my labor has to be pending 365 days or have an 140 approved to extend. so if pp goes away for 140 then my only option to stay in status is EAD. Also I am not in IT so patni,tcs etc...is out of question.
If you had a approved 140, you'd get 3-year extensions. If it is pending, you could still get 1 year extension.
While I'm sure about this rule, you should check with the attorney.

Research has shown over and over again that "talent, mental capacity, innovation and learning abilities are distributed evenly among different races and ethnic people..."
So there is no dearth of talent in south asia or any part of the world when compared to US or west. It's just that there is a difference in harnessing that talent...
Look at this way...You might like indian classical, but you might not appreciate western opera...That does not mean that western opera is not upto standards, or vice versa...AR Rahman's music is exceptional...no doubt about that...Because of the way movie makers want in India, it is geared towards indian market...It would be suicidal for indian movie makers if they ignore that...
Moreover, until recently, there was no separation between movies and music...Music is pretty much wedded to movies and vice versa...Whereas in the west, music is a separate entity and an industry of it's own...If you have a separate entity like that, it is easier to put your skills in a variety of ways and therefore easier to showcase your talent and easier for others to spot the talent...
Also, in India, movie industry is more paternal of nature...Barring few exceptions, irrespective of talent, some actor/musician, etc. get the roles because his/her family is tied to the industry...(Although it's slowly changing now)...Because of this, you might not get the best talent even though it's out there. Ofcourse, in the west also, you might see the same here and there, but IMO, it's more prevalent in indian cinema...
Lastly, spotting talent greatly depends on the director. In India, we hardly have exceptional directors...Also, I suspect the directors in India are given as much freehand as we hear in the west. If I remember correctly, it was said that it was an accident that AR got the chance in the movies by accident...I think ramgopal (/or maniratnam) (when he was yet to make name for himself) wanted ilayraja to score his movie way back, and was told that he was busy...Stung by it, the director brought AR and from there, the rest was history...
But nonetheless, better late than never and AR achieved it in a big way by winning two in a night...

I think your plan may work out just fine. I would make a couple of suggestions:
1. If you are taking LOA from original employer, for practical purposes (for USCIS), you are not employed with that employer any more (they go by pay stubs). But if doing so helps to avoid revocation of 140, go ahead and do it that way.
2. Because you will actually get your pay check from new employer, you are employed by them (and you will work on EAD with them, make sure that this is mentioned on your I-9 form). No matter how much ignorant your employer is, they will have to have I-9 on file and it must have your EAD (not H1).
3. After doing this, you will be on I 485 pending status (no longer on H status), and so make sure you have current EAD and AP all the time.
4. If something goes wrong with your I 485 (very unlikely); you will have to leave the country and enter back on H visa and work for H visa sponsoring employer (probably your old employer).
5. It is perfectly fine to not file AC21. AC21 is needed only if you do not plan to join original sponsoring employer after GC approval. However, if you do want to file AC21, you do not need much documentation from your new employer. It just needs the simple letter stating your job position as a "physician" and brief job duties (briefer the better!) and salary (should be proportional or higher). If you do not file AC21, you may just keep that documentation on file with your attorney (which I would do to be on safe side). The implication of having this is as follows:
--If you have this documentation (even if not filed with USCIS), at the time of approval of your GC you will have the option of just staying with new employer or going back to original employer.
--If you do not have this, you will have to go back to original employer after GC approval with a "good faith intention of permanent job".

Guess What from NOV - 08 to July 09, the VB will have older Cut off dates and after July 09 DOS will open the flood gate and move the cutoff of to 2007 or even 2008.
USCIS will start approve the cases with later PD's and the leave the older PD's on the air.

I first immigrated to Canada, got my citizenship and then came here to the US and am languishing in this stupid GC queue for the past 7 years..
Inspite of all the freedom to go back to Canada, I would now, rather move back to India than any other place...
Forget the little hardships in India..what matters is that India's IT economy is booming...booming like probably no where else in the world!
Why not, go back there, repay the country that gave me all the skills in the first place, and at the same time participate in that booming economy?
I agree with the sentiment. But the reality is many immigrants who evaluate the canadian option would want the paperwork that you have. Don't indian citizens, like the Chinese, require a visa to visit EU countries, commonwealth countries such as Australia, Fiji, the carribeans, pretty much anywhere in the world? Especially the more entrepreneurial ones amongst us all would want easy access to western markets and eastern talent pools. Sure it's still manageable to foresake what you got here, but I really want easy travel documents and the freedom to choose where I live and work.
There's no need to discourage people who choose to want to stay in the western hemisphere for a little longer.

It is foolish to expect idiots like you to come out of the gutter because you just enjoy the smell of the gutter. And expecting folks like you to stand-up for yourself and do something about this is even more foolish.
One more thing, only desi consulting companies are not the problem. Companies who figure out a way to take advantage of its employees, will do so. All companies are in the business of making bigger bucks for its shareholders. If they can figure out a way to make more, they will, even at the cost of taking advantage of immigrants. Desi companies figured out the loop holes first. Some of the other companies followed, others are still learning. It can be argued that % of such elements in desi consulting are more because they were the first to figure out the loopholes. But desi companies are not the only group taking advantage of immigrants. They are all the same. And folks like yourself feed into the problem. So please stop blaming just the desi consulting companies, because all companies are the same. Some companies have not yet figured out the ways to take advantage of immigrant employees. But these comapnies are learning fast, because they want to be competitive, right?
The actual problem is, the Congress. Lawmakers are the problem. They know everything what is going on. They know that not just desi companies but even larger companies take advantage of the vulnerable part of the society - the immigrants. Inspite of having all the information, the lawmakers deliberately did not add necessary protections for immigrants. And, even if the system becomes more efficient, people who enjoy the gutter will continue to live in the gutter. No laws or protections can help folks like you. Every now and then, just come to forum like these and rant once in a while. That's what you will do. The fact is you do not need better treatment or benefits. You need better therapy to tell you that you can come out of the gutter.

I have money crunch in US. I have accumulated huge debt in my CC. In past I have sent some money to India, but now when I ask my parents to send it here, they tell it is not possible without losing 30%. This is what they heard from my bank. Any Idea on how to get money from India from my own account to which I have sent from here.
I am in the other way round,Last year i bought a house in india and i keep sending money to india as soon as i get my salary deposited everymonth. Lot of my friends are in the same boat,we send all our savings to india. I send not less than $3 k /month to india and can try to help you.
Let me know how much you are planning to get here ,so that i can think of it. We can work on a mutual benefit way, if you are interested.

While some members might have jumped too hard on the whole thing, Some stuff goes unanswered.
1) Why has not USINPAC endorsed IV all this while on their website? Does not USINPAC know any thing about IV?
2) While I understand the importance of fund raisers for politicians, why USINPAC has not involved US citizens of American origin to contribute to the cause? What about grass roots efforts?
3) I dont have the exact statistics, but I am positive that every one out of 2/3 Indians living in the US is plagued by this problem of GC. How come Orgs like USINPAC are not pushing this by all means?
Forget the media mishap and the outrage of some members, if USINPAC really considers Immigration of Highly skilled Indians, they should be doing some thing. I personally am neither defending the outrage of some members nor appreciating it, but most of the Indian American citizen community does not want to be in sync with the plight of Indians immigrating to US.There are various reasons. Most important one as I have seen, Many in the Indian American citizen / Indian Permanent Resident community run consulting companies and they would hate to see these guys slip away from their hands by getting GC's. Fcuk, its like the damn door closes right behind you. I am positive most of those shops will come down to earth if Indian citzens start getting their GC's. May be its time, the Indian American Citizens/ Indian PR's ask themselves, what they really want. I have been to some Indian regional association meetings and the big guys or folks from my generation ahead would love to see their kids get married to an Indian or would love to see their kids grow with the rich heritage, but damn it, they just want it to happen with out doing any thing.
Dear Nixtor, we should not question that why they do not have IV on their site and they do not cut us any checks. It is their site and they can architect it the way they can. Yes, the Indian Express misquoted Robinderi or may be it was a misrepresentation, we would never know but the good thing is that he has acknowledged the discrepancy. That is where it ends. Robinder has been a very highly regarded ananlyst and a commentator of indo-us relationship. We needs friends with him and not make enemies. It is a different thing that he is associated with USINPAC and we do not agree with their agenda, approach or the way they misrepresent themselves to be the representatives of Indo community in USA. We have about 2.5 million Indians in USA of which about more than half a million are stuck in this green card mess. Any organization that claims to be a representative of Indian community should have this Green Card reform as a very top priority in their agenda, but it was extremely disappointing for the people fighting for this cause when they approached some of these organizations who could provide just lip service and press releases from their chambers and project that they are on the top of the issue and working hard to get the work done. IV has filled this void for a true grass roots level organization with a huge membership base which is truely global,not just Indian and working in an extremely organzied fashion. I am sure that many of the the organizations envy the way we have built the membership base ( we are not a paid membership org) and have individuals roll up their sleeves, go to the fields across the country and work for this noble cause unlike others who are limited to doing press releases, photo opportunities and advertizing to promote them selves.
At the end, time will tell if Immigration Voice would be successful in the agenda it has enbarked on, but what ever the final result be, our efforts would be analyzed for years to come by the ethnic, minority and national groups as to how to unleash the power of the Internet to build and run a grass root level oranization. Can you imagine how it would have been if Internet were available at the time of Mahatma Gandhi? I am sure Robinder has been thinking and analyzing that and we would welcome his analysis.

1) Why has not USINPAC endorsed IV all this while on their website? Does not USINPAC know any thing about IV?
2) While I understand the importance of fund raisers for politicians, why USINPAC has not involved US citizens of American origin to contribute to the cause? What about grass roots efforts?
3) I dont have the exact statistics, but I am positive that every one out of 2/3 Indians living in the US is plagued by this problem of GC. How come Orgs like USINPAC are not pushing this by all means?
Forget the media mishap and the outrage of some members, if USINPAC really considers Immigration of Highly skilled Indians, they should be doing some thing. I personally am neither defending the outrage of some members nor appreciating it, but most of the Indian American citizen community does not want to be in sync with the plight of Indians immigrating to US.There are various reasons. Most important one as I have seen, Many in the Indian American citizen / Indian Permanent Resident community run consulting companies and they would hate to see these guys slip away from their hands by getting GC's. Fcuk, its like the damn door closes right behind you. I am positive most of those shops will come down to earth if Indian citzens start getting their GC's. May be its time, the Indian American Citizens/ Indian PR's ask themselves, what they really want. I have been to some Indian regional association meetings and the big guys or folks from my generation ahead would love to see their kids get married to an Indian or would love to see their kids grow with the rich heritage, but damn it, they just want it to happen with out doing any thing.
Dear Nixtor, we should not question that why they do not have IV on their site and they do not cut us any checks. It is their site and they can architect it the way they can. Yes, the Indian Express misquoted Robinderi or may be it was a misrepresentation, we would never know but the good thing is that he has acknowledged the discrepancy. That is where it ends. Robinder has been a very highly regarded ananlyst and a commentator of indo-us relationship. We needs friends with him and not make enemies. It is a different thing that he is associated with USINPAC and we do not agree with their agenda, approach or the way they misrepresent themselves to be the representatives of Indo community in USA. We have about 2.5 million Indians in USA of which about more than half a million are stuck in this green card mess. Any organization that claims to be a representative of Indian community should have this Green Card reform as a very top priority in their agenda, but it was extremely disappointing for the people fighting for this cause when they approached some of these organizations who could provide just lip service and press releases from their chambers and project that they are on the top of the issue and working hard to get the work done. IV has filled this void for a true grass roots level organization with a huge membership base which is truely global,not just Indian and working in an extremely organzied fashion. I am sure that many of the the organizations envy the way we have built the membership base ( we are not a paid membership org) and have individuals roll up their sleeves, go to the fields across the country and work for this noble cause unlike others who are limited to doing press releases, photo opportunities and advertizing to promote them selves.
At the end, time will tell if Immigration Voice would be successful in the agenda it has enbarked on, but what ever the final result be, our efforts would be analyzed for years to come by the ethnic, minority and national groups as to how to unleash the power of the Internet to build and run a grass root level oranization. Can you imagine how it would have been if Internet were available at the time of Mahatma Gandhi? I am sure Robinder has been thinking and analyzing that and we would welcome his analysis.
