    CIS director is saying that he has made arrangements to pass on the flowers set to CIS office to the US war-wounded soldiers.

    I think we should start a blood donation campaign to impress upon him that aspiring immigrants will not be found lacking in caring for the US army soldiers.

    Any thoughts?

    Just a hypothetical question, if AILF withdrew from a lawsuit, then waht?
    Dude, have faith. Think about the mass involved here, with a small contributin from everyone or even without there are many law firms which would be interested in filing lawsuits on our behalf.

    You're most welcome, a big thank you to the core team for having followed up and for doing what was necessary to turn this into reality. I have shared the article with some of my colleagues, and they all agree that the article hit the nail on the head in as many words in regards to the problems that we all undergo as GC and LC applicants, problems that the public at large does not know about and would not otherwise not have knowledge about were it not for IV. Lets keep up the team spirit, the momentum and steer IV to even greater heights! We can do it and we certainly will.

    I did call USINPAC too and left a earful on their voice mail.Looks like they are all busy at this time figuring out which is the next item/development around the world that they can take credit for.

    My friend who called USINPAC this AM tells me that that fraud Sachdev is right now in India. Wow wow.....

    I joined the forum last month and realized that I should NOT be one who wants a free ride. This is a great effort for all of us. We should support it by all means we can.
    Immediately signed for monthly contributions. Last weekend I heavily sent emails to media persons and contacted the senators too. Everyone and every dollar counts. I am spreading the name amongst all my friends and colleagues at work.
    Go IV !

    AirWaterandGC. I saw your enthusiasm and work on the media thread also, and I know you worked over the weekend sending emails. Here you are a new member and contributing in every way possible. I wish each member joining this forum was like you. I know IV attracts a lot of members because they can get quick answers to their particular situations and answers they do get, but most of them never stay back and strengthen IV. Then there are some, that believe in the cause but are involved in endless discussions about things that do not resolve or attempt to act on IV's goals and agenda. And a few like you, who get active, who understand what is important and what can help us achieve the result we are so much seeking.
    Thanks to each and every member like you, who make IV work.

    I agree, you will be competing with all the illegals. But.....

    1. How likely are they to file their apps on the first allowable day that USCIS will accept the applications? Not very. Most of us know what's going on and will be ready to send in our apps first. Ofcourse if some EB based guy is pottering around instead of moving fast, thats his problem.

    2. How many illegals can afford the high priced attorneys? Most of these poor guys dont know to speak, read or write english, forget about filing out USCIS forms.

    3. How many illegals maintain perfect records of their time and can recreate a paper trail of the time they spent in the US. I certainly can and most legal wannabe immigrants can definitely prove the time they have been here (paystubs, utility bills, credit card statements, bank statements, etc.)

    The point I am making is - this is the best option I have seen in a long time. Even the stupid point based system had its drawbacks. This is unconditional. It will get vast support from the hispanic community also. The UK has the same thing. Be on a work permit for 5 years and then you are eligible to apply for Permanent Residency. I believe there is also some clause in the UK system that states that you have to have been in the UK illegally for 10 years as against 5 years for a legal immigrant. I'm sure setting the illegal bar at 10 years and legal bar at 5 would be acceptable for most people.

    If we reapply under this section, we will be competing with the massive illegal-to-AOS guys based on our Receipt date for adjudication.

    I would again suggest to go for paid Forum for everyone. Treat desi's like desi's.
    Free means one gets all kinds of public answers hindering IV's efforts.

    I think the current model( Free access to all, except donor forum) is fine. If the whole IV site is paid one, many people like me would not give a thought to spend a min in this site. I came here as a guest, started reading the forum posts. Later realized some threads like 485-Filing and EB2-EB3 predictions require membership. Once I find the membership is free, I registered as a member. After couple of months, I realized what IV could do with my contributions and then I became a donor. So we need free access to bring new members to the forum and to show how they can help IV to help themselves.

    For all those who commented in negative.
    1. Its posted in Interesting topics section. GC, E2/E3 predictions,H1B extension etc is not the only thing left in life.
    2. Spelling is a logical/creative thing. Its not cramming words from dictionary. Its an art too. Ever heard of phonetics.

    Are you quite sure it is a logical creative thing ? There are a lot of words which are pronounced quite differently from the way they are spelled ... unless you know the word ( by cramming ) you would not be able to spell it.

    Your point 1 has nothing to do with this topic. Was it ever said that GC is the only thing in life by anyone ?

    Obviously this is hard work but to what end. How is knowing the spelling of every word in the planet going to help her or anyone for that matter.

    Better be a good writer who writes on interesting topics , stories or novels than to be the proof reader for the writer. Who do you think would have a good career - the writer or the proof reader.

    Learning how to spell would have taken thousands and thousands of hours . Wouldn't that time be better spent in learning maths or science or arts or a musical instrument or sports or anything that will help her in the future or be personally gratifying for life. I am not sure she will remember half the words 10 years from now just like a engineer doing java programming for 10-15 years would practically remember nothing he learned in college.

    I personally think that 6 month rule-of-thumb is nonsense.

    AC21 clearly states you can switch employers 6 months after your green card application has been pending. On what legal basis could USCIS then come back and deny citizenship to anyone for switching employers too soon after getting their green card?

    I'd really be interested to hear if someone has specific knowledge of a case where someone had their citizenship denied due to switching companies too soon after getting their green card.

    And you are defending a guy who has committed shop-lifting with this? You should have probably come out with more ammunition than this. Because of ppl like the OP and maybe you, we Indians are getting a really bad rep everywhere. I am sick and tired of defending our community, when ppl like you and the OP defend (or even condone, in the name of an immigration query) such acts with no compunction. Shame on the OP and for defending him, YOU!

    OP, please get lost from this forum and from this country. This country is not for criminals like you (there are enough already). I wish you had gotten a stricter sentence than what you got. And those of you that want to defend the OP or the folks that condone such acts, in the name of immigration, dont need to lecture me on taking this stance - just get lost, will ya!

    Did my post suggest in any way that I was defending the guy? I was only ridiculing those who were bad mouthing him.

    Are you suggesting that my post would have scored more points if I came out with more ammunition? I did not post in order to win your accolades. The fact that you felt there is not enough ammunition, suggests to me that you think it is perfectly fine to do all those filthy things I was referring to. This tells me about your moral standard.

    You had to assume that I probably have a criminal issue too, and thats why I was defending the original poster? Is that the best your mind can think of?

    You are sick and tired of defending our community? Do you imply that most people from our community have turned to criminal acts these days, and so you are tired? Because, I have not seen that around the people that I move around with. Is it all too common in your circles and the people you associate with?

    You most probably have half the education that I have, your salary is most likely half that of mine, and your moral standard is probably half that of mine. If I start ridiculing you more, you will suffer sleepless nights. So I won't do it (after this post, I mean).

    You don't post bullshit in a public forum, just because you can't see the people you are talking to, infront of you. Would you dare call the original poster 'thief' if he is standing infront of you? Would you call him that, if he is a friend of your roommate and your roommate brings him over to your house? The internet must be a new technology for you. Please learn how to use it to spread some love.

    To the poster above you:
    It is true that the law does not impose punishments on backstabbers, womanizers, sexual perverts, etc. Prostitution is legal in a lot of countries. The fact that the law permits some things, does not have any bearing on the moral severity or the lack thereof, of those things. Would you choose a 'prostitute' over a 'shop lifter' for a wife? If these are the only 2 options, I would be content with a shop lifter. Would you choose a 'prostitute' because there are no criminal issues involved and you will get your greencard faster?

    Even though not many people have posted in support of my post, my reputation has gone up, and yours probably went down. Please don't respond just because you want a revenge.

    I will always stand up for the one weak guy who is bullied by a 100 really nice & powerful ones. This can't be called defending the act of 'shop lifting' !!!

    is the answer :-0). Remember in life you have to have an attitude of respecting others, if u think you need to be treated specially cause you have lived in America 10yrs then u would be definitely disappointed. A lot of my friends have relocated to India and I am too early next year. The only answer is attitude.

    But there are cases where you expect to be treated like a human , and you are not. That is the most difficult thing for some who returned and regret doing so.

    And it is a bigger dream (than dream about getting GC) to expect people to leave en masse .

    Hi

    I have a question regarding an appeal I did a year ago for a rejected LC.

    I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. Thanks

    We all admit, that we haven't served our birth land as much as we have served America. Maybe there is calling here amongst all the turmoil with getting GCs.

    Our home country wants us back. I know we have huge issues back in India. Population, Politician :-) etc etc.

    I am very depressed! my lawyer who is doing my I-485 has advised that if she was to be concerned with her representing me, she would advise against me starting the company. basically, she said, USCIS can read this as an intent to leave the permanent employer for self employment. my business plan was to be in non-IT business. she said that if i am making enough money in the business, it will be hard to prove that i intend to continue in the job while having this business on the side...

    Although USCIS guidances are not binding, you might want to pay attention to the below (was not able to upload the attachment, you might want to google for it)

    Re: Interim guidance for processing I-140 employment-based immigrant petitions and I-485 and
    H-1B petitions affected by the American Competitiveness in the Twenty-First Century Act of
    2000 (AC21) (Public Law 106-313)


    Question 7. Should service centers or district offices request proof of �ability to pay� from
    successor employers in I-140 portability cases, in other words, from the new
    company/employer to which someone has ported?
    Answer: No. The relevant inquiry is whether the new position is in the same or similar occupational
    classification as the alien�s I-140 employment. It may be appropriate to confirm the legitimacy of a
    new employer and the job offer through an RFE to the adjustment applicant for relevant information
    about these issues. In an adjustment setting, public charge is also a relevant inquiry.


    Question 8. Can an alien port to self-employment under INA �204(j)?
    Answer: Yes, as long as the requirements are met. First, the key is whether the employment is in a
    "same or similar" occupational classification as the job for which the original I-140 petition was filed.
    Second, it may be appropriate to confirm that the new employer and the job offer are legitimate
    through an RFE to the adjustment applicant for relevant information about these issues. Third, as
    with any portability case, USCIS will focus on whether the I-140 petition represented the truly
    intended employment at the time of the filing of both the I-140 and the I-485. This means that, as
    of the time of the filing of the I-140 and at the time of filing the I-485 if not filed concurrently, the I-
    140 petitioner must have had the intent to employ the beneficiary, and the alien must have intended
    to undertake the employment, upon adjustment. Adjudicators should not presume absence of such
    intent and may take the I-140 and supporting documents themselves as prima facie evidence of such
    intent, but in appropriate cases additional evidence or investigation may be appropriate.
