    My LCA for H1B extn for 6 years is approved on July 15. But still my company lawyer is not ready to file the extn. He keeps on saying that I didn't get the approval notice from DOL, It's certified online only, So without physical approval document, I cannot proceed.

    Guys, Since it's certified already, Can he get a LCA detail and print using his account from iCert?

    I also checked the online status in iCert (he gave me the case No), the status says certified.

    So in this How long DOL took to send the physical copy of LCA?

    Since my H1B is expiring October, I need to file extn ASAP. My company lawyer is not helpful ...

    Your replies are much appreciated ....

    Is there any way that we can get the USCIS to update their Aug 2007 bulletin and write on top of it and the July bulletin was valid till Aug 17th.

    That way any officer who would check the Aug 2007 bulletin would first see the update and go by the July bulletin instead of rejecting I-485's in a bunch which cause additional hardships to the applicant in getting it reopened via MTR and again going through the long process.

    She could join from the day when the papers for transfer was mailed, this is as per AC21 law. She does not need to wait to receive the receipt from USCIS.

    yea its not a premium processing case. we r just trying to play it safe by waiting for the receipt. the new employer is not giving her grief or anything about joining quickly. the paralegal said that they are experiencing delays at uscis. i guess this whole bi-specialization thing is gona end up being another orginizational fiasco.

    Thanks for reply. I updated my profile. I just want to know there is going to be only 10 days gap between joining date of new employment and renewal of new EAD, will it create a problem.

    You would need to take an updated affidavit of support and you latest tax returns if you have filed for any dependents and they have been called for the interview also. Would be useful for you to take the I-140 approval with you. All your original certificates, including birth and marriage, employment letter, W-2's, medicals if the ones that you submitted have expired, you need to follow the list of documents as per the interview letter. If your spouse has been called for the interview you would need to take joint documents and photographs to show that it is a bona fide marriage.

    have u seen the legal immigration/ foriegn workers issue address by Bush today. althou he spoke just 1-2 sentences. stating that ' legal immigration system needs to be fixed, so that foriegn workers are in no harm

    Hi Gurus,
    My PD is 04/2002 and RD is 18/June/2007, EB3 India. EAD approved and fp done in Aug.

    There are no soft LUDs on my 485 after 7/17/2007. What does this mean? Is there a way to check if I am stuck in name check?

    I see many people with later RD and PD getting soft LUDs. Is anyone else in the same boat? Please advice..

    i am in same situation. i applied for employment base in Dec 2004 and family based in May 2006 through my sister. Rightnow i'm on EAD and my sister based F4 category have priority Dec 2001.


    You can apply in both category. when i was filing 485 (EB3), there is question if any other 485 petition is pending? The answer is "NO" even i have applied (I-130) under Family based GC. My lawyer said filing I-130 (for family based GC) is not consider as another petition (485) for GC. So it is ok to apply in both.

    Thanks a lot for the quick reply. I was also thinking to go for H1 as I don't have to renew EAD every year.

    My wife has worked on a project and got some money on 1099. and as I said earlier that she has taken SSN based upon her EAD.

    Does it mean that she has started using EAD ?

    and now her H4 is invalid ?

    I have got all copies of my labor, I-140 etc. and it has been more than 180 days that I have got my EAD. Do I need anything else from my old employer ?

    Hello -

    I am in sort of big dilemma. My Background:
    - Single (not married)
    - Currently on H1-B valid until Dec 2011.
    - PD July 2007. Company A
    - I140 & AOS filed concurrently in Aug 2007. Approved I140 (June 2008) & AOS pending. EAD & AP since Dec 2007.

    I am currently working (full-time) for company A who started my GC process since last 3+ yrs. And lately I am realizing that my growth opportunity in terms of salary (more importantly) & career is very limited & been looking out lately. To an extent that I feel so frustrated that it has started to affect my social behavior.

    Recently, couple of other employers have shown interest in me which align completely with my future goals. But, the problem is the following:

    - they dont do H1-B & willing to hire me on EAD. Hopefully, AC21 should not be a problem as the prospective job will be in the same area.
    - I am currently single planning to get married in a year or so. I want my spouse to have an option to be my dependent ie H4.

    So, I have following questions to experts here which will help me decide what option to take:

    1) Shall I go ahead with new employer & start using EAD ?

    2) My GC doesn't seem to get approved for another year or so. Is it worthwhile to keep the option of my spouse being on H4 open & get myself frustrated & spoil my career in current company?

    3) Can I move to EAD -> H1-B later? Maybe once I move out of this company A & join company B on EAD either company B or some other company may be ready to file H1-B petition ? This is just to open up the option of my spouse get H4.

    Please advise.

    Hello,

    Did you receive the compensation at all? If so, the deposit slips from your bank may be a possibility as proof of payments. If you haven't been paid at all, you might be a victim of a bad employer and you should report the employer to Department of Labor in US.

    If you are now entering US on L-2, there should not be any questions around your earlier H1-B, but the IO can always ask about your earlier stays in US and hold you up. Ask your employer to provide you a certificate on company letterhead with authorized signature stating the compensation provided to you while on H1-B, though 'I lost your paystubs' is a really flimsy excuse... ;)

    Please consult a good lawyer before making any decision...

    Temporary Protected Status and Expired Employment Authorization Documents

    One must accept a Temporary Protected Status (TPS) beneficiary's expired Employment Authorization Document (EAD) if DHS has automatically extended its validity in a Federal Register notice. Automatically extended EADs are listed on the USCIS web site. EADs issued to TPS beneficiaries will include one of two category codes: �A-12� or �C-19.� You must not require an employee to provide proof that he or she is a national of a country that has been designated for TPS.

    When creating a new case in E-Verify for newly hired TPS beneficiaries, select �Employment Authorization Document (Form I-766)� as the document presented and use the date to which the EAD was automatically extended as the expiration date. We recommend that you read the TPS information on the USCIS web site carefully, as the EAD automatic extension is usually shorter than the TPS extension date.

    When re-verifying an existing TPS beneficiary�s employment authorization in Section 3 of Form I-9, write down the date to which the EAD was automatically extended as the expiration date. Never use E-Verify to re-verify an existing employee�s employment authorization.

    Once the automatic extension of the EAD expires, re-verify the employee�s employment authorization again in Section 3 of either the original Form I-9 or a new Form I-9. The employee may choose to present a new, unexpired EAD, or any other document from List A or C of Form I-9 that shows he or she continues to be authorized to work in the United States. Federal contractors with the FAR E-Verify clause must follow special rules for verifying new and existing employees, including employees in TPS status. Federal Contractor needs to check the Supplemental Guide for Federal Contractors for more information.

    We are a canadian family who moved to the US about 10 years ago. We are US permanent residents; all have green cards. My husband lost his job in the US last month and we are currently staying with family in Canada until my husband gets another job. But this other job may be in Canada or in the US again. Until he gets an answer and we relocate, we would like to put our children in school so they don't fall behind by the time we get to our next destination - which could be about another month or so. If we place our children in canadian schools until then, will this jeopordize our green card or status?
