I had a question about using using AC21.

Here is the scenario: Let us say I work for XYZ Company who applied for my 140 and 485. I have approved 140, H-1b, EAD and AP.
If XYZ laid me off or I left them for career progression or more money 180 days after my 485 was filed and 140 approved, what happens to my 485 application?

Wouldn't USCIS question that since my sponsoring employer does not exist anymore, who am I going to work for once I get my green card? or is this coverd under AC21?

Please advice!

hi everyone

I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.

Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)

2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )

Any comments or suggestions will be appreciated.

I went to graduate school in the US, (majored in Architecture) and was on an F1 visa from the period 2006-2009.I graduated in Aug 2008 and applied for an H1 through a consultancy firm.The petition for an H1 visa was approved, but I decided to return back home anyway and came home in 2009.

2 weeks ago, I visited the States for a week for a conference on a B1/B2 visa. I eventually want to return to the States and work there and therefore, need advice in this regard...

Given that my petition for an H1 has been approved, will the company that offers me employment have to reapply for an H1 for me?Or can the H1 be transferred from the Consultant company(that got me the H1), to the new company easily?!

Any help in this matter will be highly appreciated!

I went to Infopass to enquire about my interfile status. The first level officer said since my PD is not current, she will not allow me to meet the IO. I argued that PD has nothing to do with knowing the status and allow me to meet the actual IO. she still did not. What a crap !!!

Dates can move two months to July 1st.

Does anyone know what the following status means for I-140:

Current Status: Document mailed to applicant.

On July 16, 2007 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.

Is this GOOD or BAD?

Does anyone have experiance with similar status change?

Understood. However, my question is still is unanswered. My question was when can I apply for the new 3 year H1-B term

Scenario1: I can apply after 1 year anniversary of leaving H1 adding the 15 days spent in the US on B2 status ?

Scenario2: I can apply after the the 1 year anniversary of my last entry in the US which is obviously on B2 visa since I have entered a couple of times on B2 after leaving H1 ?

Question 2
A related question is how does the USCIS know my H1 cancellation date ? Do I ask my previous employer for it ? It cant be my last US paycheck date because my employer put money in my account a few months after I left H1 as well because of some payroll issue. The H1-B visa stamp was cancelled also few months after the actual leaving H1 date when I got my B2 stamp .
