Yes I think we should also try to see if non-immigrant people who have already bought a home they should higher priority date than people buying now. Also given the case of ailing auto industry add buying American car in the list too.

Here is what you should do:
1. Print this memorandum

2. Take it and go for infopass.
3. Insist that they follow the procedures outlined in the memo. Do not leave until they do what they have to do according to the memo. They have to provide you a receipt that they followed the procedures.
4. Get your EAD within a week or so after infopass.

Does visa means stamped in the passport or even the approval notice?

Does any one know how many visa# have been used for 2009 quota?.
Sept dates may advance and some lucky ones are sure to benefit --but for their attempt to use the remainder of visa #s in fiscal year09. Now since most cases are pre-adjudicated hopefully they won't pick up randomly

Good to hear that 01, 02 & 03 ppl r getting approved. Atleast they are following FIFO and the line is getting shorter. Not that I am not happy abut the 06 folks who got GC but it should realistic 'First In First Out'.
The only problem with this is as follows. You are either FIFO all the way or you are not. When you are FIFO by convenience, then the result is multi year old 485s, and volatile PD movements that make the stock market gyrations seem minuscule, which is clearly not the intent of the system. Where was FIFO this summer when they were shooting random approvals from the hip? How can you say FIFO for come and luck of the draw for others?
I am especially glad to see the older cases getting their due, but they have most certainly screwed some ie those with 2004/5 PDs, especially those at the NSC by their policy this summer.

USCIS people are too loaded with work to start rejecting applications for such trivial matters.
The instructions say this "NOTE: Please spell out U.S. Department of Homeland Security; do not use the initials "USDHS" or "DHS.""
You have written the most important words, atleast u did not abbreviate!
Also remember there is NO OTHER "department of homeland security" in the world. Check has gone to USCIS office. They know u mean US, even if u did not write it.
So I am confident that their banks will cash your check. Keep a watch on your bank online. Texas cashed our checks in 7 days and also sent receipt. Dont know how Nebraska is doing. Call USCIS in 1-2 weeks if they did not cash checks.
Worst case they will send the application back. You can then quickly fix the check and resend application. Hopefully if you have applied in time, then a delay of 1-2 weeks does not matter.

Hi,
I have 3 yrs degree + 1 yr PG diploma. I have been working in industry for past 17 years, and don't think any degree or even doctorate would add much to my qualification for the job that I am doing.
I am currently filed in EB3 category, and new company I am changing job to are ready to refile my GC. But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.
My son will be in the highschool in 4 years, and I don't want to spend a lot of money on getting MS to myself. But for the GC I am looking for fastest and cheapest way to get MS program. I have no idea how it works, what qualifies me for a degree, what can I get credits for. Any inputs would be appreciated.

Seems like your end goal is to get GC, have you considered option of waiting for your son to become 18 so that he can sponsor you for GC? That might be an even faster option than EB2, considering the current backlog.

Till 2007 that was how it was being interpretted and then suddenly DOS realised it should be by category and not by country of chargebility.
The earlier Eb1 ROW>Eb2 ROW>Eb3 ROW spillover is called vertical spillover
The current since 2008 spillover Eb1>Eb2>Eb3 regardless of country is called horizontal spillover.
However see in Horizontal spill over Eb2 India backlog takes of the numbers (14k in 2008)
In vertical spill over Eb3 India backlog takes the numbers(17k in 2007)
So either method wont help Eb3 ROW. Its a double whammy.

Not sure if this helps, but this kind of thing happened to me 8 years back when my wife was pregnant. I asked my employer about insurance; he said I can continue coverage if I keep paying my premiums. Even if you have to pay a bit more than actual premium it should be better than not having at all. The other option is COBRA as some one already mentioned.
If that does not work out, call your current insurance company and ask them what are your options in the event you lose your job. You don't have to tell them that you're going to be laid off yet. As the wise say, we don't have to tell everything to the other person until it is really required to disclose. You might end up finding some facts that you probably are not aware of.

The main problem is that no one really knows for sure whether these steps are taken in sequence. There is little to no transparency. There are procedures, but we can not guarantee that they are followed.
To answer your second part. No, I don't believe there are any standard updates that indicate this, but I could be wrong. I think that there is an update if you clear it, but not if you are stuck in it. Make sense?
