyond six months. The letter that we got is valid for two years. We were told that if the child stays beyond the date of the validity date in the letter, then to come and get a new letter. The whole process took about two hours. BTW, this was in Hyderabad.

I was responding to a post on this forum (and not the press in general) that implied that this issue affects people from specific ethnic backgrounds, which is false.
I do have a general issue that people seem to forget that.
I applaud all core member efforts, however negative this post seems.

Should watch AILA's stand on this. One group who would benefit immensely with this system would be immi lawyers, at least for first 10 years after which it would be more established. A perfectly intelligent delaying technique moving the issue away from its solution at least by 2 full years. This idea appears to be so full of holes, it seems as though coming from WH itself. Soemtime Logiclife nicely argued against such a suggestion, it would help to dig out those comments and post them here...

My wife's EAD was applied on July 30th. She didnot recieve her EAD for 90 days, hence we took a infopass appointment and went to the local office on 92 nd day. They have informed us that they had sent a RFE on 88th day of filing and we need to wait for another 90 days after we send a response to the RFE.
Strangely the RFE that she got is for Birth Certificate which is not a required document for EAD.
I did not read anywhere that 90day count starts from the day when a response to the RFE is sent.

It would get attention and help in educating (legal vs illegal) and would be done in conjunction with other things like:

We have to attack simultaneusly (but SMARTLY) from all angles in order to be effective!

So before paying money, make sure that it is worth. USCIS web site has the list, you can search and find.
If you mean the SEVIS list, that is worthless. Even TVU was listed their. Check for accreditation in U.S. Department of Education Database of Accredited Postsecondary Institutions and Programs (http://ope.ed.gov/accreditation/) . Any accredited degree (not the fake accredited ones) is good

Hello there,
I have been wanting to make an IV contribution for a long time and here is my problem..I probably can be labeled a miseror a magpie! ..Whenever I go to the IV link to contribute and see the $50 or $100 option I panic and get out..yes I do!
I have some desi colleagues and was discussing this issue with them at work..and they had the exact same experience..wow..I am not the only magpie..
But hey is'nt IV the one which is at the receiving end not getting our contributions..
I speak from my own experience and call me a mapie or a miser..or whatever..I cant make myself make a $50 or more contribution .. thats the way I am..But I can sure make a smaller contribution (like a monthly recurring $10 contribution which really is easier to make) and I am quite sure IV will benefit from my small contributions as well as i think a lot more people will not hesitate making contributions in smaller denominations than a whopper $50+
And really this is not related to IV effort but more to do with my own way of thinking about parting with my money..I love my money..:)...

1. Copy the link on your clip-board (highlight and Ctrl+C). E.g., the following is the link for TSC
https://egov.uscis.gov/cris/jsps/Processtimes.jsp?SeviceCenter=TSC
2. Close *all* your browser windows. Perhaps you might want to open the task manager and kill the "process tree". But simply closing *all* the browser windows was sufficient in my system.
3. Open your browser. Paste the link (Ctrl+v) on the browser and voila!
They could be using some distributed web caching like akamai.

As per online status "Your response received on June 15th and processing resumed". If it's pending for couple more days, As per the rule i should get my $1000 back. Will my I-140 then thrown back in the normal (non-PP) queue?
