Pappu, special thanks for researching this topic, and posting updates regularly.

Last week I too consulted a high profile (about $200 per 15 minutes... you should be able to guess, I am not sure I am alowed to mention the name) lawyer to discuss this issue. To give you a brief background, my lawyer did not include the Employment Verification letter
    1) He told me that he would re-submit the AOS. The comparison to the medical clearance requirement, according to him, was pointless, as they are two different things. If USCIS issues a statement they will not reject solely based on the EVL, then we can assume that is the truth. Their statement on Medical clearance cannot be interpreted to say they won't reject on the basis of another missing requirement, say the EVL.
    2) Filing two AOS packets can indeed also cause confusion, but it is a smaller risk according to him, and should be mitigated by a covering letter that says you are re-submitting to provide the XYZ document that was missed from the first packet.

Based on this info, I have asked my lawyer to get a confirmation from the USCIS on the document that he missed in my case-- the EVL. If USCIS okays that, we do not resubmit. If they don't do that within a week, I will try to re-submit... not going to be easy considering my lawyer may not be in agreement... but that is what would be the correct way out of this, according to the second opinion I got last week.

    Thanks!

just a question on #2 above - if you are filing second AOS with EVL, why not just withdraw the first AOS once you get the receipt? Wouldn't this be safer?

And to think just sometime back we had an action item to send mails saying "Give us GCs and we will buy houses and help the economy"! What a joke!! For all the labels of highly skilled/highly educated etc. that we shower ourselves with we are no better than those idiots and irresponsible people who bought houses far beyond what they can afford and ran away putting their keys in mailboxes when going got tough.

To the original poster: You asked an advise on an open forum. You asked a favor. You can't dictate terms like just tell me options and not your opinion etc.when you ask a favor. You don't like what people have to say about you, don't ask them for help. That's the way it works. Other people have every right to be upset with you as if and when you foreclose you will be asking taxpayers - and that's us - to foot your bill.

yes it is(both about work and supervision), read the pdf.

The L-1 Reform Act amends previous legislation by addressing the issue of “outsourcing.” L-1B temporary workers can no longer work primarily at a worksite other than their petitioning employer if the work will be controlled and supervised by a different employer or if the offsite arrangement is essentially to provide labor for hire, rather than service related to the specialized knowledge of the petitioning employer. This limitation will apply to all L-1B petitions filed with USCIS on or after June 6, 2005. This includes extensions and amendments involving individuals currently in L-1 status.

as IV community we must be against these violations. We must support only the compliance L1B.

    Sir, the question is not
    Who actually controls the work?

    the question is
Who actually controls the L1 person by directly managing him/her?

    big difference.

Lost in all this is the fact that Punjabi wants to sell his house not because he cannot afford it anymore, but because he wants to move to a different city to a higher paying job and can't be bothered to take responsibility for his failed real estate venture. He could have done the ethical thing and stayed in his present job and paid off his loan but he is choosing not to. And who does he blame for his situation? The concept of the "American dream". So the fact that he wants to shirk his responsibilities in favor of foisting his own debt onto the rest of the country isn't his own fault, it's the "American Dream" that's making him do this. It's not exigent financial circumstances that are causing him to foreclose, it is greed and shortsightedness (colloquially known as "The American Dream"). Greed and shortsightedness already caused him to go 20K under the water. And they will now make him screw up his own credit history. If someone cannot learn from one mistake, I say let him keep making mistakes. He will soon find out how difficult life in the US can be if you don't have a good credit history. As for the burden on us taxpayers, hey, we've been spending 10 billion a week for the past 5 years dropping bombs on people, what's a mere 20K?

These are stupid quotes that will only make the situation worse. The real solution is to make the fingerprinting independent of the green card process. There is no point in trying to push for a faster name check in the post 9-11 world, it will be shot down legitimately. We need to make sensible suggestions not demands.

You better read the OMBUDSMAN Report before coming with irrational thoughts!!

And I thought DOS is gonna move the dates by ONE year into June 2007...ha ha ha...

Can we? We can and should hold him accountable for his words. Anyone willing to volunteer to draft a letter. IV Moderaters do you support this?
I think we are on to something here. Please see the quote below from Arnold. Let's start communicating with his office and highlight the visa bulletin fiasco, flower campaign and media coverage. Should we start a new thread on this topic.

As Schwarzenegger has said multiple times:

"I think the most important thing to note is I am a champion of immigrants. I promote immigration. I am an immigrant myself. I think it's extremely important that we do it in a legal way."

At present my EAD is status not changed (USCIS case tracking), So I assume my EAD is valid. I also read Attorny Ron's blog that EAD is valid even I485 is denied. That gives me some comfort. Another problem, even if I get H1b (with out I94), I don't have AP to go (out of country) for stamping. What happens if I apply for AP while I485 is denied? Any one tried this? I am not sure what to do...

Buddy sledge_hammer this is the mess mortgage companies created, they need to face it.fanie's and fadie's caused this mess and they to need face it ?
I don't understand what you are trying to get at by asking me a question if Freddie and Fannie need to face "it"? If you are so sure they caused it, why ask me?

Who the hell are "fanie" and "fadie"? Are they your work buddies? Its "Fannie" and "Freddie"!

And why the hell is there an apostrophe ('s) to indicate plurality?

Do you think the individual should sit in that home and hit on their head with the 'sledgehammer' when they are in this mess? I would say get the f**k out of that house and lead peaceful life.
What mess? "punjabi77" is not in a mess! He is losing 20K if he sells his home. He is looking to relocate becuase he has found a better paying job.

You must be one of those idiots who can't construct logical arguments but just wants a piece of it on a forum to look like they too contributed to a current affairs topic. The likes of you read a couple of headlines on the internet or overhear someone at the water fountain talk "economics" and want to show off their new found knowledge over a forum where other ignorant and ill-informed trolls just like you give crappy suggestions and advices, and all of you think you know what you're talking about!

Sledge_hammer, use the thing in your screen name on your head to make your thoughts work correctly. Hey don't get me started.

Well, you should really have warned me about not getting you started at the begining of all that crap you wrote, not at the end! Now that I have gotten you "started", what are you going to do about it dimwit?????

THIS ISSUE IS CLOSED NOW. MISSION ACCOMPLISHED. WITH SOME REGRETS
    See the final results http://immigrationvoice.org/forum/showthread.php?p=300225#post300225

    *****************
    Original Message:

There is a difference between laws and regulations. Laws are what in INA (Immigration and Naturalization Act) and Regulations are what in CFR.
It takes congress and senate to change laws where as it takes discretion to change regulations. And the good news is that discretion can be challenged.
There is another thread on the issue and some of us think that we do have a case. Initial response from a certain lawyer has been positive.
    http://immigrationvoice.org/forum/showthread.php?t=20669
The affected parties (i.e. us) need to show damage in certain way and I do have some points that can be used. Our primary point is that the spirit of law has not been upheld.

Following are the steps in making this a reality:
    a) Gather around 50 people
    b) Develop and finalize draft of the case. Rolling_Flood has a initial draft.
    c) Hold initial consultation with a lawyer.
    d) Decide as a team if we want to continue.
    e) File a class action suit or next course of action
(as of 08-29-08 , we have dropped the idea of lawsuit and are pursuing other avenues)
Not sure what is the total cost but given the years of wait and uncertainty $500 per person should be reasonable. I will also create a yahoo group to start these discussions.

    Notes:
If you already have applied in EB2 you won't be affected.
If you have a Masters you won't be affected.

I will participate in this wholeheartedly. One suggestion to the admin: perhaps we can post this in other websites also like ? I know a lot of people use that site for posting problems etc and whoever is not in IV might also get to know about it.

Good idea. Please feel free to post this information to as many websites, forums and blogs as possible. Please do not restrict yourself to websites in english language. If you know of websites in other languages frequented by EB immigrants, please post this information. The mantra for success in this effort is getting as many letters as we can.

You are funny....you should take the moral high ground only when you are on the right side...you gave morally/ethically repugnant suggestions and have "decided not to reply to any of the comments here"...very funny.

I do not condone the pathetic language folks here use including from sledge_hammer. You can make your arguments with civility. No need to call people "fools", "idiots", "stupids" etc. Shows your own under-confidence and lashing out at the wrong things/people.

I think we should write letter and incorporate such things in our DC campaign.

I am tentattive to the DC campaign. But we should come out with a document or website and have our guys officially sign it and send it to all the parties involved in making such decision.

Agreed, Thanks for correcting me :)

    The calculation looks incorrect.

You considered the I+ C allocations and subtracted those in line 1. You again subtracted those in your final calculation.

The straight forward calculation is EB2 ROW is entitled to 34,436 (1) and they used 27,406 (2). So splillover was around 7 K.
