    Just curious.... When do they do the name check? Is it after the fingerprints are complete??

    I just spoke to a USCIS rep who was very helpful. She took the A# of mine and my wife's and verified the status of FBI name check and FP check. My name check is pending with FBI and my wife's was cleared as per her. For both of us the FP check is cleared.

    When I asked her when my name check was initiated I was told that it was on Aug 1st 2007. This is approximately 1 week after my 485 notice date. My FP was done on Aug 21st 2007.

    Many folks on this forum are so excited that consulting companies are going to be affected by this bill. Many FTEs think they are safe and consulting companies going out of business will help them get their GCs faster. Wait and watch, such bills typically affects direct hiring companies more than consulting companies in the end.

    Remember who is proposing these bills. Durbin and gang. Do you think they are trying to liberate the employees from the clutches of "bad" employers. I don't think so.

    Many IV members has started seeing this anti-H1B bill as CIR 2009.
    We are such a pathetic community !

    Isn't it part of her job? There is nothing like being servant. Moreover, it was just asked to rinse the bottle with hot water, to be sure it is hygenic, in a circumstances when baby was making tantrums. Another reason for asking was because bathrooms were full, otherwise there wouldn't have been a need. We have travelled many other airlines, and there was never an issue for such requests. Many airlines go extra mile to please you. It is what is called customer service.

    I don't understand why is it hard or degrading? Maybe then they are not supposed to serve you a cool cup of water at your seat as well. Is that demeaning as well on part of her job?

    no its not part of her job. I know a stewardess, and this exactly the part she dislikes about her job. people think its her job to attend to all little demands of the passengers.
    She has two duties on the plane, in order:
    - safety of the passengers. this is #1.(ensuring luggage is stowed, seatbeats are on, people are not wandering around the aisles; co-ordinate and help in case of emergencies)
    - basic service (serve food, clear the trays, handle simple requests like juice/water, ice barfbags etc). This does not include cleaning out your babies bottles. Some airlines have stewardesses who would go out of their way (I have seen Singapore Airlines do this) but again, rinsing a baby's bottle is NOT part of her job. She can get you a bottle of hot water if you want and you can rinse it yourself either in the sink or into the barf-bag.

    From IV: IV commends the initiative taken by it's members nk2006, pd_recpaturing, ItsNotfunny and others. As these members have observed, we all know that any one who has filed for AOS/I-485 can potentially be hit with this issue, especially in the current job market situations. If you believe in the old adage prevention is better than cure, this is an action item you have to subscribe to. It will be only a matter of time the number of such denials is going to spike.

    In recent weeks there has been a spate of I485 denials by USCIS in the AC21 cases. In most of these cases, the underlying I-140 has been revoked by previous employer. But AC21 regulations and related memo�s require that I485�s should not be denied based on that � provided I485 has been pending for more than 180 days and the applicant has changed to a new job that is same or similar. USCIS has been rejecting cases without even issuing a NOID � again required by AC21 regulations. So USCIS is not following AC21 regulations and related field memo�s for whatever the reasons.

    Obviously this will have a very bad impact on us � in addition to tremendous amount of stress it can have very bad economic implications including loss of job. In the current economic conditions we cannot afford to lose the job change flexibility provided by AC21 regulations. IV has started a campaign to fight this.

    After a brief campaign to write to Ombudsman, it has been decided to intensify this campaign and write to various officials in USCIS hierarchy. IV core members have been actively involved in coming up with a strategy and are actively supporting this effort. By sending large number of letters we can draw their attention to this issue and resolve as quickly as possible. There are other strategies that are being discussed and will be underway soon to tackle this issue. This is the first and the most important step up on which other steps depend.

    I request all the members to start sending the following 4 letters. For your convenience the letters have been completely written including addresses to be sent � all you have to do is download following 4 google documents � add the date, your name and address � and send it to the address provided on each letter.

    Why don't you just ask those 10 guys you know are comitting fraud ( by not joining the desi consulting companies and trying to workaround etc ) which company\companies they are working with and then file a complaint with DOL about them. I am sure DOL would surely look into their workings and will very very surely find out that they are doing something illegal in other things ( even if this is not one of them ). Those companies will get blacklisted and will set an example for other companies.

    But I don't think you should stop anyone who is doing it legitimately. If one qualifies for EB2 and has been in the queue for a long time he has the right to do it.

    My lawyer advised me as I mentioned before. If your case is simliar to me and if you might have hired the same lawyer he would have advised you the same as what he advised me :). The key is the "wait period" and letter from employer " To show readiness to promote based on skill progression for 2-3 years". Technically "real promotion" should occur on the day of interfiling or immediately after that not before the interfiling.

    How can the current position (EB3) relevant when the new employer is filing your GC for a future job (Eb2) ?
    Does the employee need to get promoted in the current job to apply for a future EB2 job ?

    I thought each EB category could get upto 28.6% of 140000 = 40000 visas every fiscal year. So if EB1 uses up 5000 and EB2 takes the remaining 35000 and its annual allotment of 40000, EB3 does not get any spillover.

    Thoughts?

    knacath, I am hoping that EB2 will be current this year and EB3 begins to get spillover though very little this year.

    Some more specifics

    Annual Quota ------------------------------------------------------------------------> 140,000
    Pending EB1, EB4, EB5----------------------------------------------------------------> 7,653
    Estimate of all categories current applied this year and approved this year -----> 10,000
    Remaining visas -----------------------------------------------------------------------> 122,347
    All pending EB2s (includes retrogressed) -------------------------------------------> 74932
    Remaining visas available to EB3(includes retrogressed) --------------------------> 47415

    The only flaw in above is ignoring CP and assuming all 140K Quota to AOS. The majority of EB1, EB2 and EB3 are AOS. So I am safely ignoring CP. Even if CP is 15% of annual quota as some one put it, EB3 gets its allocated 40K quota and around 65K pending EB2s get out of queue.

    When I cancelled in Mar-09 , my experience was different. The CS was humble and only persuaded me not to leave. But the cancellation process went smooth.

    FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.

    Our parents/relatives do not need a land phone in India. Send one VONAGE adaptor and they can call any number in India (long distance) and to USA and other 60 countries.
    They can receive any calls in a Cell phone (prepaid) (in India - incoming is free).
    So just take a broadband connection and Vonage. Bye BSNL/VSNL.........

    Remember you are talking about INDIA which is not US. you need broadband connection and Electricity for VOIP and you know the availability and reliability of both in INDIA.

    I came across a couple who got their H1B approvals last yr with in 3 weeks to each other. One of them was in PIMS and other one not. So I feel approval date does not seem to be a criteria to base these delays upon.:confused:

    I agree. The companies should feel the pain. our cause should get sympathy from the americans. We need publicity for our causes.

    ram_ram,

    Some publicity is good and we will be working on that. Suggestions are welcome.
    However I must tell you that being hostile towards companies will be counter productive to our cause. Infact we'll have to work with the companies and organizations formed by multiple companies. They may or may not help us, but being hostile to them won't help us one bit.

    Pls come up with any suggestions you may have towards this.
