I filed 485 on July 2nd with an EAD with receive notice date of march 2007. it is not approved yet. Will I get an EAD even before the I140 is approved or should the I140 be approved for the EAD to be issued.

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. Hello Gurus,

I got my EAD in 2007 and have been working for the sponsoring employer till now (Of course on EAD). Now I found a new opportunity w/ an excellent pay.

My designation and responsibilities at new employer are pretty much same as the current one but I see the difference in the salary --It is two times(2X) the current salary.

Is it OK if I accept this position with double salary?

Hi,
Recently I transferred my H1 to another company. My H1 and my wife�s H4 got expired on last August 2nd 2007. However, the new company filed H1B application and it got approved 2 weeks back, but forgot to file for H4 extension for my wife. My company is saying they will file for H4 extension (I-539) now, even though her visa/I-94 got expired and she doesn�t have to go back home. Do you think they are on right track? I�d really appreciate if anyone could suggest me on this.

The Los Angeles City Council has approved a measure barring city workers for traveling to Arizona on official business and also banning the city from contracting with Arizona businesses. Some contracts for key infrastructure items are not affected, but the LA Times estimates that the vote will cost Arizona upwards of $8 million per year. The biggest contracts not affected are those involving the airport and sea port. But the civilian panels overseeing them are considering canceling contracts worth $26 million. Hi,
I wish to scroll horizontally using two custom buttons (a left & a right one) in a FlowLayoutPanel, while disabling the autoscroll properties, as I do not wish to have the scrollbar. The controls that will be added into the FlowLayoutPanel will be subjected to changes, as it depends the number of data in the database.
So is there any tutorial/website that anyone can recommend for this related problem?
And also, I do know what to put for my horizontalscroll.maximum and minimum value as my flow direction is RighttoLeft.

Any one had luck refiling I140 in EB3 for denied EB2 I140 (for same labor)?

Also is it possible to request USCIS to change an EB2 I140 denied partition to EB3 during an appeal?

It depends on several factors...
Example PERM Job requirements, reason for 140 denial...etc

My sister's H1B petition was approved on 2008 and she was unable to travel US for the past 1.5 year.

She is working in a MNC company in India. Now, she came to US on her B1 visa 1.5 month back. Meanwhile, she got an offer from a client in US and she want takeover the new job on her approved H1.

So, can you please let me know whether the employer (whoever filed my sister's h1) can file the H1B amenment while she in US with B1 visa and having H1B approved petition? If so, how many days she has to wait to get the approved amenment to start her work at client place? The employer is going to do the premium payment so that can we assume the amenment will be approved for sure?.

The LCA is really required for H1amenment? Please advice. This is really urgent.

Hi All,
One of my friend has been working for a desi company for 6 months and now is moving to another company.

In the desi company offer letter there is no information regarding leave encashment and it says that he is eligible for one day leave per month.
There is no statement regarding leave encashment policy in the offer letter

So if he resigns now will he get any leave encashment or is there any virginia state laws governing the leave encashment
