I am trying to say something about my financial success instead of lifestyle.
But I have a good lifestyle too. I socialize, have parties all the time, have 2 nice kids and a nice house and a nice family. What else you want in life.

What makes people think that USCIS has preadjudicated cases in the order of priority date. If they have preadjudicated cases from 2005,2006 and left the cases from 2003 -2004 then it is the same mess an d i can bet that knowing USCIS chance of this are very very high so even if your date gets current it is still luck whether you get GC ornot.

It will bring down the workload? Can you explain how? If anyone in the world is eligible to apply for the GC without sponsorship, the system will be flooded with applications, irrespective of whether they carry any merit or not. What makes you think that an organization that cannot process 140K applications per year can handle millions?
The point based system sounds great in theory, but cannot be implemented efficiently by the U.S. as long as it remains the most desired country for immigrants. It works for Canada, Australia and the U.K. because fewer people want to move there.

As long as you dont use your EAD, you can continue working on H1B.
In fact, if it is the same employer as your GC sponsor, you dont have to do anything.
The thing to remember is to extend your H1B if you do a H1B transfer so you dont have any issues at the time of transfer.
All this is assuming that your company policy can handle exceptions to the policy :)

Why is llc less risk? i know that the legal paper trail requirements are lower... but i dont know of any other major benefit than ability to share profit and loss disproportionate to ownership stake... which could be a double edged sword too... what risk is covered in llc that is not covered in corp?
in fact i chose corp because it was cheaper.... thats it.
the low risk lies in the fact that any adverse decision you may have to take ever (God forbid) like bankruptcy does not affect your own personal credit history and assets. I am not sure whether the same exists for corp or not. So I may be wrong regarding the low risk factor of LLC. But I always had the notion of starting any venture as an LLC and then moving on to a corp.

not to be pessimistic, nov 3 is really close and I am thinking it may not happen. Here is what i have done and am planning to do..my recd date is july 30th and my travel agent is nov 21st.
1) already expedited the cases by phone.
2) just faxed the letter to local congressman.
3) have an infopass appt for the end of the month.
4) have a letter ready for the ombudsman, will send it right away after the infopass appt.
Doing all this, i am still not sure if I can make it to this trip or lose $1800 by cancelling my tickets.

But let's face reality for a moment - as several senior members routinely point out, inspite of our organization having several thousand "highly paid" members, the "donor" base is very limited. As Zen says in a truly Zen manner "we are where we are"...and we have to figure out where to go from here. Unquestionably, I am really thankful to our highly dedicated Core team for sacrificing their personal time and making all of the efforts that have led to substantial progress over the last few years for the immigration community. However,, that with a new government in place, we now have a truly unique window of opportunity to make some progress and the question before us is how do we maximize our potential to take advantage of this? The real beauty of my proposal is that we could leverage the enormous dedication of the core team and multiply it several fold, if we could build a strong donor base that provides us the funding required to engage effective lobbyists. Needless to say the more the funding, the stronger can be our lobbying.
but I also understand that most of these lobbying efforts are done in the back ground and its not good idea to share anything in these times. who knows, may be there is an anti-immigrant lurking around (ofcourse paying $$ to become Donor, become senior member whatever) to get inside information.

It is definitely not a good idea to broadcast confidential information on strategies/plans. However, what you are referring to is the merchanics of the process of sharing updates- there are several ways in which we could implement the update process so that information is only shared to a predefined "pool" and that "donors" are first vetted before being brought into the "pool", so to speak. The way IV has currently implemented this process, of course, is through the local chapters. However, their current process is subject to lack of consistency (depending very heavily on the availability of the local chapter coordinators) and more importantly, does not take advantage of the tool that really enables us to all come together i.e. the internet. It is a paradox that an organization founded on the net and is still subjecting itself to the constraints of "physical communication" via the local chapters. I thought they were taking a step in right direction with the creation of the "Donor Forum", however, for some reason, we still seem stuck in the previous mode of operation. We can find a middle ground here that would not compromise confidentiality or our goals - one alternative (certainly not the only one I am sure) is quite simply, email updates compiled by one person (for consistency and uniform direction) that go out a distribution group, where the "donors" on the distribution list, have been vetted by the local chapter coordinators. I know this takes work, but if the Core is looking for a person to pull together a Conference Call to compile this update and send it out, I would be glad to volunteer my services.
Still I've some open issues. If you look at the poll, there isnt a single person who voted NO. We should expect to see a healthy mix of Yes,No and Dont Care. But the way the poll has been put and partly the wording, partly the current IV environment, people are sceptical of putting their real thoughts publicly. This excercise is futile if you have minimal 'NO's --- hope you are getting my point here. The only thing you might end up with is x number of YES and hope to translate the YES into more dollar value for IV and there will be some YES who are already contributing monetarily.
You are correct dilbert_cal - not a single person has explicity voted "No". In reality though, everyone who has viewed this thread (1563 views when I last checked - even if you assume each person has checked this thread at least 10 times, that's about 156 individuals out of whom only about 35 have voted so far!) and not bothered to vote is essentially voting "No"! However, again as you point out, I am not really looking for the "No"s since these people have clearly decided they don't want to part with their money at this stage (not ascribing any reasons or motives here - just stating the facts). Instead, my focus is on coalescing a group around those who voted "Yes" since they, like me, agree that they would contribute more if they received more regular updates of what is going on. Our organization just needs a little more "organization" (pun, intended :p) to make it more effective! Again, just reality but that is also the usual natural evolution of most organizations that start out as pure grassroots organizations.
I really do believe there are substantial number of folks out there who can be engaged more effectively in this process and I invite the Core Leadership team to put more thought in figuring out how to achieve this - I hope you take my suggestion constructively!

Thanks Almond... your post summarizes exactly how ppl in my position feel. one of my frds did MBA from top 20 B-school but could not change to a new job in management career becoz his I-140 approved but did not file for I-485 yet and worse yet he crossed 6 year H1b. now he is also living on 3 year h-1b extensions with approved I-140. when he was venting his frustration like me, one a$$hole (GC holder) suggested he move back to his home country. funny thing was this a$$hole got her GC becoz she married some bakra who already applied for GC. within 6 months after she arrived in US, her huby got them GCs. This dumb wothless piece of $hit doesnt know how hard (impossible ?) to get GC in this lifetime becoz she got it in 6 months :mad: .
Yeah, and that's another thing. There are a lot of insensitive people out there who don't really know the meaning of sympathy and who think out of their butts. That is why when you feel like venting out you need to really select people that are more compassionate. No one expects a pity party, but at the same time no one should trivialize something as serious as this or give "advice" that is idiotic and that even they, had they been in this situation, would not do. I feel terrible for your friend because he has such education and is stuck like this. It feels like you're wasting the best years of your life just waiting. There is nothing that I or anyone can tell you or your friend to make you feel better but please listen to me and learn from my mistake, and tell your friend, too: DON'T WASTE THIS TIME. If you need to volunteer somewhere to use skills that you have that you are not allowed to use on your present job, DO IT. Or if you can take classes to learn new skills, DO IT. Find a way to be more than what you are now so that when this is over you are not just "floridasun, man stuck in the same job for 10 years" When you finally get out of this hell hole and someone looks at your resume and says, what, you did this for how long!? 1. If your labor was filed in Nov 06 or earlier then you can file for 7th year extension (based on rule that labor pending for more than 365 days)
2. I'm not 100% sure but i think when your labor is approved if PDs are current, you can file i-140, 485, EAD together and get EAD by before your visa expires and you would be fine.
3. Labor substitution will not be allowed after July 17th, and there are a lot approved labors whose beneficiaries have left the company. Employers are willing to use these labors for whatever they get (excuse me!). Thank you very much for all the response. I waited for responses from different places so I could determnine if it is a Nationwide policy as what the Colorado was saying.
I am from Colorado and I think Colorado is one of the strickest states in the US whatever.
It looks like from responses that only Colorado has so far adhered to this new policy.
I have 4 friends who currently cannot drive because their licenses have expired and they are waiting for MVI's (Motor Vehicle Investigative Unit) letter. Until such letter is issued, you cannot renew your license (in Colorado). According to MVI Here, it will take to 5-7 days, but if there is a problem, it will take up to 9 weeks.
Really rediculous procedure and I agree with everyone.
Just in case anyone there is in the same predicament, please share your story and the resolution.

Finding out I made a long term decision to persue career in US only to realise that I was used as a cheap labor and when I INVESTED substantial time here, I got to know that employer is using creative ways to keep cost down, hamper growth opportunities. Have you ever been cheated? Then you will know what it feels like. Going back home is always an option but a boneheaded one. Eventually that might happen too!

My EAD-renewal is also delayed and had an Infopass appointment in local USCIS office today. During the meeting, I specifically asked, in the event if EAD renewal is not approved before the expiration of current one, can I still continue to work? The answer was - "You can continue to work as long as your employer agrees to it". hmmm. Then I asked, would it jeopardise my status or 485 process in any shape or form. The answer was - "No (it will not effect my status)". Although, he did mentioned that interim EAD is not allowed anymore. He even said that, they actually took the machine and equipments required to produce EAD card for local office.

As visa bulletin is taking time, it suggests that somebody is putting some efforts in determining new cutoff dates. And they need to use up leftover visas. Hope to get a movement all across.
