You are correct. The rules must have changed recently. I wonder what made them make that change, Now children of US citizens (who were once Indian citizens) have an advantage over children who has both parents as Indian citizens. Weird.. isn't it?

I am confident that Obama will come with some kind of immigration bill like he did with health care. Though the bill will not be comprehensive, it will include some benefits to EB reform. The reason obama will pursue this is to secure his political future and win second term.

These IV core people took it up and organized a real grassroot effort when no other h1b or former h1bs were able to or willing to get organized and fight together to alleviate our pain.
The other day, reading posts/comments on WashingtonPosts by some former h1b holder against our cause really aggravated me.
If you don't agree with IV approach, that's fine and just add your dissenting voice into this organization, and continue and add to a healthy discussion. Now that this legislation pass or fail is so imminent, can't we just focus on one thing at a time? Being a detractor is not of much help with the senate and hostile house considering major reform bill(s) within the month. Thank you all for all your suggestions and support. Past 3 days was very stressed and exhausted. Your suggestions and support made me relieved and courageous. Yesterday I slept peacefully without any tensions. IV is a great forum which is helping immigrants in difficult times by providing support and useful information. I am very thankful to you all. I will keep posting the updates; I will definitely fight and overcome this situation. Now, my first priority is my baby and health.
After seeing the support in IV, it proves that still there are so many good people out there to help people in difficult times. I won't forget this in my life.

So they refused to acknowledge that it is pending more than 90 days?
They are technically right, the regulations say "within 90 days from the date of receipt of the application".
Talk about broken promises. Write to the USCIS ombudsman.
Emails to USCIS ombudsman just generate a standard response, nothing more, asking to submit form 7001. They should be swamped with 7001s by now, so they should create a processing-times for the form7001s.

My interview is scheduled on 22nd Aug but not received letter yet.
email the consulate. I heard that they are very prompt in replying.

One interesting point that came out of that recent hearing.
PD movement results in both 485 approvals + new 485 filings. CIS blames backlogs partly due to the policy that allows 485 filing whenever PDs are current. if PD movement results in 5 approvals, it also results in 10 new 485 filings and thus a backlog is built over which they have no control.
So in their opinion, PD movement should only control approvals & 485 filings should be controlled separately. If this happens, there would no backlogs and no one will ask them any questions or drag them to court for hearings!

I believe any efforts to make USICIS accept all applications can be couter productive. You can have some people getting stuck for sure for many years before they get their green cards. also since new fees kick in on July 30th, you will have to pay for the EAD,AP.
The law-suit can benefit only a few of us, so why is IV behind this.
Can the core members comment on this.
I tihnk all these efforts do not define a common cause right now.

I haven't applied for green card yet. Is IV only for GC purposes or it addresses other issues too which makes life of H1b holder hell?
Not sure why you would generalize all H1b holders as experiencing hell - I for one did not. Anyways if you take the time to browse the forums you will find the answer to your question.

I am glad that some EB2 guys can empathise with us....EB3(I) is completely hopeless....but I doubt if IV will take this up...even a small admin fix like applying the spillover to EB3 this year...that will take away some stress on the EB3(I) pipeline....

With all due respect, the probelem I have with volunteers is that I don't think amtures can pull a job this big, you've got to have profesionals, somethng like a compain maneger.
I admire the courage of your guys, and think the goal is fantastic. But the way it goes, I don't see how it can be achieved.
I've learned a great deal about immigration from the forum here. I very much appreciate it. I try to give back by answering questions others may have. I think IV has been doing a great job serving as that capacity.
But you guys want do something bigger. Well, you have faith in it, I don't, at least not now, neither many others. Maybe that is why you are still asking for money and volunteers.

i am a silent reader of this forum. you have to agree that iv has given the opportunity to file i-485's...forget about how many has not filed or missed the window but they provided the opportunity...and if you don't want to contribute then simply don't do....stop underestimating them....they do something about it instead of allowing changes to happen by themselves...they try to make changes in every possible aspect...so please don't contribute if you don't want to and stop badmouthing them.

Zen, the point is very simple. If you believe in this organization and what it does then you will donate knowing that IV needs the money to lobby for you, me and everyone else who is part of the community.
Lobbying is a very sensitive issue and it is not always possible for the persons involved to give you daily updates. Rather disclosing too much before time can have the opposite effect with people interested in lobbying against our interest mobilizing more aggressively.
Also bills are introduced all the time and there is not always enough time to hold funding drives to lobby for and against those bills. Moreover lobbying with the congress and senate is an on going effort and will require resources anyways.
However if you feel you want to be in the thick of things and know everything that is going on, then I guess joining your state chapter and being an active member can help you get some additional info. I believe volunteering your time is a lot more useful for the community than only money and if you can do that, all the power to you. I for one try and make my contributions to help those guys who are taking the pains to do all the work which benefits all of us

On one side kids at a age they should be enjoying... work hard at something and excel at it,whatever it be.
On the other side so called highly educated (?) people ...supposedly people who should excel at something find faults with these kids saying they aren't good at all facts of life.
Are any one of us good in everything ? or for that matter is anyone in this world good ?
Learn to appreciate achievement, for they have achieved far more than most of us did.
To all those people who keep saying this is rote learning of words, do you know how many words there are ? and if it is humanely possible to remember the spelling of each of the words ? There is much more logic involved as words of a specific origin (greek,Italian etc) have a specific characteristic and trend it is all about picking out the trend...keeping your cool and spelling it out taking into account all the smaller variances.
Before any of you go off on how kids work too hard, take a survey of the most successful people in the world most them spent their childhood working extremely hard towards a goal.
These are kids they can grow up and learn and become more rounded, hopefully that can apply to some posters here.

I have EAD approved and 485 pending over 180 days. But 140 is still in process. My company decided to lay me off. What options do I have ?
1. The company is not mean to revoke my 140 unless it is required by law to revoke 140 for all lay offs, Please advise.
2. What options do i have now to retain my GC process

You have a little tricky situation at hand, but you'll be okay if what you wrote is true - Your employer will not revoke your pending I-140. Not only that, they have to be nice enough to respond to any RFEs that come for your case. they can state that the imimgration application they filed for you is for a future position.
Also, USCIS has a guideline about these cases. They are supposed to see if your I-140 was 'approvable' if it had been adjudicated within 180 days or before you leave the company, which I think it should be.
I understand there are some anxious days ahead for you, but If I had to bet, I would bet on successful result of your case in the end :).
Just make sure that your old employer doesn't revoke your I-140

They are talking about Both H1b and Green card. Corporations are pushing for increase in H1b also. But this time they are giving some importance to green card also. That is a good development. Already Skil bill by Cornyn is there. May be in next few weeks it may come for voting with or without attachment. But approximately 4 to 5 votes will decide the fate of the bill as usual in the Senate. And also as usual anti immigrants may push Durbin Grassley bill. We will wait and see.

I have a question regarding an appeal I did a year ago for a rejected LC.
I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. I dont think that its a good idea to ignore someone who is raising some opposing voice. This is a forum where anyone can raise his or her concerns. I dont think that anyone over here has some hidden agendas or is playing against the main idea of making immigration easier.
