    Employer A with EB3 PD Feb2003 and I 485 filed
    Same Employer A is doing EB2 PERM with I 140 PD porting
    Is it possible to invoke AC21 in middle of process??

    1. is it possible to use AC21 after 140 approval??, any time constraints?

    2. what about between 140 filing and 140 approval?

    3. at what stage it is not safe?

    any advice please

    I have my AP approved H1 valid till 2009 but stamp expired. If I marry a non us resident and bring her on H4 and Myself enter in US using AP. Does it mean that my H1 is invalidated?

    Does it mean that my wife's H4 will be invalidated also and she becomes out of status since my H1 is invalidated?

    Or I am completely wrong here?

    I can't file her 485 since my PD is not current and also I cant have h1 restamped cause it takes way long to get it stamped.

    Any Idea?

    I've filed for I129 but I don't yet have my I-797C, Notice of Action form with me. I do have my receipt number and I was wondering if it was possible to find out the service center based on that.

    When I check the status of my case online, it does not include any information regarding which service is processing my application.

    If your receipt numbers begins with

    WAC - CSC service center
    EAC - VSC service center
    LIN - NSC service center
    SRC - TSC service center

    1. If my father applies for GC for me under F2B can it be converted to F1 when he becomes citizen?

    YES

    if so, will the priority date be same or it will be new once converted to F1 category.

    IT WILL STAY THE SAME.

    2. Can I apply for both family based and employment based in parallel?

    YES, THIS IS COMMON.

    if it is not possible which path should I select? Will the employment based GC will be faster of family based?

    FAMILY-BASED AS THE UNMARRIED CHILD OF A US CITIZEN IS PROBABLY FASTER, ASSUMING YOU ARE FROM INDIA.

    i applied for OPT in OCT no response from TSC for a long period ,contacted international officer--she emailed TSC got response no record of such case found.

    i had to apply again in DEC they cashed my check for this one so got to know my receipt number.

    so i cancelled check of first application as i thought that was missing.

    but problem is they processed the application for cancelled check and sent my EAD too.

    second application is withdrawn.

    now, they came to know that check is cancelled
    they put a status that fee payment rejected due to insufficient funds and ill receive a notice.

    i waited for 2 weeks received a notice saying ill receive a INVOICE notice from INS dept in which i have to pay amount for that case.

    NO INVOICE received and by the time i got my notice from uscis i called to INS they said u are a day late for payment--i said no invoice received so cant get back to you.

    i had payed the debt -- but INS said i was a day late
    it depends on uscis to decide............


    1) now will my application get rejected
    2) do i have any chances of refiling again (if rejected)
    as i graduated in december my I-20 will expire for refiling .?

    I plead moderators and users to reply me in this regard

    Does anyone have any experience how long it takes to get the Canadian visa if my family members who are visiting were to travel to the Canadian Consulate in Seattle.

    Earlier you used to get on the same day (in matter of hours), but apparently in March of this year, they changed their policy. "Minimum 24 hours" is not a very helpful indicator for planning :(

    Temporary Resident Visas (Visitor Visas)

    Applications submitted in person are accepted during our walk in hours Monday through Friday 8am to 10am. Effective March 8, 2011, applications submitted in person will no longer be processed on the same day. The minimum processing time will be 24 hours. Passports will not be returned until processing is completed. Processing times for mail in applications vary, please allow at least 4 weeks for processing. The Seattle Consulate does not provide expedited service, if you have urgent travel, it is recommended that you apply in person.

    I am also looking for form I-131.
    The current form expired on 02/282009, so they might be working on revision.

    I agree with you. The current form expired on 2/28 so they might post a new form tomorrow
