Of course yes its for our interest BUT don't forget that its against a violation. Tomorrow if the same organization brings resources in H-1B/EAD/GC/Citizenship we are not going to complain about it ... because its within whats allowed by the law, I think thats the purpose of having rules ... to have a fair playing ground ... think abt the havoc/chaos these companies could create by bringing people without any visa (illegally across borders) and talk about 'closing the doors and me not brought up that way', do you think that anyone including you would support that???. Here the purpose of L-1B visa is misused and blindly violated, so lets move in the right direction, we are not asking all L-1B visas to be banned BUT to investigate the abusal of that visa category and we are just pointing out the incidents where we think its getting violated. Lets see who is on right/wrong side. We'll leave the decision part to ICE/USCIS/Other agencies involved.

L1fraud - what GC28... is saying is for DilipCr and not for you . Mr. Dilip has been touting himself as a highly skilled individual who is applying for citizenship now and wants that the rules should be made so hard now that no one else from India ( or for that matter anywhere else in the world is able to get EB GC ) . He says that most of the H1's and L1's are not BEST and the BRIGHTEST according to him .

Here is a summary of the bills, their bill numbers and the Sections:

Sen. Chuck Hagel's Bill (Section 202 of S. 1918)
-High-tech workers who have worked in the U.S. for 3 years would be allowed to adjust to permanent resident status without regard to the annual employment-based immigrant visa cap of 140,000.
-The spouses and children of immigrant workers would also be allowed to adjust status without regard to this cap.

McCain/Kennedy Bill (Sections 601 and 602 of S. 1033)
-Increases quota on EB immigrants to 290,000 to alleviate retrogression
-Recapture unused visas between 2001 and 2005
-Increase the per country limit from 7% to 10%

Cornyn/Kyle Bill (Sections 1001 and 1002 of S. 1438)
-Recapture of the unused visas between 2001 through 2005
-Removal of diversity visa and reallocation of these. Since this is mentioned under EB, the implication seems to be reallocation to EB but am not sure.
-Increase of the country limit from 7% to 10%

It is understood that there would be a merging of these to make the final comprehensive immigration bill

Senate Judiciary Committee Chairman Arlen Specter (R-Pa.) needed the assistance of the White House in early 2005 to overcome opposition within his own party to his chairmanship. In late November, Specter repaid the Bush Administration by unveiling draft legislation that would bring about a massive increase in government- mandated immigration to the U.S.

President Bush, in his immigration address on November 28, pledged to work for an increase in the number of green cards issued each year and stated his intent to work with Sen. Under Specter�s draft legislation, the cap on family-preference immigration would be increased by 254,000 visas annually and hundreds of thousands of additional relatives would be exempted from annual limits. In addition, Specter proposes raising the cap on employment-based immigration by 150,000 a year, and allocating any unused visas to other preference categories.

If enacted, Specter�s legislation would mandate the largest increase in immigration in this nation�s history. Moreover, according to FAIR�s analysis, such legislation would fuel the demand for still higher levels of immigration as more extended family members line up to follow an ever-growing number of immigrants streaming into our country.

I saw posts of several members extremely skeptical of the whole idea, even went on calling it stupid, crazy and useless. Some made mockery suggesting sending dead fish etc. I don't see any more posts from them.

Yes I was the one who suggested the dead fish. I belive in RESULTS, if sending these flowers actually ACHIEVES something, I will make a nice big biscuit of my words and eat them :).

Until we see ACTUAL "POSITIVE" RESULTS I am still going to be skeptical. Sure we have made a lot of noise and it has been heard by a lot of miscallaneous people. So were the rallies held by the illegals. What happened? NOTHING! So until I see some results YES I will STILL be skeptical.

Other than that, I really really really hope for everyone's sake, that this works and if it does I will eat my words and become a believer:)

So much for being mum eh ;)

Finally got the magic email, straight to card production ordered. After 12+ years in this country and 3 labor filings

NSC, EB2
Priority Date - 2/3/2006
Receipt Date - 7/2/2007
Notice Date - 8/10/2007
RFE - April 2009 replied promptly in a few days, status was stuck at RFE response received since then.

Opened SR on 8/4/2010
Filed DHS-7001 last week 8/11/2010

hadn't heard anything back from either of the two methods above.

knacath, I am hoping that EB2 will be current this year and EB3 begins to get spillover though very little this year.

Some more specifics

Annual Quota ------------------------------------------------------------------------> 140,000
Pending EB1, EB4, EB5----------------------------------------------------------------> 7,653
Estimate of all categories current applied this year and approved this year -----> 10,000
Remaining visas -----------------------------------------------------------------------> 122,347
All pending EB2s (includes retrogressed) -------------------------------------------> 74932
Remaining visas available to EB3(includes retrogressed) --------------------------> 47415

The only flaw in above is ignoring CP and assuming all 140K Quota to AOS. The majority of EB1, EB2 and EB3 are AOS. So I am safely ignoring CP. Even if CP is 15% of annual quota as some one put it, EB3 gets its allocated 40K quota and around 65K pending EB2s get out of queue.

I agree that it should be current. But knowing CIS ability to process, Shouldn't we ask DoS to move date of EB2 and make them current. So that the CIS will not waste them. They wasted earlier, So they can do it again.

It takes an year if not 2 for them to clear the new I485s. I don't anticipate many. But there will be some..

3. To top it all, its own "ineeficiency"
