I am glad that some EB2 guys can empathise with us....EB3(I) is completely hopeless....but I doubt if IV will take this up...even a small admin fix like applying the spillover to EB3 this year...that will take away some stress on the EB3(I) pipeline....

According to Ombudsman's report,
Pending cases = EB + Family + Refugee + Asylum + ... = Backlogged cases + Unripe cases = 1,275,795 (page 11) + 1,316,740 (Figure 1, page 14) = 2,592,535 (as of March 2007)
I am approximating 1M to be EB based, 1.5M to be family based and 92,535 to be asylum + refugee (which is a lot).

There is another part in the I-131 rules document that you havent read,
"If you are in the United States and seek advance parole:
A. You may apply if you have an adjustment- of- status application pending and you seek to travel abroad for emergent personal or bona fide business reasons; "
which sorta makes any personal visit an eligible for AP visit.

Project_A - Were you able to file eb2 and got approval after completing online MS ? Also how does uscis treat online MS compared to full time MS for eb2 approval ?
I also have 3 year degree+1 year PG+ 20 years progressive experience. how can i get approval under eb2 ? I heard that uscis is now stricly looking for 4 year degree for all eb2 approvals.
No, we do not have any suitable open positions to file under EB2. There is no difference between online /fulltime; in fact even fulltime students are allowed to take online lectures (for example if they are sick and could not attend). It is actually recorded live and posted to the university website. I have a 4 year BS degree so I can�t comment on 3 yr deg.

What we are talking here is to reduce the EB3I backlog atleast a little bit...may be a year or two behind EB2

This Tracker facility we have in IV is good. Kudos to the Admin team who implemented this thing.
These are my observations. I could be grossly mistaken. Pardon me if I am wrong.
There are approximately 26,000 people who have put in their priority dates and other such data in the tracker. When I compared similar cases, I got some 265 who were EB3 India with a priority date in 2002. That is approximately 1 %, give or take.
Here I have ignored EB3 India 2001 guys. But that number would be very less I believe.
1% of 400k is 4000 which is what USCIS issues GC for EB3 India in a year.
Does that mean I could get my GC this year.

Once we have more data that can help us represent a better % of the overall actual applications in USCIS data, the analysis will be much better. I filed for my I-485, EAD and AP on July 2nd at the Nebraska Service Center. I am EB2 with a PD of June, 04. I haven't received any receipt notices. Any one in the same boat/ who has been through this process would like to share their views? Also, given the current fiasco, by when should I expect finger printing notice and, realistically, the green card?

so TSC processing time actually retrogressed this month by 8 days if it is at June 21. For times of April, it shows that they are processing June 29, 2008.
what is going on man. when will they get to Aug 7. but then again, if EB3 is not avaialable then what si the point.
