    People need to understand. (Offcourse its frustrating to wait for..but no one forced us to stay here..or come here)

    What about the false promises and carrots and propaganda of liberty, equal opportunity and land of opportunities? Of course they wont say its land of indentured servitude. Its our fault that we didn't figure this out, isn't it?

    I cant tell you how much i was moved by the momentum that got generated during the 'black' weekend before christmas. One can tell the excitement and enthusiasm among the sufferers in this community. I wholly appreciate the efforts taken in setting up this site and following up on the issues. We need to generate the same kind of membership as we saw during that weekend.

    One question i have and many others like me would be interested in knowing is a clear description on how the money collected will be spent. I understand by reading your posts that it will be totally transparent and will be detailed out every week. But its more important for people to know before hand on how and why money is needed, before they can open up their purses generously. Also please take this question in a positive attitude as more people would know the actual reasons.

    It DOES matter what your PD is. USCIS apparently does process FIFO according to your Receipt date - BUT ONLY IF YOUR PRIORITY DATE IS CURRENT will you get a visa number assigned (i.e. approval of said greencard).



    Thanks! That's helpful... from what you say, sounds like PD is still quite important. RD comes into the picture only after the PD becomes current. However, if a range of PD's are current, then they would sort those by RD and not by PD.

    For eg, if they move the dates forward by a year, and Jan 04 and Jan 05 are both now current, a person with PD of Jan 05 but an earlier RD would still get processed prior to an application with PD Jan 04 and a later RD (according to the FIFO principle)...

    Senate Leaders Expect Immigration Bill Next Week

    WASHINGTON, May 11 � Senate leaders said today that they had broken a political stalemate and would bring to the floor next week an immigration bill that could put millions of illegals on the road to eventual American citizenship.

    An agreement reached today by Senators Bill Frist of Tennessee and Harry Reid of Nevada, the Republican majority and Democratic minority leaders, ends an impasse that has stalled action in the Senate for weeks while immigrants and their advocates have been holding huge demonstrations across the country.

    The deal does not mean that a bill will emerge from Congress soon. But it is significant that the Senate leaders agree to move forward, because the chamber operates under peculiar rules and traditions that can bury legislation indefinitely. Mr. Frist and Mr. Reid said they hope to schedule a vote before Memorial Day.

    Even if the Senate passes an immigration bill, it would have to be reconciled with a bill enacted in December by the House. That bill generally emphasizes border security rather than attainment of citizenship, so negotiations between Senate and House would probably be long and heated.

    "What the Democratic leader and I have laid out is a way to get on to this bill, and as you can tell, both of us are working in very good faith on the various issues that have been raised on the floor," Mr. Frist said.

    "I welcome the return of the immigration bill to the Senate floor," Mr. Reid said. "America's immigration system is broken, and our national security depends on Republicans and Democrats finding common ground to fix it. The assurances I have received from Senator Frist make me hopeful we can finally move forward on real comprehensive reform."

    The leaders' comments indicated that they had resolved the issue that had kept them apart: how many amendments to consider, and how much time to devote to them.

    "I didn't get everything that I wanted," said Mr. Reid, who blocked votes on amendments weeks ago, saying they were intended to gut the legislation. "I think the majority leader didn't get everything he wanted."

    Mr. Frist said there would be "a considerable number of amendments debated and voted on each day," and that they would be handled "in an efficient way."

    Until partisan bickering sidetracked legislation in the Senate in early April, the chamber was working on a package that offered opportunities for eventual citizenship, a guest worker program for some immigrants and measures to enhance border security. The tougher House ill focuses on border security and would crack down on illegal immigrants and those who employ them.

    Mr. Frist said 14 Republicans and 12 Democrats will negotiate with House members once the Senate passes an immigration bill. Seven of the Republicans and five of the Democrats will come from the Judiciary Committee, with the remaining negotiators to be picked by Mr. Frist and Mr. Reid.

    President Bush has said he favors legislation that would enable immigrants to become citizens, but only after they meet strict standards. He has said repeatedly that he does not favor "amnesty," a word that is anathema to many conservatives. "We congratulate the Senate on reaching agreement, and we look forward to passage of a bill prior to Memorial Day," Dana Perino, deputy White House press secretary, told The Associated Press.

    Senator Edward M. Kennedy, Democrat of Massachusetts, called the agreement announced today "a major step forward in our fight for tough but fair immigration reform."

    "Business and labor, Democrats and Republicans, religious leaders and the American people strongly support our plan to strengthen our borders, provide a path to earned citizenship for those undocumented workers who are here and put in place a realistic guest worker program for the future," Mr. Kennedy said.

    But quick passage is by no means assured, given the complexity of the immigration debate, the emotion it stirs and the approaching elections. Representative John A. Boehner of Ohio, leader of the House Republican majority, said in late April that he opposed the emerging Senate legislation and its emphasis on citizenship attainment. "I don't think that would be supported by the American people," he said.

    But the accord announced by Mr. Frist and Mr. Reid apparently means that immigration legislation will not sink out of sight in "the procedural quagmire that the Senate is," as Mr. Reid put it recently.

    Very sorry to hear this and our prayers are with you...hopefully all this will be settled soon and to your satisfaction.
    First thing - try not to stress out about this. Really, your baby's health and your own are far more important than some stupid GC. Keep in mind that the less you stress yourself, the more likely the child birth will go peacefully and well.
    Secondly, hire a good lawyer - it is well worth the expense and helps relieve your stress.
    Thirdly, if possible, let someone else (such as your husband) drive the "discrimination" lawsuit if you think it is fit...helps give you some line of defense against the problem.
    Regarding insurance, the employer must offer you COBRA. Also, not all insurance companies consider (or are allowed to consider) pregnancy as a pre-existing condition.

    Keep the good focus in mind - let not this affect your baby. And at the same time, don't leave any option unexplored. There're plenty of suggestions in this thread. Ask your lawyer which ones you must explore...

    Hi Gurus,
    I am confused about the status of my application. I had concurrent I140/485 filing under EB3 on July 30th at TSC(with PD of Dec 2004).
    On May 9th I got a CRIS notification that my I 485 case has been transferred to Lincoln, NE -I am assuming it is the Nebraska office.
    However, I am more interested in tracking the I 140 status.

    1. My RD for I 140 is July 30, 2007 and ND is Sep 26, 2007. Online status still shows being processed at TSC..so which tracking dates shld I follow..is it the RD or the ND?

    2. Even though it is concurrent filing, I am assuming the I 140 case is treated independently and is not tied to the I 485. (PD is very far EB3 Dec 2004, but I 140 still shows at TSC)

    Due to some personal reasons, it is important to know if my I 140 will be approved before July 2008..given the info above..when do you guys think it may be approved??

    You can be paid hourly or weekly or monthly or by weekly, does not matter as long as your job is fulltime and in same or similar occupation. Hourly pay is a more convinient tool for employers to keep you as contigent worker at times it works both ways because you can get paid more if you work more hours (depends on the state I guess).
    You may verify the same with lawyers and gurus.

    Kindly read text below. Based on whatever is said here, an element of risk still exists if your ex-employer decides to harass you. As someone had pointed out in one of the threads, what is supported here is long term indentured labour keeping people like like us perpetually under the mercy of the greedy employers.     AC21 and I-140 Revocation : INS Inconsistent on I-485s

    The law and applications of the law are ever-changing. What seems to be firm ground one day turns to quicksand the next. And so it goes with AC21 and the impact of I-140 revocation.

    For more than a year, top-level INS officials have stated in AILA meetings that an I-485 that has been pending for 180 days or more can gain approval under AC21, even if the employer revokes the I-140. That is, once the I-485 has been pending for 180 days, the employer's revocation of an I-140 is ineffective as far as causing a denial of the I-485 in the context of AC21. The INS elaborated on this to clarify that the date of revocation of the I-140 is the date the INS acts upon the revocation request, not the date the request is made. Therefore, an individual could benefit by the INS' delays in processing routine mail. Our June 28, 2002 MurthyBulletin article, I-485 Approval after I-140 Revocation, available on MurthyDotCom, covers a victory involving this precise issue. Unfortunately, the INS guidance has never been submitted in writing. This is currently causing problems in several cases that have come to our attention.

    We have recently become aware of cases in which the INS has denied I-485s due to the revocation of the I-140 petition, even though the I-140 revocation occurred after the 180-day point. Motions to Reopen and Reconsider were filed asking that the cases be approved based upon the INS' stated policy. Both the California and Nebraska Service Centers issued denials of the Motions, essentially citing that there is no written policy. Accordingly, without a written policy, the INS cannot deviate from the general legal requirement that an I-485 application needs to be supported by an approved, un-revoked I-140 petition. We cannot be certain whether this is a change in policy or an issue requiring the training of examiners unaware of the policy.

    The Law Office of Sheela Murthy recently contacted the INS Headquarters in Washington, D.C. to rectify this situation and urge that the INS follow their own guidance. INS policy personnel have reiterated that the I-485 application should not be denied if it has been pending for over 180 days based on a previously approved I-140 petition. INS Headquarters has informed our Office that they will contact the particular INS service centers to have them reconsider their earlier decisions, based on Headquarters' policy. However, INS has not yet addressed what happens to post-July 31, 2002, concurrently-filed cases in which the I-140 was never approved but the I-485 remains pending for over 180 days.

    If AC21 is to have any meaning, the sponsoring employer must not retain control over the foreign national after the 180-day point. An individual's ability to obtain approval of an I-485 based on a job offer from a new employer should not rest upon the former employer's whim to revoke the I-140 petition or not. Fortunately, the majority of employers do not tend to revoke the I-140 petition. However, we have seen employers inadvertently revoke I-140s when the intent was to revoke the H1B petition, as is required under certain regulations. We have seen some employers attempt to retaliate against an ex-employee by revoking the I-140 petition after the 180-day point. We have seen employers revoke I-140s who simply do not want any extra papers bearing their names at INS. Employers hoping to hire more foreign nationals in the future may want to revoke the I-140 in order to use the labor certification and substitute another foreign national as the beneficiary. There are many reasons an employer may revoke an I-140. However, none of them is related to the spirit and intent of AC21 in allowing the beneficiary the freedom to move to another position and gain approval once the adjudication of the case has taken half a year or longer.

    I already sent a AC21 letter to USCIS through my Attorney - I am not sure if my file got updated.
    My desi employer wants to withdraw the 140 petition now. He says, he cannot keep 140 petitions of employees who leave the organization and not on w2 and he will have "ability to pay issue"
    I have heard horror stories of USCIS issuing denials and NOID because AC21 letter never reached the file even though it was sent in time and I guess this is exactly what my desi employer thinks - teach lesson by withdrawing 140.
    I spoke to my Attorney and she says "your file may not be updated but we will keep a record that we sent" useful in case we want to respond to NOID or RFE.
    Folks - please post your AC21 success/horror stories when previous employer withdrew the 140 petition.
    What are my options to avoid a NOID or denial

    You will not have any problems since you already submitted AC21 documents (keep certified mail receipt with you).....so whatever your attorney said, it is correct....you don't need to worry.....even your employer withdraws your I-140 it won't be having any problem.....it happened in my case....I have sent AC21 docs....after that employer withdraws I-140.....but nothing happened to I-140

    "Ability to pay issue" is right in employer's view.....he can able show the ability for one more application if he withdraws your application.....

    How did you find your file was not updated AC21 docs..... better way is go to local USCIS and asked your attorney name whether it is the changed one or previous one if you have changed them.....call I800 and asked them few details like attorney name and company name etc..... see some times they won't reveal any info....you have to find out the way to get right answer (like tell them old attorney's name and say didn't get any updated information about your case etc)....

    In EAD form, they are asking about previous EAD info..like which service center, what date, GRANTED or REJECTEd etc.. Now I had two EADs..one is OPT and other one I got last year. Do I have to write info for both one or just for last year?? In last year's form, I wrote info about my OPT. But what now?

    Hi,

    I have applied in EB2 category with job title of Sr. software engineer. and I have frnds who have applied for EB2 under, Programmer analyst, team lead.

    But all of them had Master of science from USA.

    And all of us have our I140 cleared and waiting to apply for I485 when its gets current.

    Reno, could you please give us more information about your and your friends' experience :

    - What your qualifications are.

    What the Sr. software engineer job requirements were. Things like:
    - Education
    - Experience

    and also more info about your experience with PERM:
    - Processing center. Chicago or Atlanta?
    - Processing time.
    - Any audits?
    - Any business necessity documentation requirements?

    I know I'm asking for a lot of info but I think it would be extremely helpful for many folks who are preparing to file under EB2 to avoid regression.

    Should watch AILA's stand on this. One group who would benefit immensely with this system would be immi lawyers, at least for first 10 years after which it would be more established. A perfectly intelligent delaying technique moving the issue away from its solution at least by 2 full years. This idea appears to be so full of holes, it seems as though coming from WH itself. Soemtime Logiclife nicely argued against such a suggestion, it would help to dig out those comments and post them here...
