Does anyone know if you can file for I-485 on a B1/B2 or do you need to have an H4 status?
It seems to me, you are on a B1/B2 and are contemplating a marriage to a "485 current" green card benfeciary...and subsequently filing the 485 jointly with your would be other half...
The intention in a B class visa is very weak and its purpose very limited. It is best to not do anything while on the B visa, and relinquish the B status, then either re-enter on a stronger intent visa (H1/H4 or L1) and then file 485 or file the 485 from outside the country.
Any change of status from a B class visa is usually looked upon with a frown by the USCIS...

F1 is strictly non-immigrant VISA. So having family members in USA has a bearing on F1. On the other hand, bunch of H-1B applicants have relatives in USA. Also H-1B is dual intent VISA. So you should be OK with H-1B.

You will have to open a service request (SR) with USCIS after 30 days have passed. Once you open a SR , usually service center will people will call and confirm about the current status and in about 45 days from SR open date they will try resolve the issue. If 45 days have passed, then you will have to take an infopass appointment figure out. Hope this helps!

I believe that the sponsored employee (and the attorney) are not allowed to have any part in the recruitment effort as per DOL guidelines. It should be done by the employer.

It is a hard situation for me. I-485 interview for AOS is due in just 3-4 days from now. I am separated from my US citizen wife.Have not filed for divorce. I am employed in the US on a valid L1-B visa.
Our marriage may or may not work..
1. I need advice as to how to withdraw the I-485 AOS application. I do no have copy of documents/notices that USCIS sent.They are with my wife.
Or
2. If we do work out our differences then is there a way to keep the current AOS alive? Or shall I get the current one withdrawn and file for a new one if we do resolves our differences?
3. Also if I do withdraw the I-485 does it also mean that the I-130 filed by my wife is abandoned/revoked automoatically?
Really appreciate a prompt advice.

If you have a job, getting a work permit will take only 4 hrs inside the consulate. No line. Give the passport and come back within 4 hrs to collect it.
No labor certification for computer(s/w for sure, dunno about h/w side for sure) professionals or petition. Need to show offer letter from the company and letter from company to the consulate.

I am planning to own a franchise on EAD along with my friend who is on H-1b. Please let me know if I can do it or not.
We are planning to register a LLC and run the franchise on the company. Let me know if I have to take any precautions before buying the franchise..
Also let me know if my friend can be my partner on H1.b..

My wife is on H4 and with recent events, we applied for EAD. Our EAD was approved a month ago. I recieved mine but my wife did not. When checked with USCIS, they informed I have to wait for 30 days.
It would be great if the group can share thier experiances or has any advise on this issue?

In my job search (banking and finance jobs) there is this one question i come across on each and every job application-
"Do you now or will you in the future require sponsorship to legally work in the united states?"
and options to tick on the form are 'yes' or 'no' with no space for explanation.
So i mark 'yes' and i guess thats where my job applications get stuck.
Should I answer yes or no, since i am on L2 (visa valid for next 2 years) and currently have 2 years Employment Authorisation (EAD) where i can work for any employer in the United States ?
I understand that companies ask this question because some of them are not allowed/ do not have a policy to sponsor visas.
I want to know whether i am legally required to say 'yes' beacuse i am on L2 ( since after 2 years, my visa renewal depends on whether or not my spouse's L1 is renewed)
OR
Do I still have a choice to say 'no' since my visa renewal gets done if my husband's gets done or i manage it on my own through a consultant... and the company i will join in both cases does not have to sponsor or pay for my visa either now or in the future.
I do not want to misrepresent any information and get thrown out of the organisation after i join, nor do I want to lose out on opportunities because of answering this question wrongly.
(There is a separate question that asks if i am legally allowed to work in the US and i answer 'yes' to that since i have an EAD)

This is to complicated and INS take a lot of time to respond....By the way do you know aproximately how long will take to receive the I-140 approval? And if there is a chance to receive a DENIED notice? Hearings will go on for a while. Since it is already known that the public oppose amnesty, personally I will definitely forget CIR. It may return again next year, but remember that by then the Senate may have voted out a number of incumbents that voted pro CIR.
I think this will take patience. If one can wait and watch this unfold for the next 2-5 years without going crazy, then you may watch the passage of CIR during your lifetime.
