I came across a couple who got their H1B approvals last yr with in 3 weeks to each other. One of them was in PIMS and other one not. So I feel approval date does not seem to be a criteria to base these delays upon.:confused:

Guys do not feed the freeloaders by telling anything you are reading in the donor forum. Let these people help themselves by signing up for recurring contributions if they want helpful nformation about their EB2 PD movemement. We are still not meeting of our advocacy day amount. It is all because most people want free lunches. This needs to stop. The 200 people going to DC tomorrow are going to speak for you and me for yours and mine greencard. They are taking time off and spending own money for you and me. Nothing is free in this world. IV is also doing this for you and me and we are taking it for granted. Finallly, my online status changed from "Initial review" -> "Document production" and also got email from Senator's office that my case is approved.
I think I got it....but not 100% sure yet...no approval emails yet... or no other proof.

You are assuming that the spillover from remaining countries in EB3 will be allocated to EB3 I/C/P/M. The spillover rules that changed in 2007 will ensure that those visas will first go to E1 -> EB2 and then fall to us if there is an overflow. Unfortunately that will not happen because there are many retrogressed individuals in EB2 and they will get the visas first.
If there are 140K visas then EB3 category will get 140,000%28.7 = 40180

Received the physical card and the welcome notice on mail yesterday for self and welcome notice for my wife. Status still under initial review for self and for wife it is under post decision.

Hello every one,
I am starting this thread for all of us not to just think about the GC process. If any one is residing here for 10 years without GC, think about making a law which can lead us to Citizenship. My thoughts on this:
Many of our colleagues who landed with us during the late 90s (1998, 1999) and early 2000, who got their GC without any issues are now Citizens or waiting to become Citizen soon.
What is our status?. Just think. Still we are strugling to get the GC. Even by law change, if we are getting the GC this year (by GOD's Grace), then we need to wait for another 5 years from now (approximately 2014). Many persons like me who have come to this Country in their later career will be very much affected due to this delay (we have lot of other issues like the dependents reaching the age of 21 etc., College, University fees etc.,).
Core team and every one, please consider this and try to lobby for getting the citizenship without further wait if the persons satisfy the folowing conditions:
1. If they are legally here for 10 years (With approved I-140 and waiting for Adjustment of Status without current date).
2. If they have earned full 40 points in Social Security
3. If they have paid the tax continuously for 10 years
4. If they own a house and paying Mortgage (adding weightage to the Economy boost)
and
5. If they do not have any criminal records in these 10 years.
Please again do not just concentrate on the GC issues. Consider this and if any one can come with a letter draft with legal openion, we can send it to all Congress members, State Governers etc.,
Hope the members and the Core team consider this issue. I have one more thread on this, which I started some months back but the response was not that good. If every one of us unite on this and raise this to the Congress, I think the new Government may consider as this is very genuine.

Yes..OCT bullettin holds the key to EB-3..if its bacck logged..then EB-3 call SOS and port to EB-2..none else will work

There are more foes than friends in the congress and lawmakers do what there pupil tells them to do. Right now the under current in US is anti immigrant..

My $0.02. This could be a pre-emptive measure on the part of AILA. There must have been some talk at the state department of mid-month regression. This might be a strategy to scotch that. Raise a ruckus and send a message that we are prepared to file a law suit. Who knows? We are mere pawns in this grand game. Whatever happens, I hope people keep some perspective and not lose sleep over this.

I'm not getting this. If DOS/USCIS wants to retrogress the current dates then why they will wait for july2nd or 3rd. As they know people will file their applications by 29th june or they will try to deliver their applications by 2nd of july. So,if this rumour is really true then they would have posted revised bulletin in this week only , latest by today only, so that people will stop filling applications. So guys relax and keep doing whatever you were doing and file your applications by 2nd july.

I always use AMEX and I know they have a good service. Maybe that is the reason they don't accept AMEX. I also disputed the charges with my CC company and they just got back to me after a month. They require some kind of proof (which I have), but I know what they are going to say. Since the email from UK emb(ass)y clearly mention the amount of $184 and $276, they (CC company) will say the charges are correct. The trick is to catch someone at the emb(ass)y, but it will only work if their email's are working or someone out there will handle my voice mail message left on their answering machine. It is much easier for them to delete/ignore the message than to take pains to correct the situation. Remember, I am dealing with a useless govt. organization rather than a highly competitive private company.
You can take a printout from the UK emb(ass)y website showing the standard charges for Visa. I think if you print page from the following link , that will be good enough proof for CC company.

Hi,
I'm in trouble situation, maybe somebody can give advice.
I can file I-485(Eb3 March 2005). But my wife & daugther basically out of status. Their H4 visas were not extended.
Before june bulletin I was thinking to go back home with my daughter (she is under 18) and try to get visa in consulate. It was attorney advice. Also he suggest to file for an asylym for my wife.
Now I'm going to file I-485 for whole family regardless what attorney will tell me.
Is it good idea to go directly to uscis office and ask them (can I file)?
And what will happen if their apps gets denied?
Any ideas?

I was here since 1998... and cud not stop surprised to see the ideas in this thread..veeeeeeeeeeeeeeeeeeeeeerrrrrrrrrrrrrrrrryy yyyyyyyy farrrrrrrrrrrrrrrrr from reality.
Better to wor for admin things like visa recapture, some admin things within INS w/o any legislative action.
Do you guys have any idea that it needs legislative approval for things you are dreaming of...
It means it shd win in 100 members senate and in 500+ members house.
As Pappu suggested it is better to get more publicity, funds and then work for few admin things first(Gives a big relief) ...
But guys, what you are thinking is far beyond the dream itself.
I guess Pappu is the only guy active in Core now...
However let us concentrate as Core suggested, as they know the realities/pains involved.
Pappu, any core members active other than yourself, because i did not see a core member other than you fr more than a year...
Buddy some genuine dream may come true. We are thinking logically and it may become true. We are not trying to get any shortcut to get the Citizenship. Think High... You will Achieve...

I request some help on how to proceed and what is required for self filing 485 for child born in India. We have already filed 485 3 yrs ago and awaiting Approval( delayed due to retrogression). Now since the dates have become current we would like to add our child who was born in India and currently living with us here ( we are still maintaining H1 and H4 status valid). I wanted to find out what documents and letter( to build the case) is required for adding our child to the application. Also would like to find out if we need to attach our child to existing application(mother or father) or file is seperately. Anybody please advise

i wanted to share that i have recd by email confirmation regarding the GC production from USCIS (Aug 18).
I was, in fact, waiting for my fingerprinting notice - since my last one was couple of years old. My lawyer had written to USCIS to review the case and requested to send us a FP notice.
But what i got was GC production email for both me and my wife. My journey on H1b that started on Nov 99 has finally ended!!!:)

Am a new member here. Thought of posting the follow-up activities I have done till now and the results for the same.
Details:
PD: Oct 2005
Center: NSC
I485 RD: 07/26/2007
I485 ND: 08/24/2007
FP done only once in 2007 (forgot exact date).
Follow-up:
08/03/2010: Opened SR for primary (self)
08/05/2010: Sent email to NSCfollowup. Got reply that this account address is for following up on open SRs.
08/09/2010: Infopass appointment, did not get any useful info other than that case is being processed
08/09/2010: Opened SR for Secondary (spouse)
08/12/2010: Got response for 1st SR. Main gist of reply was that due to pending caseload in Nebraska, the processing time for my case has been extended :(. But the statement that got my attention was "Your application remains awaiting review by an Officer and you will be notified as soon as a decision is made. The Service is waiting for VISA availability." So called helpline again and was able to get to 2nd Level IO. She said that this statement is a mistake and that Visas are still available. Also confirmed that my case is with IO. However she said that I might be required to do FP again. The FP might be causing the delay.
08/13/2010: Contacted local congressman and asked help for following up.
08/13/2010: Send letter to Ombudsman
Latest status: Still waiting, not sure what other action I can take.
