USCIS declares in weekly updates that actual package receiving date will be recognized as the Receipt date. However, as filings are shuttled between centers in an effort to push work around, when data is entered, a different date appears. This needs to be corrected. Further, as there are still cases not owned by any center, weekly updates are misleading. Each center just reports on what it has accepted to deal with. This needs to be addressed as well.
I think congressmen should be approached with the larger and collective problem, which is likely to get attention/action. Individual cases just receive standard replies.

your ad shows a company that has advertised for no EAD, GC h1b etc., which is legal, AFAIK.
It is not a small difference, but not interviewing someone based on whatever is probably their prerogative (even this may have certain limitations like -you cannot say "no women" et6c.,), visa status is not considered a protected class... again AFAIK. They probably cannot say no GC, but CAN say only citizens because of some clearance required etc.,
This is different from getting someone through the interview loop, making an offer and THEN saying sorry we ont hire you now because of EAD. That is BS. As for saying no to H1B, we have all been there, a company that does not want to sponsor cannot be MADE to do it.

The OP is great. He has created a new id to discuss L1 fraud. Will he be creating one id per issue... recapture, H1B abuse, outsourcing, backlogs?? wow!!!
Not sure why he wants his/ her identity covered up. This shows how good some of us are in trying to make noises in the dark and not doing anything about issues in hand.
In all, I still don't understand why L1Bs cannot work at Client site. I am sure that the L1 petitions specifically ask for Client site / work location. If Client site address is mentioned, the USCIS does approve the petition. If it is against law, they will not approve the petition. I know this for a fact since some of my friends are on L1.

So once these violations impact your day to day life you look around for ways to stop this fraud. Its true that if I was a Nuero Surgeon in Phily or a Astro Scientist in Houston I wouldn't be interested in this violation :-) .... tomorrow let this scenario happen to you ... you would be first one to raise the alert.
Regarding 'getting burnt', I don't think there is bigger burn than loosing our jobs (which already is happening) and hope you know that there is something called 'anonymity'... ya lets see whos going to get 'burnt' here. We'll definetly keep you updated regarding the outcome.

My point is not everyone wud then leave Vonage and move to another service , thats how Vonage wud gain, again are u sure u read the complete fine print :P
Look up Bait and Switch (http://en.wikipedia.org/wiki/Bait_and_switch). If vonage intends to suddenly switch their offerings after gaining customers through misleading ad - then it fits the definition of Bait and Switch - which is clearly illegal in US.
So even if you leave aside the bad reputation from such a maneuver (which, in itself would be huge since their target consumer base is clearly immigrants - most of whom are savvy consumers) - Vonage may stand to lose a lot from legal fees and penalties if they try to pull such a trick. Class actions are not fun in US.

Well, I am just stating facts. Just because you dont like them, I cant help it. You got to learn to move on. Agreed on your point. But there are other discriminations at workplace such as , age, race, sex and sexual harrassment. Those who complain about it effectively terminate their careers. If you want to go , complain against this L1 misuse fine, but you are not going to get mileage, maybe some bad breath and bad publicity and eventual loss of reference & job. If your company / client has decided they do not want to persist with you, there are 101 ways they can get rid of you, legal or illegal, my suggestion is, if you were exposed,

My priority date is current since september 2010.
My H1B transfer application is with USCIS since Aug 27th, 2010. The date for transfer requested is Novemebr 1st, 2010.
My I 485 was filed in Aug 2008. I have been working with the current sponsoring employer since 2005, no breaks.
I am expecting an RFE for my I 485. Anyone who was in similar situation share what kind of RFE is likely to be issued? I already have a job letter from the new employer essentially stating same kind of work duties.

I called the department of state, visa's section to enquire about this PIMS verification. They said that KCC handles it. When I called KCC they said they cannot check ahead of time :mad:

Let me give you an example and you would understand my point. USCIS Customer Services Directorate received 16 million calls from the public and 300,000 from Members of Congress. Add to it, all other items people do to get attention for their case and think that by sending an email or a phone call from Senator or by a lawyer, the officer will realize his mistake and quickly open the file and approve it. If you look at the responses people post to their inquiries, you would see that most responses are standard. USCIS is not just approving 140K greencards but more than a million greencards, hundreds of thousands of H1 and other visa types, EADs etc...every year. Greencards do not get issued on the day date gets current. It is not a automatic process. There is lot of human work involved and many people do not understand that or spend time understanding it. They would rather waste their time either on useless task of tracking or calling customer service every single day.

I doubt things would have materialized if i just kept waiting and here is why.
July 12th: I opened a SR to check on my I485. Purpose was to see if Namecheck was cleared. I wish USCIS gave me that info easily on the website.
July 29th: I get a response by email that they cannot find my I140. I was told to call back with I140 receipt number. This is a bizarre response as i don't know how they accepted my I485 in August 2007 when they can't find my I140.
So i call back and i was told to wait 30 days from July 29th to give the I140 receipt number since its not been 30 days since first receipt. They were counting 30 days from response they sent on july 29th. Now what do i do?
Aug 3rd i went to Infopass and showed them my I140 and I485. They told me i can see your I140 but i cannot say whether this is the I140 linked to I485 because case is at NSC.
So i went to my cognresswoman and based on her enquiry, the PD linked to my I1485 on USCIS system was Feb 16th 2007 instead of Feb 16th 2006. Her office faxed the I140 approval notice and made USCIS correct this error.
I tried checking with USCIS through NCSC and Infopass to see if the PD and category linked to my I485 is correct about 5-6 times and never got a correct response.
If congresswoman's office had not helped correct the PD with USCIS i doubt my case would have even been picked up for adjudication.
Only good thing i got at Infopass was that during my last visit, IO was indian. She told me to write to NSC with a copy of I485 and approved I140 letting them know that PD is current for the past 35 days. End of a loooonnnng chapter and onto next. Best of Luck for all those current and still awaiting approval. Keep following up through all channels and do not give up.
The cards came in a non-descript envelope that also had a 'Welcome to America' pamphlet. The pamphlet describes where to get information on community services, shopping, housing and jobs!!!! What an irony!

My husband's petition is from a reputed company, and its an L1 blanket petition... the petition approval date is somewhere in Nov. 2007... does this mean that it would take a long/short time to update in PIMS?
