    Ok, I had hoped not to bite the bait, but I am human, nothing recharges and roils like someone saying "you are EB3, you are worthless compared to US the mighty EB2s".

    The misleading continues

    1) "VDLRAO" (no disrespect to his prediction capabilities) says EB2 will be current soon, so why are you raising this voice.

    Well, if it is going to be current soon enough, then any action to redirect EB1 numbers should not be a cause of concern for EB2s should it? If you are going to become current soon, then it means there aren't many people waiting in the queue.


    2) We should support the visa recapture

    You all are assuming that EB3 does not support it. Unlike me, most EB3s are very active in calling, contributing and supporting those events. I have personal reservations about asking for a change in law when I am the direct beneficiary (I feel like those big oil companies who use their clout to get laws favourable to them, nothing wrong, just that I dont like to do it). Having said that, I have no problems in asking and demanding that the law be applied as written.

    Once I have my GC done with, I intend to write to the representatives that barring progressive experience in the same company rule should be removed, because it is the experience that matters, not where you get it. Why should someone who chooses to be loyal be discriminated against another who has no qualms about his company's future.


    3) You dont have the law on your side, USCIS/DOS only implements the law.

    Some within EB2 concede that the law is fuzzy, while others claim there is no basis for our campaign here. Well, there was no basis for so many things that IV has accomplished, and yet, most people accept that we are better off in some ways compared to pre-IV. If you believe that we have no basis, then why bother dissing us? We will make ourselves look like fools. If you believe the law is fuzzy, then you should realize that current interpretation is your luck, not your right.

    My attorney originally applied for my labor (regular process) in late spring 2006 but due to another issue we decided to expedite (premium process) in early winter 2006. Question is, is early spring my PD or early winter of 2066? (Sorry don't have the exact dates in front of me).

    Hi guys

    Just now (12.30 PM EST) I got a mail from USCIS saying your application has been approved. I didn't do anything (never opened SR or contacted Senator) but last week I did had an info pass appointment which was useless. MY PD was Feb 2005 EB2 INDIA (The fun part is My AP and EAD are still pending for over 4 months)

    I don't disagree with any of the statements.. It is totally personal decision for someone to donate or not.

    I agree that there is no silver bullet in any analysis. It is a number crunching game.. What is important is follow-up after analysis, which is only possible with IV.


    Dems want votes and more Hispanics
    GOP want more temps since it is very good for business
    Lawyers want more money so they are not interested in solutions. They are in it for money
    Individuals want their greencard just in time and not worry about the guy right behind them..
    tracker websites need traffic to get money from adds, so they don't want solution..

Believe me its all very simple but has been only possible with news, inputs, suggestions and critique from all its really teamwork. Only together we have been able to come to understand how best we can predict what the future holds for us. Nobody claims or guarantees for accuracy however we do try our best to give out the most up to date forecast. Many folks like and appreciate this and it brings traction and new members to IV. Nobody is discounting that advocacy is not important it really is important.     I received the card production ordered email today morning, after 1 hr again I received a Decision email. Online status shows as "Decision" , does this mean my 485 is approved?

    PD: 10-Feb-2006 (EB2)
    Opened SR on 08/03
    SR response on 08/18 - Your case is currently under review by an officer.

    Hi All,
    I am on a business trip to Chennai and I was interviewed for my H1-B renewal on Dec 6th 2007, unaware of the PIMS as it was not mentioned anywhere on the website that it will take this long to receive the passport. I was granted my visa within few minutes but till date (Jan 1st, 08) I have not received my passport. Was interviewed at the Chennai consulate. It has been heights of frustration as I had to spend all my Christmas holidays and New years at Chennai with all my fly being in US. I was supposed to return to US on Dec19th had to postpone my tickets to Dec 24th and then to Dec 29th. Now finally I have cancelled my tickets as it was costing me $200 every time I modify my itinerary.The US consulate, Chennai keeps on extending the processing time from 3 to 7 to 10 and it has been 15 working days already now, but still no passport in hand. Last week on Friday (Dec 28th) got an email that it might take additional 7 working days, huh ! Good thing is my company is in Chennai so atleast I can go to work or else it would have been really painful.
    Was anybody else interviewed at Chennai during that black week ??? with similar situation ?

    Are they interested in national security or just numbers of processed name checks? Why not create a special team to handle requests with the high number of "hits" as those are much more dangerous potentially for the national security?

    i will really really appreciate your posts..

    its been 23rd day..H1B renewal..New Delhi..still waiting for PP..i got no slip ..no warning to wait ..nothing..

    But now i think its not stuck due to PIMS..it could be anything ?? some admin processing ? some security check ? some name check ??

    How do we differentiate what are our passports held up for..COULD THIS BE CALLED 221(g)..i read in forums..221g can take forever ??

    I am not very sure but my understanding is that consulate will tell you if there is any issue reg security clearance etc (in other words 221 g).

    Did VO tell you anything about administrative processing during your interview??

    Maybe we can use the H-1 B reform bill, to recapture unused visas during the last many years. Make H-1 B tough but at the same time, release those green card numbers. Carrot and Stick approach.


    Guys,
    This is one of the key reasons why we are not successful in our mission. All we can do is "lets kill H1/L1 so I can get GC", "lets not worry about EB3 as long as my EB2 is fine!". The only way we can make any progress is to stay united. Lets not try to find carrots that would really be sticks on people who are also part of this cause.

    Multiple 485 and EAD filing

    Hi,

    My wife and I both got our LC approved. She filed I-140 and I-485 concurrently for both of us in Nov.2006 (Nebraska Center), based on her LC. Then I filed I-140 and I-485 concurrently for both of us again in Jan,2007 (Texas Center), based on my LC.

    The EADs she applied got aproved pretty quickly. Several days ago, my EAD applications got denied. The denial reason is, we already have approved EAD.

    Originally our plan is: My wife will switch to a Finance related job soon (her LC is based on Software job), I will wait for GC. (The reason we still filed for multiple 485 and EAD is that we want to postpone the decision on who should wait for GC). Now I'm totally confused on whether she can use the EAD, and whether I can renew the approved EAD (because they are based on her application).

    Any inputs or clarifications will be greatly appreciated.

    I really don't know why someone would file the 485/EAD through the spouse when the spouse is planning to change the career field, and you know that you need to be in a similar job description to work on EAD. It almost seems like a no-brainer that the guy in this case should have filed for the 485/AP/EAD.
