    This verdict opens up another front for the IV core- Judiciary.

    From my understanding , IV core has so far Lead/co-ordinated efforts to impress upon the congress and executive branch of the legal immigration issues.

    Judiciary can be used to further exert pressure on congress. Because ultimately relief has to come from congress.

    I saw posts of several members extremely skeptical of the whole idea, even went on calling it stupid, crazy and useless. Some made mockery suggesting sending dead fish etc. I don't see any more posts from them.

    Attracting and retaining the best and brightest minds from around the world is in America’s best interest. In February 2006, your Domestic Policy Council issued a report on the American Competitiveness Initiative that recognized the importance of employment-based immigration. The report stated:

    “The President also recognizes that enabling the world's most talented and hardest-working individuals to put their skills to work for America will increase our entrepreneurship and our international competitiveness, and will net many high-paying jobs for all Americans. The United States benefits from our ability to attract and retain needed immigrant and non-immigrant students and workers, and it is important that America remains competitive in attracting talented foreign nationals.”

    You can advance your stated objective by making common-sense administrative reforms to fix a system that is clearly broken.

    Implementing much-needed reforms will also free government resources to focus on pressing national security matters. For example, current rules require the Department of Homeland Security to renew the Employment Authorization Documents (EADs) of hundreds of thousands of legal immigrants each year as those immigrants wait for green cards and permanent residency in the U.S. Rather than renew these EADs annually, the government could renew these documents every three years, freeing countless hours that could be better spent serving the Department’s mission.

    The greatest impact of the broken green card process is borne by the legal immigrants and their families. The more than half million highly-skilled legal immigrants already working productively in the United States find themselves trapped in a system that is taking years longer than intended. During this wait for a green card, these immigrants remain trapped in a legal maze, unable to change jobs – even within the same employer – without starting the arduous immigration process over again, and subject to waits that grow longer and longer.

    We implore you to exercise your authority to implement administratively these much-needed reforms.

    • Recapture administratively the unused visas for permanent residency to fulfill the congressional mandate of 140,000 green cards per year.

    • Revise the administrative definition of “same or similar” to allow slight additional job flexibility for legal immigrants awaiting adjudication of adjustment of status (I-485) petitions.

    • Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.

    • Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.

    • Allow visa revalidation in the United States.

    • Reinstate premium processing of Immigrant Petitions.

    I urge you to implement these administrative remedies without delay. Action is urgently needed to fulfill your stated goal of attracting and retaining highly-skilled legal immigrants from around the world, eliminating bureaucratic inefficiency, and improving the lives of future Americans already living and working legally in the United States.

    Why not an interim AP or ability to travel using Original AP receipt before the actual AP arrives? The AP issue does cause a lot of disruptions in planned vacations or also in cases of unplanned emergencies.

    This House member is apparently retiring in 2007 after serving his current term.

    Here is an extract from his article that hits the homerun when it comes to retrogression. (please read this article entirely to get to know what this guy is all about).

    We rarely hear about the long and shameful wait of up to five years facing a person seeking to immigrate legally into the United States, or the legitimate cross-border business that finds roadblocks at every turn. Kolbe consistently pushed the government to treat the people caught in this bureaucratic wastelands with respect. To be sure, he was a strong advocate of tougher border enforcement, but he knew that enforcement should be only a single component of a much bigger strategy.

    This man is honest, candid and outspoken and unpopular:( at home(arizona) because of that. But the keyword here is candid and well-informed:). If the EB retrogression is presented properly to him, he could be an effective voice in the house.
    Now, does anyone live in Arizona's 8th congressional district who can do something here. Arizona's 8th is most of Tucson, eastern Pima County, all of Cochise County and parts of Pinal and Santa Cruz Counties.

    Can someone explain why it seems harder to find backers in the house than in the senate for immigration reform (even the employment based legal immigration)? If we understand this, maybe it will help us focus our lobbying efforts better. Just a thought.

    The constituency of a Senator is the entire state while that of a House Rep is usually much, much smaller. So the Senator needs to make sure that all his actions are more 'Inclusive' and do not offend a lot of people.

    But since the House Rep has much fewer and probably much more homogeneous set of people, the needs of his/her constituents are not that diverse and hence they can afford to take a hardline stance in many cases.

    I raised an SR on 8/25/2009. I got a response that my "case was being actively processed, allow 60 days for a decision to be made". I kept calling uscis, every CSR told me the same thing "wait until Oct 25, and then raise another SR". I got the CPO email on 10/22.
    As I mentioed in the previous posts, though I tried Senator, Ombudsman, calls thru my lawyer, I beleive that SR is the one that makes the IOs take a case out of a whole bunch and keeps it in the queue for approval.

    Heard the same from my lawyer, she has changed her tune completely in 2 days. Now she says that she is hearing the same thing and is possible. They are working through the weekend and has asked me to keep my blackberry on me at all times as they will be providing emails updates every 4 hours or if and when the said bulletin is released.

    Will USICS will release on the weekend?If they have any thing it should be today or they will do it on monday evening . They will do it on monday so that they are safe and cover their skin ( always say they received 100000 Applications and they are good enough for the dates to go back)

    Can we apply for I-485 individually and add the other as dependant at the same time?

    The employer will come up with many excuses to not interview a candidate or hire. If the law doesn't allow you to discriminate when hiring based on national origin or EAD or whatever, rejecting candidates even for an interview doesn't make sense.

    Interview is part of the hiring and recruiting processes. Would you say employers putting a job ad saying we will only interview someone from a particular nationality is allowed?

    However, the more important point is we are fighting to get multi-year EAD in IV among other things. The law doesn't allow discrimination based on EAD for hiring. Let the govt lawyers and employers figure it out if not even interviewing candidates because of EAD comes under the purview of hiring or not and if it is legal or not.

    yes, that is our line of logic and understanding. But seeing the number of experiences what we are having in real world, this does not seem to be applying. You are rightaway asked about your work status and they insist till you give them "specific" word - either "GC" or "Citizenship" or "EAD"... If this would have been the real way ( I and all of us wishes that) the these recruiting guys may not dare to insist till you spit the speific word out and that is before interviewing. In my experience, I always had verbal conversation. I have never been sent an email or letter by any company yet regarding their refusal not to even interview me based on EAD. Verbally 5 companies have starightaway told me "they are not considering me as I do not have green card yet - EAD is not enough". My thinking is that they do this because somehow some law may be covering them, we do not know that but they know that, perhaps..:confused:

    It is not true that all the H1bs are creating jobs. For one example I worked in a big garment company and they laid off hundreds of people(around 800) 4 years back and did offshoring 90% with 10% H1b and L1 to Infosys. This would have created less than 10 new admin jobs for setting up office here but it displaced 800 jobs plus all the new projects(jobs) go to Infosys and US government lost millions in taxes for a private company to save a few million dollars. But if a H1b is a real innovator or investor then he could create scores of new jobs but those guys are very less. They should be identified and rewarded by faster GC process.

    But real intention of H1b when it was created was to fill shortage of skills but not for competing with citizens in rate. If the real intention is to compete globally then that needs to be revealed while lobbying with Senators. There is nothing wrong with immigrants or H1b persons. Most abuses are done and enouraged by employers. Corporations prefers a person always to be in H1b so they want more H1b quota and less gc so that they can exploit people.

    Basically H1b numbers and offshoring needs to be increased when demand is high(Really it was needed on 1999 and 2000) and it needs to be decreased when demand is low. Also today also there is shortage of skills in a few areas. System should handle those also.


    Hunter, this is the first sensible post from you. Now you agree that abusers of this H1 visa system are corporations not the immigrants on their own. So far you were busy bashing immigrants.

    Also if US is a free market and capitalist society, why should corporates employ "whoever" is locally available. Its a private money afterall. Shouldent it be upto them to decide how to spend? Also most US corps, have local presence and as for taking a tax break, I hope companies did not promise to create "ALL" jobs in US. Majority of local jobs go to US citizens. They still create thousands of local jobs and pay H1 visa fees part of which goes to train american workforce. If the wages were equal, its more expensive for a company to hire H1 worker.

    there is one place where you enter petition info.. when I booked online appointment for mumbai.. I had to enter petition info online... it doesn't show up anywhere on any form but we do need to enter it online.

    Shove your condescending advise to where the sun never shines. It is NONE of your BUSINESS to tell me or anyone what they should be doing. No wonder average americans have started hating people like you and want to drive you out of the country.

    If you think that you can fool everyone all the time, you are sadly mistaken. Even by DOL estimates, there is 20% fraud with H1. The real figure could be a lot higher than that

    I am not the only one expressing these opinions in this forum, as I can see, "TN Man" has suggested pretty much the same here. There is no point in trying to close your eyes to reality.

    Senator Grassley and Durbin wants Google and Yahoo to succeed in US. But they don't want Indian cyber-koolies like the body shops and TCS/INFY/Wipro to steal american jobs under the guise of globalization.

    For all the geniuses out here, how many companies like Google or Microsoft or yahoo came out of India in the last 20 years? Yeah, that is what I thought too.. BIG ZERO. But if you read J(erk) Thomas' response, one would have thought that India is full of competitors for Microsoft and Google today :D :D :D

    Hey Hunter, so do you think India should buy from Boeing, Pepsi, Coke and even Ford? Should Indians be driving coolie cars made by ford? No wonder India would want to place a larger order with Airbus in return. And Dont you remember that during bankruptcy of airlines, Indian routes were their lifeblood and european routes were bleeding. So should we force to cancel a few more flights to India by these airlines?
