A few weeks ago, I posted a story written by one of our clients, a Registered Nurse from the Philippines employed by a hospital in the U.S., who was stopped and held by CBP officers as she and her family tried to drive north from their home in El Centro, California near the U.S.-Mexican border to Palm Springs to celebrate her husband's birthday. YOu should go ahead and file your response to RFE. I had the same issue with my case when my attorney did not inform me of a RFE. After missing the deadline, I filed my repone through a different attorney explaining the problemand USCIS accepte my response.

Hi,
I am going back to India by next week. But my L1B extension is still pending (We applied for ext., before it expired and recieved RFE and responded. So as of now its more then 6 months from the date of I-94 expired and still my petition is in process).
My question is,
- while going back, do I need to show the copy of reciept in Port of Entry? (as I need to return my I-94 which is expired long back)
- Will it create any problem when I apply for extension again?
(My employer say, it shouldn't be a problem as I will have Approved/Denial notice which prove that I maintained legal status)
Or is it worth to wait here until I get the decision? (as I may cross 240 days by Jan, I am not sure whether the decision will come before that)...
Please adivce.

1)I am on H1b visa and currently i am on bench. My 140 is approved and my H1b is expiring on sep30 ,2009. I got rfe for h1b extension asking for client letter.

Diversity Lottery ends in FY08. As a baby step, to offset this why dont we ask these numbers - 50,000 to be added to EB visa quota?
I'm sure most senators will be agreeable to this - getting 50K immigrants with skills(in the future) vs 50K immigrants only

I just checked that Nebraska is now processing cases from August 2007 for I 140 applications. Do these also indicate China and India?
My pd for I 140 is in July, and I am from india. Should I be able to make a query since the dates have gone past my PD?

Hi, I have/had valid I-94 all the time. Recently I renewed my passport in US. But I renewed it 3 months after expiry of old one. I heard from friends that, you need to have valid passport for the entire period of H1B petition validity. Wondering, If am in trouble for not renewing my passport before it expired. Please give your opinions.

you do not have to apply for COS, if she wants she can get h4 stamped when she travels, but is moot anyways as she plans to use EAD anyways nullyfying her H4.

I am planning drive to Halifax or Quebec end of this month.
I am intended to use �AUTO VISA Revalidation� rule.
