My I-140 on EB3 category is under appeal and decision may come in Aug 2011. I applied for Labor in EB2 category in Nov.2010 but it went for audit. This audit decision might come after 20 months. If my I-140 of EB3 is denied then can I extend my H1B status based on pending Labor Audit. My current H1B is valid till Feb 2012.
Please advice.

Myself and my wife got first EADs with expiration of Sept 17, 2008. We both applied for renewal on July 14th, 2008 with TSC and my wife got her EAD under a month. My wife is using it work, where as I am still on valid H1b. My application was pending still then, I have called USCIS and put an expedite request on Oct 17, 2008. On Dec 3rd, my case status online updated saying, case transfered to one of the local office. I got a paper notice after 2 days saying:
for faster processing we have transfered your case to the following location.
and nothing in the next line, blank.
Even though I assume this was to faster my process, just wanted to know whether any of you have faced this.

Hello All,
I am currently working for Employer A for the past 6 years and my current H1 is Expiring in May End 2010. MY employer says he will file the H1 in may starting. In the meantime I got an offer from a future employer B who applied for my H1 transfer in premium processing. We got an RFE and the new employer is working on that .
My question is that lets say After responding to RFE by my future employer B , god forbid say the H1 transfer is denied. Would this denial have any impact on the H1 Extension that my current employer A plans to file in couple of weeks using I-140 approved petition. Please advice ?

What are people's guesses on how many of the BEC labor certifications will be rendered effectively useless because of this?
Also, does this mean it will be more straightforward to port PD after I140 approval (because the old employer has no benefit to revoking I140 anymore?)?

don't think their is a set time required. I know people that left their employer the day after gc arrived, know people that left 6 months after their approval and some that have worked for their employer even after receiving their green card for over 4 years. hope this helps

An employer did H1 processing for Ms.A on US Masters degree quota in 2007, but she decided to go back to school before the H1 kicked in (communicated the same with H1 sponsor/Employer) and is getting the degree (PhD Engg) in Aug 2010. Ms. A never worked on H1 and continued to be a full time student(made the mistake of telling the university about H1).
FYI: Ms. A traveled to home country and got back on F1 visa in Aug 2007
What solutions does she have now?
1. Get a job, continue on H1 and extend it?
2. Get back to F1 ( graduate in December instead of Aug. Really difficult to find other schools giving I 20 now!)
(Ms.A may have to visit home country this year for personal reasons and visa stamping is required to get back to US!!!)
Is there any other solution?
Do you think consulting two different lawyers is helpful in this situation?
How much may be the Attorney fee ?
Deeply appreciate your input.

I want to know whether I can legally open some business in USA. A sole proprietorship is the simplest business format in USA. I am currently in F1(OPT) visa and will be H1B visa sometime later. Whether F1(OPT) and H1B visa holder can legally open sole proprietorship in USA?
My attorney told the foreigner without Green Card can open business in USA but can't get paid. The sole proprietorship count all business profit/loss as individual income/loss for tax. (Form 1040 Sch C) I am afraid this is not legal for my current visa status.
Anyone here has opened business in USA without a Green Card legally? If yes, could you please share with us which type of company you opened? (Inc, LLP, or ...?)

when i had downloaded the "May-Preview" and "August-Preview" of expression Blend, it has 3 options for "New Project Type" :
1. Standard EXE
2. Control Library and
3. Silverlight Application (Java Script)
But when i downloaded and upgraded with the latest version, the last option (SilverLight Application) is not there.
Can anyone please tell me,
