    last i checked - there are plenty of flights between JFK/Newark and all major cities including Boston.

    also - all airlines work on a hub and spoke arrangement

    +1.

    One thing to realise is that direct point to point flights will take a while, and even then there is no guarantee that you will want to fly it because it may not be economical or convienient.

    And the absence of point-to-point flights has more to do with the airlines following a hub and spoke model than with any government restrictions. Point to point flights were identified as a core part of Boeing's product strategy only recently. The situation should improve over the next few years as airlines take delivery of new models, but until then we are stuck with the hub and spoke arrangement.

    We were very satisified with Continental even though we flew Seattle->Newark->Mumbai.

    I received a response from the ombudsman. I am not sure if our issue is properly understood by his office. When we write about AC21 issues, the response talks about I-140 delays. Gurus, please help me understand the contents of the response below:

    Dear xxxxxxxxx:

    Thank you for your recent correspondence to the Office of the Citizenship and Immigration Services Ombudsman (CIS Ombudsman). I appreciate your comments regarding I-140 processing at the Service Centers. We are well aware of the processing delays at all of the Service Centers and the AC21 issues created by these delays. USCIS has taken steps to address the processing delays, but their efforts have not come about swiftly. We have received several inquiries such as yours and are very concerned. We are currently discussing these issues with USCIS and continuing to review their policies and procedures concerning these petitions. Hopefully we will soon be able to help USCIS with a recommendation to address the I-140 delays and AC21 problems.



    Generally, we do not accept case problems presented by emails. Under the authority of the Homeland Security Act of 2002, the CIS Ombudsman assists individuals and employers who experience specific problems during the USCIS benefits seeking process, largely to identify problems and to formulate recommendations to improve the USCIS service.     As I said before, I am never going to fly thru UK, even though I sill have a transit visa valid till Nov 2008. I can still feel the pain.

    Yeah I would say get a direct flight to India via Continental or whatever else is available ( AIR INDIA would not be anyone's preference I guess ) rather than going through these idiotic countries.

    Dear Members,

    This issue will hit everyone sooner or later especially in rough economic times that we currently have. Even if you do not plan to use AC21, due to current economic down turn..One might be forced to use AC21..

    Let us start this campaign. Please DO send letters. As we also have IV support now, let us get a resolution for this issue with the help of IV leader ship..

    This will help people who are already affected due to these denials and aviod denials for other people going forward.. Printing and mailing the letter will take only 10-15 mins of your time..This campaign will be a sucess only with support from every one.

    The Los Angeles Times (11/11, Watanabe) reports that, according to a report from the Migration Policy Institute, there is "a massive 'brain waste' of highly educated and skilled immigrant professionals who potentially could, with a little aid, help ease looming labor shortages in California and nationwide in healthcare, computer sciences and other skilled jobs." According to the report's findings, "nationwide, more than 1.3 million college-educated legal immigrants are unemployed or working in unskilled jobs such as dishwashers or taxi drivers," and "nearly one-fourth of them, or 317,000, live in California." The report also "noted that competition for such professionals is heating up, with other countries such as Canada and Australia moving aggressively to attract them with better transition programs," and "suggested an expansion of successful programs such as Welcome Back," which helps transition immigrants with medical skills "back into the healthcare field."

    It is not true that all the H1bs are creating jobs. For one example I worked in a big garment company and they laid off hundreds of people(around 800) 4 years back and did offshoring 90% with 10% H1b and L1 to Infosys. This would have created less than 10 new admin jobs for setting up office here but it displaced 800 jobs plus all the new projects(jobs) go to Infosys and US government lost millions in taxes for a private company to save a few million dollars. But if a H1b is a real innovator or investor then he could create scores of new jobs but those guys are very less. They should be identified and rewarded by faster GC process.

    But real intention of H1b when it was created was to fill shortage of skills but not for competing with citizens in rate. If the real intention is to compete globally then that needs to be revealed while lobbying with Senators. There is nothing wrong with immigrants or H1b persons. Most abuses are done and enouraged by employers. Corporations prefers a person always to be in H1b so they want more H1b quota and less gc so that they can exploit people.

    Basically H1b numbers and offshoring needs to be increased when demand is high(Really it was needed on 1999 and 2000) and it needs to be decreased when demand is low. Also today also there is shortage of skills in a few areas. System should handle those also.

    Well there are different examples you can cite all the time to turn the argument in your favor. By themselves H1Bs in that status can not create jobs, because they are bound to the employer. However there is no denying that a lot of them such as those who graduated from US universities with masters degrees, those from IIT or IIMs are smart and bright individuals. I know at least 2 Indians , family friends that after getting their green cards, started companies on their own and now employ hundreds locally if not thousands.And let me tell you these are not desi consulting cos. The very premise of tying an H1 to employer is wrong, not the individual by himself. Instead if there is point/skill based immigration system then it will ensure only the brightest will come inside the country. Currently the decision to hire the immigrant rests with an employer and hence we see systematic corruption to some degree.

    Also what I said was companies are profit oriented business entities. Of course they will want to hire people who best benefit their business. Nobody is stopping a local from proving that.

    Good suggestion, I didn't ask about EAD, I will check next time. But I guess evantually EAD would be revoked after I485 is denied. I think H1 is a backup plan if MTR denied and till appeal is decided..

    I am sending letter CIS ombudsman shortly.

    well, EAD is denied when MTR is denied, makes sense. But if you see the information posted by 'desi485' in this other thread (http://immigrationvoice.org/forum/showpost.php?p=302334&postcount=17), it may remain valid till validity. This is indeed confusing though. Please ask your lawyer and share with us everyone here.

    Conspiracy? DOS is part of bush administration. And since the president is dissapointed because of CIR. He wants a back lash from immigrant community?

    It is going to be true. otherwise mathew wont shut down his work and post that AILF is going file law suit.

    I am suspecting that they made current because of lobby made by some big heads inorder to get support to pass the immigration bill.
    Since the immigration bill failed, DOS is going back to retrogression.

    What should be the answer to this question on I-485 part 2- out of following 2 options for my dependents ? to me it seems #b is the right answer for my family members 485 and #a for me. BUt some how teh legal guys are changing this from #b to #a for my dependents!!

    Thank you very much for your update. Went to the Infopass today and as per the IO came to know that my case is in adjudication review and will get the interview. I don't know how much ombudsman will be helpful, but will try all options. My labour was approved in 2 months and I-140 in 18 days but it seems I485 is sturck for ever :mad:

    My H1b1 extension petition was approved in October first week.

    hmm.. so this is very recent approval (just 3 months back). i know there are cases which are approved long back and they are also stuck in PIMS but we don't know their service center.. in your case we know that WAC with october 2007 approval is getting stuck..

    is there any one with WAC receipt number and approval after October 2007?? if there is anyone please post your details...

    IV should send a letter to Vonage CEO asking to put pressure on Obama and Senators to approve GCs quickly. We have been very good customers of Vonage.

    What a stupid idea.

    Why don't you write a letter to the CEO and threaten to cancel your vonage subscription if the CEO does not help you get a green card.

    Let us see if you choose to do it and lose your $10-15 dollars of savings every month via Vonage in the interest of gaining your greencard!!!
